This Indenture Witnesseth, That Quadrant Development Company, Inc. ( "Grantors "), of

A part of Lots 10 in the Foster Estates- Section 3, an Addition to the City of Carmel in
Hamilton County, Indiana, as per plat thereof, recorded in Plat Book 16, Page 39 -40, in
the Office of the Recorder of Hamilton County, Indiana, and being that part of the
grantor's land lying within the right -of -way lines depicted on the attached Right -of -way
Parcel Plat, marked Exhibit "B ", of the Hamilton County Highway Department's, 146
Street Project, the Carey Road Segment, described as follows: Beginning at the grantor's
northwest corner of said Lot 10, thence along said grantor's north Lot line , North 89
degrees 53 minutes 36 seconds East, 45.720 meters (150.00 feet) to said grantor's east
Lot line of Lot 10, thence along said grantor's east Lot line, South 26 degrees 40 minutes
09 seconds West 5.946 meters (19.51 feet) to the point designated 319 on said plat;
thence South 89 degrees 53 minutes 36 seconds West 1.387 meters (4.55 feet) to the
point designated 318 on said plat; thence North 84 degrees 01 minutes 05 seconds West
30.169 meters (98.98 feet) to the point designated 317 on said plat; thence South 89
degrees 53 minutes 36 seconds West 11.670 meters (38.29 feet) to the point designated
316 on said plat and to said grantor's West Lot line of Lot 10; thence along said grantor's
west lot line, North 00 degrees 16 minutes 51 seconds East 2.108 meters (6.92 feet) to the
point of beginning, containing .0150 hectares (0.037 acres), more or less.
TOGETHER with the permanent extinguishment of all rights and easements of ingress
and egress to, from and across the limited access facility (to be known as 146th Street) to
and from the grantor's abutting lands along the lines described as follows: beginning at
point 316, through point 317, through point 318 and terminating at point 319 as shown on
said plat. This restriction shall be a covenant running with the land and shall be binding
on all successors in title to said abutting lands.
