The applicant seeks the following development standards variance approval:
Docket No. 12090012 V ZO CH.23C.09K.2.e EIFS not to exceed 10%.
The site is located at 10206 N.Michigan Rd and is zoned I-1/Industrial within the Michigan Rd. Overlay Zone. Filed

u , with the Plan Commission and is the result of the
many changes the petitioner has made to the
architecture to better incorporate the Italianate architectural style permitted by the Ordinance. The building will also
consist of a significant amount of stone and the EIFS will not be located at ground level so it should not be damaged as
easily. The Department is in support of this variance as the petitioner has worked with the Department and the Plan
Commission on the architectural design of the building and the proposed architecture and materials provide a better result
than was originally proposed.
Findings of Fact
1. The approval of these variances will not be injurious to the public health,safety,morals,and general
welfare of the community because: the building will also have stone on the façade, the proposed EIFS will not
be at ground level, and the EIFS should not detract from the character already established in this area by previous
developments.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the building will also have stone on the façade and the proposed EIFS
material should not detract from the character and sense of place already established in this area by previous
developments.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: while this property will still be viable for other development,it
will be difficult for an Olive Garden to build here without this material which was added to better meet the
architectural style requirements of the Michigan Road Overlay.
Recommendation:
After all comments and concerns have been addressed,the Dept. of Community Services recommends approval of
Docket No. 12090012 V.
