I have attached a revised site layout that illustrates the changes that have been made to the site This is an earlier version of what Eric sent with the dimensioning turned off. As you can see the site plan has been revised so that both buildings meet the 120' setback. We need to meet with Rachel Boone so we get the revisions to the sign in compliance regarding the logo and overall square footage With these items addressed variances would be required for (I) building offset reduction, (ii) second sign, and (iii) drive- thru stacking on the side of the building The revisions eliminate the need for variances regarding (i).maximum 120'setback, (ii) maximum sign area,gand (iii,);rogo Lpereentage We therefore have decided to,%withdraw these three variance requests. Subject: BZA 1'c'\ • Dear Connie, I am writing comments on the following proposal of Michigan Road and request that you forward to the commissions members. 1. A two multi-tenant buildings with a fuel canopy is proposed on the west side of Michigan Road on land zoned I-1/Industrial. They will be seeking a number of variances from the BZA: a. Drive-thru lanes on the side of the building rather than behind. b. Reduced façade offsets on two sides of the building. c. An additional sign, which also puts them over the permitted sq. ft for signs. d. Increasing the size of the logo on the sign from the permitted 25% of the sign to 32% . Setting the building more than the 120' feet from the road that the Overlay Zone requires As one of the onginal wnters of the Michigan Road Overlay Zone, we wanted the rules in place to make the requirements easy for the developers to follow. I am a little surprised that this developer wants to change rules this late into the development of the overlay zone. The land is generally flat and rectangular. It does not have a stream on it or unusual characteristics. The Starbucks, Wendy's, Burger King, and Walgreens have their drive thur's in the rear of their buildings. The buildings are screens to this. The drive-thru needs to remain the back. We need to continue with our façade requirement like the rest of the new buildings. We need to maintain our sign conditions as to colors, style, height, numbers, and size. The logo should remain at 25% like the rest of the overlay zone. We do not want a sea of cars so the 120' is imperative to maintain. As we have also expressed to Plan Commissioners, we are concerned about a trend that seems to be developing with new businesses wanting to benefit from the success established within the Michigan Road Overlay Zone while at the same time, they ask for exemption from fully meeting those standards. These are"standards,"not"guidelines." Certainly you can use your judgment, but the standards are meaningful only to the extent that they are upheld. We ask you to carefully consider the necessity of any deviation from holding the newcomers to the standards met by those who came before them. Every exception makes it more likely that other businesses will also seek similar exceptions (especially regarding signage limits and drive-thru locations). Please also remember that there are people whose sole expenence of Carmel is through this gateway area. The standards set and met do matter to this area's continuing success. Of course,the BZA would have to vote on that rule suspension. You could still get your public notice out in time to be published by the 9`h, and that would be about a 17-day prior public notice, rather than a 25 day prior, so that would mean a Waiver of about 8 days.
