Pilkinton Commitments - REVISED 11-26-12 Sharon, The commitment to the City needs to come from the current entity, the developer. It is then the developer's responsibility to convey this commitment in any future sales agreements of the lots. We cannot accept a commitment from an unknown entity (a future lot owner). If the Pilkintons want to make a future lot owner responsible for the construction of the path or meeting the City's Stormwater Standards, then that should be part of their private negotiations/sales We will ensure that the secondary plat is on next week's BPW agenda for approval. The commitment that I sent to you last week will he included with the secondary plat to the BPW, as a contingency of approval. Please contact me with any questions. I just got off the phone with Mrs. Pilkinton's realtor, who called me with concern after finishing a conversation where she was in tears. This I do not doubt, as I have had multiple conversations with her in the last few days, answering questions the best that I can at this stage, and doing my best to keep her spirits up despite our primary plat approval Tuesday evening. The issues we are encountering with engineering while frustrating to me, are absolutely devastating to her , with not one but TWO real estate deals hinging on the timely completion of this process. With tomorrow's deadline for the BPW agenda looming and still no response from anyone in engineering, we must cover all of the bases that we can. May I please request your assistance in facilitating the timely review and approval of Lot 2, at the very least, so that the imminent transactions may be completed? If there are still issues to be worked out on Lot 1, we believe that they are minor and do not affect Lot 2. After all, it is an existing homestead with no additional improvements either planned or necessary - and even if future improvements were desired on Lot 2, the commitment language is structured to hold them to performance. We can have the existing document recorded immediately, or we can split it up so that each lot has its own commitment document. We are not trying to be difficult or "color outside of the lines", but rather, trying to be sensible about the Lot 2 separation given the circumstance and working within the existing parameters. My understanding is that the petitioner needs to demonstrate compliance in order to induce approval of the plat. If the commitments are ok per Molitor or Haney, I am ok. Seems like future red tape for the City and future lot owners to me. Better to take the commitment now from the petitioner and have them work this out in a future sales agreement. Just my opinion. It is the subdivision developer's responsibility to convey any responsibility for the design and construction of these improvements to the buyer of Lot 2 or future buyer of Lot 1. The City will not be responsible for enforcing who constructs the improvements. So this does not need to be a part of the commitment letter to the City. The original commitments were drafted based on language from the approved and recorded commitments for the Patel subdivision adjacent to the north. Upon additional review, those commitments accommodate the individual lot owner language pertinent to a minor subdivision such as this, and is much more appropriate. The "developer", in this case the Pilkintons, is setting forth/placing the commitments upon the property, but the responsibilities are placed upon each individual lot owner to perform. The Pilkintons simply will not be responsible for construction of the path along the frontage of Lot 2, nor will they be a part of any future improvements that the owners of Lot 2 may decide to initiate. By virtue of its recording, the commitments will attach to each lot and transfer with any sale (including the imminent sale of Lot 2) accordingly. The commitment language as constructed is still enforceable by the City,just as any other ordinance requirement, so we believe that the intent of the commitment is preserved Since copies of the commitments were provided in Plan Commission packets, I have also provided copies of this revision to PC members via email. Attached is the thoroughfare plan map from that section of the comp plan, and Six Points Road is not even shown. I doubt that this is an oversight, because Six Points is identified a few pages later in the bicycle plan with regard to side paths. The Pilkintons are the owners, and even though they are initiating this subdivide and they will continue to own Lot 1, they aren't developers - these commitments will run with the land regardless of whether Lot 1 is eventually sold or not - unsure as to why this needs to be altered to something for which a description really does not exist. Everything else is workable and just language...but I question why this is the first moment we have received these comments on the commitment language (4:30pm right before a 6:00pm plan commission meeting), when Gary sent you his comments on September 18th. We understand that the Patel's installed a shared driveway but the extenuating circumstance here is that we have an existing home with existing improvements. When he finally contracted with a Registered Land Surveyor,Troy Terew,Troy told me that he encouraged Kunkle otherwise because he felt it was common knowledge to limit curb cuts on major roads and it was not something Kunkle should be trying to ask for relief from. We would obviously prefer for Pilkinton to have only one driveway,but let us know your thoughts! They received the plans at the same time as all other TAC members, BEFORE we filed our petition, and then again one week later when I had not heard from several members/departments. Additionally, when the revised drawings were sent pursuant to the original staff comments, they received a copy...yet, only reviewed the original documents. Given the fact that Mrs. Pilkinton had also been talking with Carmel about this for several weeks before we proceeded with a formal petition, certainly you can imagine the distress that the additional driveway commentary at this time has prompted. At no time previously did anyone mention any possibility of an issue with separate driveway access to Six Points Road. Simply, we are working within the confines of the City of Carmel ordinances to split this property. "Lot 2", the existing home with improvements and existing driveway, is not changing - no construction is planned, it simply needs to be split so that it can be sold. The terms of this currently contracted sale do not accommodate a shared driveway, nor will that be an option for the buyers. "Lot 1", the remainder vacant land, must have access to Six Points Rd. to avoid being landlocked. The frontage of the access area for Lot I. is 94+/- feet - and this is a significant amount of frontage that is more than capable of accommodating a common single family driveway width; let alone its projected distance away from the Patel driveway (455+/- ft) and the Lot 2 driveway (245+/- ft). We believe that addressing the stormwater issues are more easily addressed through commitments pertaining to future construction and do not have issues with this, although the request for application for a drainage variance are distressing as well - the time that it takes to get through this are just simply prohibitive to getting Lot 2 separated and sold successfully - since the balance of the City's questions/uncertainty with development and standards rest with Lot 1. In the future, if the thresholds are exceeded for when storm water detention and storm water treatment are required, where will these facilities be placed? How will they be constructed such that they benefit both properties?Do they need to benefit both properties? Can the proposed lot layout actually accommodate these facilities?The standards require such facilities to be located in common area and easement...not on an individual lot. In the meantime, the publisher's affidavit arrived in my mailbox yesterday - I will bring it by tomorrow when I drop off the plan commission materials. I met last night with the Morrows to discuss/address their concerns. Truly, I don't think they would have found issue with anything if it weren't for these two facts: (1) modern surveying methods using GPS do not follow the exact path of installed fences on boundaries originally established using rods and chains; and (2) their next door neighbor has let their property deteriorate to the point of being a nuisance and eyesore. They were astonished to learn that the actual ownership boundaries of the Pilkinton property are approximately 1 foot west of the fence that they (Morrows) installed 20-30 years ago, and this is what set their minds in motion. (In fact, Cheryl Pilkinton's property lines to north and south were not what she thought they were, either) This is a farm fence that really is still in decent shape doing its job but they think that "it's getting close to time to be replaced". Greg Morrow has his mind set on a privacy fence because he is just convinced that someone is going to build an awful house and barn on the remainder Pilkinton parcel and they don't want to look at it because it will look like the next door neighbor's property (adjacent to the east). To ease their concerns about the property line, I had SEA Group compare data with Weihe Engineers, who had just done a survey fairly recently for a neighbor adjacent to the Morrows to the northwest. The two surveyors' data is in agreement and in fact, it shows that the Morrows west property boundary is almost 1 foot west of the other neighbor's fence. Finally, they found a legal description last night that, upon tracing, SEA Group says meets the corner marker as surveyed in connection with the plat. The Morrows refuse to believe this is correct, so I have offered to call around to some other survey companies to see if I can find someone who will inexpensively survey their east property boundary so they can feel as certain as possible that they have an objective opinion. They (the actual property owners, not Greg) were relieved to learn and understand that we are only platting to the fence line. They (Greg) continues to press for a privacy fence and I explained that I would present to Cheryl for consideration but set the expectation that she may not agree to do such a thing because nothing is changing, and the back of her property faces a farm field. I went through the various sections of the ordinances with them to help them find a comfort level in that because this is now becoming a "subdivision", there are various regulations and guidelines that must be adhered to that will help to ensure that this property does not become like their next door neighbor. I know the elder Morrows seemed to grasp this and sensed some relief on their part, but I don't know about anyone else... In any event, Cheryl has the information for consideration but already has indicated she will not agree to a privacy fence - the Patels back up to the Morrow's farm field, too, and they weren't requested to do such a thing. Plus,privacy fences do become a maintenance issue over time and do not have near the life of the existing farm fence. In short, I cannot say if there is an appropriate solution on our part to the Morrows' concerns because it really has more to do with their next door neighbor than with this subdivision. I talked over your concern with the Director of our department as these minor subdivision have been an upcoming topic. It was decided that we would not require additional perimeter bufferyard landscaping for minor subdivisions, but to review and manage the existing landscaping where appropriate. So, I have attached an example of a site plan that I would like for this project. Simply, a site plan that notes the existing trees that will be preserved during construction. Hopefully,this will answer your question and also provide us with a level of tree preservation. Additional landscaping and plantings will not be requested for this project.
