ORDINANCE D- 2111 -12
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CERTAIN PARKING REGULATIONS TO ADDRESS NEW PARKING ISSUES
WHEREAS, pursuant to Indiana Code 9 -21, the City of Carmel, Indiana ( "City "), has adopted
certain parking regulations, the same being codified primarily in Chapter 8, Articles 4 and 5 of the Carmel
City Code; and
WHEREAS, it is in the public interest to now amend certain of these regulations to address new
City parking issues.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. The following amendments to the Carmel City Code should be and the same are hereby
adopted:
a. Chapter 8, Article 4, Section 8- 29(a)(2)(b) shall be amended to read as follows:
"(b) 2nd Avenue N.W. shall be one -way northbound from its intersection with Main Street to its intersection
with 1St Street N.W."
b. Chapter 8, Article 4, Section 8- 37(a)(2) shall be amended to read as follows:
"(2) On the south side of Main Street from a point 99 feet east of the intersection of the Monon Greenway
and Main Street to a point 147 feet east of the intersection of the Monon Greenway and Main Street."
c. Chapter 8, Article 4, Section 8- 37(a)(3) shall be amended to read as follows:
"(3) On the north side of Main Street from a point 393 feet west of the intersection of the Monon Greenway
and Main Street to a point 437 feet west of the intersection of the Monon Greenway and Main Street."
d. Chapter 8, Article 4, Section 8- 37(a)(5) shall be amended to read as follows:
"(5) On the north side of Main Street from a point 186 feet east of the intersection of Main Street and 1st
Avenue N.W. to a point 235 feet east of the intersection of Main Street and 1st Avenue N.W."

e. Chapter 8, Article 4, Section 8- 37(a)(6) shall be amended to read as follows:
"(6) On the south side of 1st Street N.W. from a point 118 feet east of the intersection of 1st Street N.W. and
2nd Avenue N.W. to a point 130 feet east of the intersection of 1st Street N.W. and 2nd Avenue N.W."
f. Chapter 8, Article 4, Section 8- 37(a)(4) shall be amended to read as follows:
"(4) The first two motor vehicle parking spaces on the north side of Main Street west of its intersection with
the Monon Greenway."
Chapter 8, Article 4, Section 8 -37(a) shall be amended to include new subsections (7) and
(8), which shall read as follows:
g.
"(7) The first three parking spaces on the south side of 1st Street N.W. east of its intersection with 2nd
Avenue N.W., from the hours of 6:00 a.m. to 6:00 p.m., Monday through Friday only.
(8) Reserved."
h. Chapter 8, Article 5, Section 8- 47(a)(38)(e) shall be amended to read as follows:
"(e) Reserved."
i. Chapter 8, Article 5, Section 8 -47(a) shall be amended to include new subsections 48
through 52, which shall read as follows:
"(48) On the south side of Main Street from a point 343 feet east of the intersection of the Monon Greenway
and Main Street to a point 368 feet east of the intersection of the Monon Greenway and Main Street.
(49) On the west side of 3rd Avenue S.W. between City Center Drive and a point 391 feet south of the
intersection of City Center Drive and 3rd Avenue S.W.
(50) On the west side of 3rd Avenue S.W. between American Way North and a point 51 feet north of the
intersection of American Way North and 3rd Avenue S.W.
(51) On the south side of City Center Drive from a point 868 feet east of the intersection of 3rd Avenue S.W.
and City Center Drive to a point 890 feet east of said intersection."
(52) In the off - street parking spaces on the un -named loop road between the Palladium and the Tarkington
and Studio Theaters and accessible from 3rd Avenue S.W., from midnight to 6:00 a.m. on each Friday
and Saturday from April 15 to October 15, inclusive, of each year only."

Chapter 8, Article 5, Section 8- 48(a), first sentence only, shall be amended to read as
follows:
"(a) Three -hour parking zones between the hours of 6:00 a.m. and 5:00 p.m., Monday through Saturday
only, are established in the following parking lots:"
k. Chapter 8, Article 5, Section 8- 48(a), shall be amended to include new subsections 7
through 12, which shall read as follows:
"(7) The parking lot located behind the buildings on the south side of Main Street between 1St Avenue S.W.
and Rangeline Road, which lot is generally north of the east -west alley located approximately halfway
between 1st Street S.W. and Main Street west of Rangeline Road, and bordered on the west by the
property with the address of 25 West Main Street, the same being primarily located on Tax Parcels 16-
09-25-16-02- 022.000 and 16- 09- 25- 16 -02- 023.000.

All parking spaces located on the first level underground (that level immediately below the level of the
surrounding streets) of the underground parking structure within the development known as Sophia
Square; said development being generally bounded by 2nd Avenue N.W., 1St Street N.W., 1St Avenue
N.W. and Main Street.
The parking lot located behind the buildings with the addresses of 215 West Main Street and 115 West
Main Street, which lot is generally west of 1St Avenue S.W., north of 1St Street S.W., and bounded on the
west side by Tax Parcels 16- 09- 25- 16 -01- 011.000 and 16- 09- 25- 16 -01- 012.000.
(10) All parking spaces not otherwise contractually addressed by the City located within the underground
parking structure within the development known as the Indiana Design Center, said development being
generally bounded to the north by Robert Indiana Avenue, to the west by 1st Avenue S.W., to the east
by Rangeline Road, and to the south by the surface parking lots of the Indiana Design Center.
(11) The parking lot generally bounded on the north by the first east -west alley north of Main Street between
1st Avenue N.W. and Rangeline Road, on the east by the building with the address of 38 West Main
Street, on the south by Main Street, and on the west by 1st Avenue N.W., the same being primarily
located on Tax Parcel 16- 09- 25- 12 -02- 026.000.
(12) The parking lot that consists of the topmost level of the parking garage generally bounded on the north
by City Center Drive, on the south by Tax Parcel 16- 09- 36- 00 -00- 005.117, on the east by Veterans
Way, and on the west by the Monon Greenway, the same being primarily located on Tax Parcel 16 -09-
36-00-00- 005.217."

m. Chapter 8, Article 5, Section 8- 48(a)(4), (5) and (6) shall be amended to read as follows:
"(4) The parking lot located behind the Lion's Club building located at 141 East Main Street, the same being
generally east of 1st Avenue S.E., south of East Main Street, west of Bryn Mawr Lane, and north of 2nd
Avenue S.E. However, parking may be further restricted in this lot during certain Lion's Club meetings
and events, at which times the public parking signs located in the lot shall be masked in a manner
approved by the Carmel Police Department for the duration of the meeting or event only.
To the extent the same is not otherwise contractually addressed by the City, the parking lot located
behind the Old Town Shops, the same being generally north of 1st Street N.E., west of 1st Avenue S.E.,
south of the east -west alley which is located approximately halfway between Main Street and 1st Street
S.E., and east of the north -south alley which is located approximately halfway between 1st Street S.E.
and Rangeline Road, the same being primarily located on Tax Parcels 16- 10- 30- 03 -01- 008.000 and 16-
10-30-03-01- 007.000 and directly east of the properties with the addresses of 31 and 41 South
Rangeline Road, respectively.
(6) The parking lot located on the west side of Rangeline Road and generally bounded on the south by the
building located at 240 South Rangeline Road, on the east by Rangeline Road, on the west by the
property with the address of 231 1st Avenue S.W., and on the north by the building located at 200 South
Range Line Road."

follows:

r. Chapter 8, Article 5, Section 8 -48(i) shall be amended to add new subsections 9 and 10,
which shall read as follows:

"(1) On the west side of 3rd Avenue S.W. from a point 391 feet south of the intersection of City Center Drive
and 3rd Avenue S.W. to a point 572 feet south of said intersection."
u. Chapter 8, Article 5, Section 8 -52 shall be added to the Carmel City Code and shall read as
follows:
"§ 8 -52. Four Hour Parking Near Palladium.
No person shall park a vehicle for over four continuous hours at the following locations:
a. On the east side of 3rd Avenue, S.W., starting at the south side of the Tarkington Theater just
north of the entrance to public parking Garage 2 north to the south side of the entrance to the
Palladium loading dock, such parking to be in properly marked general parking spaces on the
curbed portions of said street segment only.
b. Reserved."
Section 3. The Street Department is directed to promptly install appropriate signage consistent
with this Ordinance.
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance.
However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or
liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance.
Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under
such repealed or amended ordinance as if this Ordinance had not been adopted.
Section 6. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
