C1O2' SITE PLAN.POF.PDF; Carmel - Mich Rd- Recorded Plat 1of212'U8U3.pdf.pd[odf Hi, Eric: When looking at both the recorded plat and the ADLS/site plan approval for Outback, yes, we can probably administratively approve the building 's side yard setback to shift from 20-ft down to 15-ft. However, there might be a conflict with the plantings Iocation and that 15-ft wide DUE & WQE along the north property line.... Please take a look at that, too, before we officially approve any changes. Usually, we like to have easements separate from the planting strips so that the plants could not be wiped out by a utility clearing their easement. In this case it might be okay if that WQE is for water quality and promotes plantings in that area.... but I do not see a WQE on the recorded plat —just the site plan.... And, of course, all this will affect the approved landscape plan, so Daren Mindham (City Forester) will have to re-review an amended landscape plan, but I think it will still meet the landscape regulations at 15-ft wide, with a 10-ft wide side yard bufferyard plus a 5-ft wide building foundation planting, making 15-ft total. Eric- It might have been because it was considered a business use? Which would allow for a lesser side yard setback? If you re-read the overlay ordinance, it talks about zones or uses.... Not just the zoning district.... Importance: High Angie, Outback is kicking up again... We have shown on our Site Plan (attached) 20' BSL on the north property line. Thompson Thrifts Surveyor recorded the plat with a 15' BSL. (attached) The area requirements under Michigan Road Overlay indicates: Section 23C.08.03.0 - Next to manufacturing zone or development: twenty (20) feet. The north adjoining property 15 1- 1. Some Some questions.... A — how did they get this recorded 5' less BSL (Did they get a variance?) Am I reading the ordinance incorrect and 15' is correct? B — now that the plat is recorded, can we change our plans to 15' BSL (with the option of moving the building up to that lS'BSL?) C— if B above is correct, do we have the option of moving the building with Administrative Staff review? D- is our plan correct and they have to record a certificate of scriveners error with a 20' BSL? Hopefully you can look into this as soon as possible.
