At that time, it was discussed that if the roundabout moved forward,that Kite would be agreeable to dedicating additional right-of-way on the SW corner at such time as the property redeveloped so as not to affect the redevelopment of the Centre property. If the Kite is contending that the current plan for the former bike shop does not need to conform to Section 2.09 of the zoning ordinance, since it is an ALDS Amend, I have no issues with that.They could argue that to what they were referring at the meeting was a total or partial redevelopment of the site and not a tenant buildout (plus some exterior work)..Future redevelopment of the parcel will be subject to the requirements of Section 2.09. What we are looking for is a commitment for the additional right-of-way on the SW corner that would be needed to locate the roundabout so that it does not affect the Centre. Moving the roundabout would not be necessary if the plan for the redevelopment of the Centre had dedicated the necessary right-of-way per the roundabout plan presented at the meeting on March 8th Please let me know if this makes sense. 'r ti p o o. 0 o z o t19 F- a• � W , ti ti Q DRAFT For Discussion Purposes Only September 21,2012 SIDEWALK CONSTRUCTION AGREEMENT This SIDEWALK CONSTRUCTION AGREEMENT ("Agreement") is entered into day of September, 2012 by KRG Centre,LLC, ("Kite") and the City of Carmel,Indiana, an Indiana municipal corporation("City"). RECITALS WHEREAS, Kite is the owner of certain real estate (the "Kite Parcel") located at the northwest corner of the intersection of Range Line Road and 116th Street in the City of Cannel, Hamilton County, Indiana which is more particularly described in Exhibit "A" attached hereto and made a part hereof; and WHEREAS, Kite is involved in a project for the redevelopment of the retail center located on the Kite Parcel(the "Project); WHEREAS, during the process to obtain the necessary zoning approvals for the Project, Kite requested and obtained a variance from the development standard requirement for the sidewalk along Range Line Road to be a minimum of eight(8) feet in width(the"Variance"); WHEREAS, as a condition to the grant of the Variance by the Cannel Clay Board of Zoning Appeals, Kite agreed to enter into an agreement with the City for either: the payment to the City of the cost to construct and install the required eight(8) foot sidewalk(the "Sidewalk") as a part of the streetscape and infrastructure improvements to Range Line Road (the "Range Line Road Improvements"); or the construction and installation of the Sidewalk by Kite in coordination with the Range Line Improvements; WHEREAS, Kite and City wish to enter into an agreement for the construction and installment of the Sidewalk; NOW THEREFORE, in consideration of the sum of One Dollar ($1.00), the foregoing Recitals, all of which are incorporated herein, the following mutual covenants and other good and valuable consideration, the receipt and sufficiency of which the parties hereby acknowledge, the parties agree as follows: DRAFT For Discussion Purposes Only September 21,2012 1. Notice of Commencement of Range Line Improvements. Within thirty (30) days of the final approval of the plans for the Range Line Road Improvements, the City will contact Kite and inform them of the approval of the plans and the schedule for completion of the Range Line Road Improvements. The parties agree to meet within ten (10) business days from Kite's receipt of notice from the City, at a time and place mutually acceptable to both parties, to review the plans, agree upon how to proceed with the construction and installation of the Sidewalk and agree upon the cost or the method to determine the cost of the Sidewalk in the event that Kite elects not to construct and install the Sidewalk. 2. Options for Construction and Installation of Sidewalk. Following the approval of the plans for the Range Line Road Improvements, Kite will have the following options for the construction and installation of the Sidewalk: a. Kite will agree to construct and install the Sidewalk in coordination with the Range Line Road Improvements at its sole cost and expense with such construction and installation to be completed consistent with the completion of the Range Line Road Improvements; or b. Kite will agree to reimburse the City for the mutually agreeable cost of the Sidewalk as a part of the Range Line Road Improvements within six (6) months of the date of final completion of construction and acceptance of the Sidewalk by the City. It is understood and agreed that Kite will be responsible only for the cost of the construction and installation of a standard eight (8) foot wide sidewalk from the south to north property lines of the Kite Parcel adjacent to Range Line Road. The cost of all modifications from or upgrades to a standard eight (8) foot sidewalk in design, materials or scope will be the sole responsibility of and be paid by the City. 3. Agreement Running with Land. The rights, agreements, duties, obligations and responsibilities set forth in this Agreement will run with the Kite Parcel, be binding upon and benefit Kite, and its successors in fee simple title to the Kite Parcel, and the City. It is acknowledged and agreed that this Agreement will be recorded following execution in the Office of the Recorder of Hamilton County,Indiana. 4. Termination. This Agreement will terminate and expire upon the earlier of the date upon which the construction and installation of the Sidewalk is completed by Kite and accepted by the City, if applicable; the payment in full of the cost of the Sidewalk by Kite in accordance with and pursuant to subparagraph 2 b. above, if applicable; or the date ten(10) years following the date of execution of this Agreement. As of such date all rights hereunder will terminate and the parties will be released from all obligations hereunder. 2 Kite—City of Cannel Sidewalk Agreement DRAFT For Discussion Purposes Only September 21,2012 5. Notices. Any and all notices, demands, requests, submissions, approvals, consents, or other communications or documents required to be given, delivered or served or which may be given, delivered or served under or by the terms and provisions of this Agreement or pursuant to law or otherwise,will be in writing. All notices will be either (a) sent by overnight delivery using a nationally recognized overnight courier, in which case notice will be deemed delivered one business day after deposit with such courier, (b) sent by certified or regular U.S. mail, postage prepaid, in which case notice will be deemed delivered two business days after deposit in such mails, or (c) sent by personal delivery, in which case notice will be deemed delivered upon receipt or refusal of delivery. Please call out that existing curb shall be demolished to the nearest joint past the limits necessary for the new entrances and closing of the existing entrances.The existing curb shall be sawcut at these joints. Sheet C201 c. The ADA ramp on the south side of the northernmost entrance indicates the ramp starting midway through the sidewalk that runs east-west into the site. Thank you for making the revision.However,would it not be better to leave the east-west walk into the site along the previous alignment and simply move the ADA ramp along Rangeline Road farther to the south?I am concerned that the landing per the current plan is not adequate in size to allow a wheelchair to move down the ramp and then turn to access the sidewalk entering the site. f A City standard depressed curb is required across the northernmost entrance. Please label the depressed curb location on the site plan. h. Will there be any wall tiebacks within the right-of-way?Thank you for your response. i. Have the proposed retaining walls been designed by a structural engineer?Thank you for your response.The sheet containing the retaining wall details is stamped by Colin Patterson. On C201,landscaping is shown in the right-of-way. Proper variance and a Consent-to- Encroach Agreement are necessary for this landscaping material to be located within the right-of-way. 11. In the site plan legend on C201-203: a. The permeable paver section is identified as PA-2 and PA-3. It should be PA-21. b. The curb ramps are labeled as AC-3. This detail could not be found in the plans. c. The chairback curb is labeled CU-1,CU-9. The detail CU-9 could not be found in the plans. 12. In the site plan key note legend on C201-203: Concrete joints are Iabeled as detail PA-28 and should be PA-2A. 13. On C201-203,the hatching appears to be the same for the different types of concrete specified. 14. On C203 at the southernmost entrance on to Rangeline: a. The depressed curb is labeled S27(chairback curb). b. What is S2 identifying on the plan view at this entrance? 15. Per conversations,please update the MFPG and MLAG for each building. 16. If vehicle detector loops are desired for the exit onto Rangeline Road at the intersection of Medical Drive,these may be installed by the Developer provided that the Developer provides the proposed signal timing modifications to the Department for review and approval.All costs associated with the installation of the vehicle detection loops and signal modifications shall be borne by the Developer. We require a minimum I4-foot entry lane.It is customary to have a dedicated left lane with a through/right lane.Are signal modifications needed to accommodate either configuration? 20. Sheet C203 a. Is the path shown along 116th Street existing?If it is proposed,why is not being located at the back edge of the right-of-way? b. Is there an existing ADA ramp on the west side of the 116th Street entrance? c. What discussions have occurred regarding a chamfer of the right-of-way at NW corner of 116th Street and Rangeline Road? d. Sheet C207: Does the stone matrix have the capacity to receive the peak flow from the piping system around the building or will this piping system back up below the 10-year rain event? 24. It is not typical that DOCS hires outside help for design review,although we have for this and CVS, because the corners locations are so visible and too important that having the extra eyes and experience with design is very helpful to staff and me. In the letter John brings up some issues that will be easy to address, and then there are a couple which probably won't be so easy. It is not my intent to share this letter directly with Plan Commission members at this time, but to work with you on these issues along with those raised by DOCS and the City engineer's office. It is not typical that DOCS hires outside help for design review, although we have for this and CVS, because the corners locations are so visible and too important that having the extra eyes and experience with design is very helpful to staff and me. In the letter John brings up some issues that will be easy to address, and then there are a couple which probably won't be so easy. It is not my intent to share this letter directly with Plan Commission members at this time, but to work with you on these issues along with those raised by DOCS and the City engineer's office. The proposed Walgreens Pharmacy design is in response to the City of Carmel's review and comments regarding the original proposal, and a conceptual site plan, conceptual elevations, and conceptual perspective sketch prepared by John Mosele Architect in October 2011. This evaluation will take a two tiered approach in the review of the proposed building. We will critique the building as to its floor plan, massing, elevations, use of materials, scale, and the image it projects to the public as a stand alone building. Additionally, we will evaluate the building in its context; how it relates to its environment and its design response to this unique site. While the first approach will suggest changes we feel will better the overall design, it is only when the contextual implications are understood and addressed that a significant and meaningful architectural statement can be created. As a stand alone building, the design of the proposed building uses a combination of brick, metal panels, aluminum windows, and EIFS. The perspective sketch illustrates a taller metal coping at the screen wall of the service area in keeping with the metal panels of the two glass and frame entry `boxes'. However the use of the EIFS for the sloping roof of the main structure, while an appropriate form, is not in keeping with the metal skin of the other elements of the design. A more appropriate material would be to use metal panels to create this roof line. The entry `boxes' are equal in size, shape and visual importance, and yet they are not equal in function. The south `box' is merely an exit with no entry to the facility. This will be confusing to the public. The inclusion of a masonry wainscot base at the south box is only a modest attempt to distinguish the different uses and is not adequate. The south smaller box, as originally proposed, is a more appropriate articulation of that space and function, but fails to address the important pedestrian and vehicular corner (see below). The use of spandrel panels in lieu of clear glazing in some of the window frames tells us that the windows were placed there for cosmetic reasons and not functional reasons, a strategy that is seldom appropriate. The metal canopies at the entries should be enlarged and expanded to wrap around the east face of the building to address Range Line Road (again, see the JMA sketch). As it is presently detailed, the building would be better suited to a suburban office park with a band of landscaping adjacent to the building surrounded by a mass of asphalt parking, not in an urban setting as it is. When viewed in total, the building is perceived as it really is; a building that has a predetermined floor plan with one entrance adjacent to the required parking lot and added architectural elements in an attempt to appease the approving agencies. This design caters only to vehicular traffic and discounts the City's goal of creating a pedestrian friendly community. As a building viewed in its context, the building is less successful. The corner of Range Line road and 116th Street poses both challenges and opportunities for creative design. This corner offers both vehicular and pedestrian site lines and access by pedestrians. It is a major corner. However, the building turns its back to this corner by placing the service area and a mock entry toward it, insulting both vehicular and pedestrian traffic by attempting to "trick" them into seeing more than what is actually there. The service area should be pulled to the north as much as possible away from 116th street on the west wall of the building and a more prominent entry be established on the corner. The success of any building on this site must accept and embrace a major entry to the building on this corner. The need for parking adjacent to an entry is accommodated by the north `box'. These twin entries should also have doors facing east to welcome shoppers walking along the sidewalk. A simple and straightforward functional change in the floor plan could connect these two entries internally. The building is a retail building but the present massing and rhythm of windows suggest otherwise. The quantity of glass and the spacing of the windows in relation to the brick mass, especially on the first floor, is more reminiscent of a medical office building set in suburbia rather than a retail building offering pedestrian access along Range Line Road. Likewise, the use of the masonry wainscot, especially along the east facade, reinforces the building's image as being separated from the pedestrians walking by. The number of windows on the first floor should be increased and extended to the floor line to better relate to the adjacent sidewalk (see the JMA sketch). In all, the building must present a welcoming face to the north, east and south, and to a lesser degree to the west, that is an honest use of form, function, and materials. We extended the south glass-bump out to have the scale and visual importance of a major focal point. The dock wall is kept at 1 story (18' ), in order to scale down the building, and importantly, to expose the glass-bump out to traffic approaching from the west. There is a step in the building facade from the brick plane back to the glass bump-out, on both the east and the south. This provides more visual interest than simply a flush corner build-out. We added one more window bay to the west end of the south dock wall, and added an upper level window to each bay, above the masonry accent line. This gives that facade more relief and interest. Further, the glazing is intended to be translucent/frosted glazing, illuminated by the space behind. This is an enhancement over dark spandrel glazing that was suggested . earlier. The glass bump-out will contain stairs and other space for the tenant, so will exhibit some internal activity. It will have a metal canopy and an emergency exit-door, but will not serve as a building entry. For this reason, it was given a 3' masonry base as a subtle visual cue for pedestrians that it is not indeed the store entry. The revised design has improved massing, architectural detail, and illumination. We feel that this corner feature, as well as the balance of the south facade, has the level of detail and prominence required from an urban design standpoint. Thanks. Ms. Hunter will respond at a later time with further comments. Amanda Foley—Carmel Engineering -Stonnwater plans will need to be approved before Engineering will have further comments. Mr.Dobosiewicz asked if there were comments to be made to DOCS prior to the May 15 Plan Commission meeting. Ms. Foley said Engineering has delivered comments to DOCS but will still need to review and approve the stormwater plans before commenting further because so much of the project relies on the drainage plans. Ms. Foley asked Mr. Huff if there would be an amended stormwater plans submitted this week,per the Engineering department's request. Mr. Huff indicated that they have issued a master plan for stormwater for the entire Legacy project and he is aware this will need to be approved before construction. He said in regards to the primary plat being approved by the Plan Commission,he would appreciate any general technical comments that can be offered from Engineering prior to presenting to Plan Commission, since every time it is not approved would be an extra 30 days. Mr. Huff said if Engineering has sent comments to DOCS on this project,he has not seen them. Ms. Foley indicated that if the plans weren't due until May 10 then the Engineering department has not seen them. Mr. Dobosiewicz said typically when they file a primary plat prior to TAC, they will receive comments from individual TAC members so they can make the necessary changes prior to presenting to Plan Commission. Ms. Foley said Engineering will provide comments in a staff report to be issued to DOCS prior to Plan Commission meeting. Daren Mindham—DOCS-Urban Forestry -Comments have been sent. Overall, I think the proposed design is very plain.Just like we mentioned for the main grocery building—they need more details on the brick work throughout the building to break it up and make it more interesting. They did add the lighter color brick at the top edge of the building.This does help.They also added the brick detailing on the north and south elevations. I think this is going in the right direction, but should be scaled back slightly. It seems like there are a few toe many brick details in each column. Maybe do away with every other one? 2. This is a four sided building—the coping should be more detailed and carry all the way around the building.Why is the double brick soldier course not extended to the west elevation?I think this would go a long way in helping complete the 4-sided look. 3. So the entrance is at the north east corner to the building...that's a bummer. I would still like to see the entrance at the southeast edge of the building. 4. Is there not a better way to incorporate the loading/trash area into the building?Or is it silly to have that extend to the height of the rest of the building? I understand this was done to help bring it down to pedestrian scale on this side of the building. 5. I'm not in favor of the metal panels between the windows on the first and second floors.They are ok,just not my preference. 6. Is it a real second floor?Yes. 7. The masonry accent band at 10' really makes the first floor seem small/squatty. Like it messes up the proportions of the building. Do you know what I mean? I understand it is meant to make it feel more pedestrian scale. 8. Does the aluminum storefront—clear anodized finish mean clear see-thru windows?Yes it does. 9. There a canopy at the south end of the east elevation/south face of the building. Is that just a design element or does it have a function?They added the masonry veneer base at this end to reinforce that this is not an entrance. I think it helps make it look less like an entrance. 10. The wall of windows on the south elevation—will we be able to see through these?Yes. 11. Did the CVS use all fake stone and brick? It seems there is a lot of veneer proposed on this building. ??? 12. I'm really curious to see what signage they'd like to have...The possible signage locations are good.Two signs would be allowed per the Sign Ordinance. Old National Bank: 1. Overall I generally like the building design. It is different, yet similar to what they have now.Just some more complexity. 2. I like the "heaviness"/height of the coping/parapet walls. But I think they need some different elements so that they're not so similar—too much white EIFS...They added some detailing in the EIFS, I think it does help. 3. I think the biggest impact(of a change) could be on the drive through soffit. Making part of that prick or a different design/material will help it not seem so un-proportional. Right now it seems like a big heavy topper on two tiny stick supports!They made the columns wider, which does help visually from the west elevation.They 1 also increased the height of the molding/cornice line,which does help to break up the height. Could the bottom half of the canopy be a lighter color?That would help a bit more in making it look different. 4. The southeast elevation could also take advantage of different materials to break up the EIFS. It would be nice to see some detailed brick(vertical) or stonework on the archway and the side bottom 1/3 of the entrance elevations.The design changes help out a lot. It looks like it flows better now. 5. On the east elevation, I'm assuming the EIFS portion in the middle is for a sign?Would you agree? But it almost looks like it could be a garage door as well...with the windows going all the way to the floor! I wonder why that is designed like that...They added a break/design in the EIFS. This does help break it up some. It is not intended to have a sign. 6. Why is the entrance door not in the middle of the glass feature on the southeast elevation? It seems off.Also, can the windows above the door not match the rest?Why do they have to appear different?They are different because of the door below. It is ok. Outlot building: 1. I think this building design is a really good starting point.The awnings certainly break up the facade and help add a bit of character. I can see how the signs could go above the awnings and/or second story windows, so that's good.They added where the signage could go on the building.This helps. 2. One thing that might help is to add some brick detailing with different color bricks to create boxes or areas where the signs will go. Similar to Turkey Hill. It would add visual interest and give more attention to the sign. This could work on both the first and second floor—if they plan to have tenants and signs up there. Perhaps not on the second floor or in the middle, but the end units could still utilize this"frame" idea.Also use it on the north and south elevations of the end units to give more detailing on the building. 3. I think the parapets and coping should be the same for both ends of the building, as well as wrap around all four sides. The lighter brick detailing does help with distinguishing the top(cap) of the building. But I do still wish the parapet walls could be on all four sides. 4. The west elevation of the building could use some more detail if this is what people will see from where they are parking.This building is proposed to be brought up to Range Line Rd., correct?It is brought up to the street and this end will be "covered up" with the drive through. So I think it will be ok as is. 5. It would be nice to see different color brick/detailing above the windows without the metal channel lintel. Thanks for doing this. 6. The north elevation bump out—can there be some brick on this feature? It appears to be 100% EIFS. I understand there can't be brick on this feature. Thanks for adding the detailing on the EIFS. One more request though—on the east and west, can the EIFS detail be bigger to reflect the entire area of the EIFS? NEW QUESTION:Could there be lighting sconces next to the doors on the south elevation for the upper tenants? I think this would be a good addition to the building for them.
