Dear Mr. Hoyes,
We have received your comments, dated August 10, 2004, concerning the St. Vincent
Medical Office Building, filed as "Meq.ical Office Building - Carmel, India~a",
addressed as 1 0801 Michigan Road (approximate), and assigned docket number
04070033 DP/ADLS by the Carmel Department of Community Services.
This letter specifically addresses comment number 4: "The HCSO has noticed a couple
of instances in the U.S. 421 Phase I construction area, of site drainage that was to
connect into the INDOT storm sewers, where the inverts did not maich. In these cases,
we now have storm water lift stations to drain these sites, which is NOT acceptable with
this office. The HCSO will require letters from the U.S. 421 Phase 2 design engineer,
INDOT head office, and INDOT Project Manager fro the Crawfordsville Office, that
these elevations will match and the sites (this site and Weston Pointe) will drain by
gravity. These letters must be received by this office before this office will give an
approval for this site. Also, please submit the most recent INDOT plans for this area,
with inverts shown." All other comments were addressed in a letter from Ms. Mary
Salada of Bingham McHale dated October 14, 2004.
The proposed plans have been reviewed against the most recent set of INDOT
Construction Documents and the following conclusion can be drawn.
· The inverts for the proposed site development are compatible with the invert
elevations planned for the INDOT Added Travel Lanes, Phase 2 work. For your
information, that project is being developed as Des. No. 9015600. A copy of the
INDOT plans is being included as an attachment to this letter. Please understand that
those plans were prepared in metric units. All values contained in this letter will be
listed in English units first, with the metric equivalent immediately following in
parentheses.
o Note that the datum used for the site development plans varies slightly
from that used for the INDOT project. A site survey was completed on

~July 15,2004.' The'difference between the published elevation (NGS data
sheet; web site: www.ngs.noaa.gov) and the INDOT survey i,s 0.57 feet
(0.174 m), the INDOT elevation being higher. Additionally, this survey
occurred after the existing 24" dia. cross pipe was jetted. This activity I
removed approximately 0.13 feet (0.04 m) of sediment.
o The invert elevation at the outlet end of Str. 655 is 896.91 feet (273.378
m). Applying the adjustment factor for the survey variance (0.57 feet)
yields 897.48 feet (273.55 m).
o The invert elevation ofINDOT Str. No. 231 is 895.63 feet (272.989 m).
o Based on this information, the stonn water should enter the INDOT stonn
sewer system via gravity flow.
o In the temporary condition, the existing 24" dia. cross pipe has an invert
elevation of approximately 897.612 feet (273.7 m). This value was
interpreted from the INDOT cross sections. lfthe adjustment for jetting is
applied,. a value of 897.48 feet (273.55 'm)is obtained. Gravity flow'
should be maintained during the temporary condition as well.

We have received your comments, dated August 10, 2004, concerning the St. Vincent
Medical Office Building, filed as "Medical Office Building - Carmel, Indiana", .
addressed as 10801 Michigan Road (approximate), and assigned docket number
04070033 DPIADLS by the Carmel Department of Community Services.
This letter specifically addresses comment number 5: "While this office understands the
proposed drainage is temporary, this office would like to see in the construction plans"
where the water flows west of us. 421. Ilnprovements may need to be made to the west
side of US. 421, to ensure unobstructed water flow and that ponding does not occur Olr r
that crop dalnage is not caused." In her response dated October 14, 2004, Ms. Mary
Salada afBingham McHale notes, "Regarding drainage to the west of us. 421, 11le have
received verbal support fro 11'1 the owner of the property to the west, an([ are 1vorking to
obtain written approval to drain onto that property. Once this written approval is
obtained, we will Jorward a copy to your office.
The written approval has indeed been secured. A copy of that letter is attached. We qope

This tetter is to acknowledge our discussions related to a terTlporary drain~ge
agreement for your site on Michigan Road. We agree to allow storm water overf'pw
to drain onto our property on a temporary basis.
I understand that t~ere is an existing 2411 diameter storm water pipe un<ier
Michigan'Road which currently aHows storm water to pass under the highway. TMis
structure is located at approximately Sta. 12+271, about 410 feet south of our
northern property line. Your plan utilizes that same drainage path, by conveying the
overflow from your Pond #1 to this cross structure. The pipe from the pond is to be a
15" diameter pipe. It is assumed that no ponding will occur on our site. In addition,
Bremner & Wiley will be responsible for any and all associated costs necessary to
maintain our site in its current condition.
Once the Indiana Department of Transportation (INDOT.s) Added Travel
Lanes project is completed. your overflow structure will feed directly into the state7s
storm sewer system. This water will be carried to the north and the pipe under U~S.
421 will be removed. After the completion of the INDOT project, there will be 'no
transfer of storm water across the highway within the frontage of our property.
Please note that this agreement will remain in place while the property exilts
in its current state. Should we have occasion to further development plans on this
parcel, this agreement will need to be revisited.

for the above~mentiQned project, After reviewing the plans the Highway Department has the
following comments:
1.. A Private Road Approach permit will be required for the constnJction of the entrance
connection to Weston Pointe. Please contact Mr. Robb Chadwell. Highway Department
Permit 'nspector, for the necessary forms and informatico.. The permit must bB obtained
prior to accessing the street in Weston Pointe.
2. The right of way width and instrument number fer the Weston polnte P1iat must be tndicated I'
on the site plan. The Instrument numbers for the right of w~y must be ~hoVin.

4. Is there an easement on the Marsh site. whtch allows for the entranc~ to the medical office
site to connect to? If so, please include the necessary instrum~nt numbers. The instrument
number!; for the easement must ba shown.
5. Even though the entrance from Weston Polnte to the parking '~t for the office s:jte is shown in
an ingress/egres$ easement. the road must be built to minimum County standards for local
streets. This would include roll curb, SSD under the curb and 2-128'anes at a minimum. The
pavement section for the road must be a minimum 9" stone base. 3" HAC binder and 111' HAC
surface. The lanes of the frontage road must be 2-12' lanes. with curb SSD..
6. Pfease be aware that further comments may be necessary at a tater time.

We have received your written comments, dated August 2, 2004, concerning the i
St.Vincent Medical Office Building, filed as "Medical Office Building - Cannel, ), I
Indiana", addressed as 10801 Michigan Road (approximate), and assigned docket numb en
04070033 DP/ADLS by the Carmel Department of Community Services. We attende~ a I
Technical Advisory Committee meeting in Cannel on August 18, and have completed' an
initial hearing before the Cannel/Clay Plan Commission on September 21. We are now
prepared to address each of the comments of your August 2 letter.
1. We~;understand that a Private Road Approach pennit will be required for
construction of the entrance connection to Weston Pointe. We are pursuing this
pennit accordingly.
2. We understand that the right-of-way width and instrument number for the Weston.
Pointe plat must be indicated on the site plan. This plat has recently been !
recorded, as Instrument Number 200400067374. :
3. Regarding the suggestion to relocated the proposed connection to the Marsh to' the
east, we are working with our traffic engineer (Edwards and Kelcey) to further
study this issue. Edwards and Kelcey is engaged in discussions with INDOT
regarding this issue, as well. The latest plans propose to move this connection :80 I
feet further east.
4. Instrument numbers 9609611518 and 9609622088 provide for the ingress/egress
to and from the Marsh site. !
5. The frontage roadway will be built to minimum County standards.

for the'above-mentioned project. After reviewing the plans the Highway Department has the !
following comments: !
1. A Private Road Approach permit will be required for the construction of the entrance
connection to Weston Pointe. Please contact Mr. Robb Chadwell, Highway Department
Permit .Ihspector, for the necessary forms and information. .
2. The right of way width and instrument number for the Weston Pointe Plat must be indicatE1d
on the site plan. !
3. The Highway Department suggests that the connection to the Marsh site be relocated to Uhe
east to avoid traffic conflict on 421. If cars are waiting to exit the Marsh site and block the I:..
entrance to the medical office site, cars could potentially back up onto 421 . ,
4. Is there an easement on the Marsh site, which allows for the entrance to the medical office
site to connect to? If so, please include the necessary instrument numbers. i
5. Even though the entrance from Weston Pointe to the parking lot for the office site is show~ in
an ingress/egress easement, the road must be built to minimum County standards for locc3'l
streets, This would include roll curb, SSD under the curb and 2-12' lanes at a minimum, T~e
pavement section for the road must be a minimum 9" stone base, 3" HAC binder and 1" HfC
surface. !

address issues raised by your staff comment I Department Report dated August 3, 2004,
and comments raised by Jon Dobosiewicz at the August 18 Technical Advisory
Committee meeting:
A point by point response to your and Jon's comments are noted herein as
follows. We provide this anticipating your support at our upcoming September 21 st Plan
Commission hearing:
1. Regarding the official list of adjacent properties from the Hamilton County
Auditor, a copy of this list was included with both the DP/ADLS and Variance
applications, filed on July 23, 2004. Should you or your office not find a copy of
this official list with the application materials, please let me know, as I will
forward another to your attention immediately.
2. Regarding the docket number, we have placed this number on the site plan and
cover sheet, as requested,
3. Regarding the buffer yard setback along the east property line, the amended plans
now provide for the full 25-foot required buffer yard, as requested and required by
the ordinance. Thus, we will officially withdraw our initially filed variance
request for a 15- foot buffer yard here.

are proposing to amend the plans in accordance with all, or nearly so, of your and Jon's comments. For e~ample,

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Office
on July 26, 2004 for this project and have the following comments:
1. This project falls within the jurisdiction of Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Area.,
3. The proposed project has a small portion in the Crooked Creek Regulated Drain :.
Watershed and a small part in the Park Northwestern Regulated Drain Watershed.
4. The HCSQ has noticed a couple of instances in the U.S. 421 Phase 1 construction
area, of site drainage that was to connect into the INDOT storm sewers, where the
inverts did not match, In these cases, we now have storm water lift stations to drain
these sites~ which is NOT acceptable with this office. The HCSO will require letters
from the U.S. 421 Phase 2 design engineer, INDOT head office, and INDOT Project
Manager for the Crawfordsville Office, that these elevations will match and the sites
(this site and Weston POinte) will drain by gravity. These letters must be received
by this office before this office will give an approval for this site. Also, please
submit the most recent INDOT plans for this area, with inverts shown.
5. While this office understands the proposed drainage is temporary, this office would
like to see in the construction plans, where the water flows west of U.S. 421 ~
Improvements may need to be made to the west side of U.S. 421~ to ensure
unobstruoted water flow and that ponding does not occur or that crop damage is not
caused.

location, the real estate is immediately north of the existing Marsh supermarket facility at 10679 !
Michigan Road.
We are filing for Development Plan approval and Architectural, Design, Lighting, and'Sigflage
approval, and development standard variances, with the Carmel/Clay Department of Community I
Services. You will be informed of future T AC meetings, as they are scheduled. !
