The applicant seeks the following development standards variance approvals:
Docket No. 12100022 V Ch.25.07.05-Menu board size (36.67 sq.ft. proposed, 16 sq.ft. allowed)
The site is located at 2350 E. 116`h St. and is zoned B-8/Business. It is not located within any overlay zones.

Analysis:

_ --= allowable size of menu boards for drive thru
restaurants.The new proposed size is 30 square feet.The update should pass on Tuesday, November 20th at the Plan
Commission meeting. The Petitioner needed their approval sooner, and was still going to be slightly over the new
allowance,thus asking for this variance. The Department is supportive of this variance request.
Findings of Fact: Menu board size
1. The approval of this variance will not be injurious to the public health,safety,morals,and general welfare
of the community because:the proposed menu board would be next to the building and would not block any
views or create a distraction.
2. The use and value of the.area adjacent to the property includedin the variances will not be affected in a
substantially adverse manner because: the proposed menu board,by being installed next to the building and
being installed with a brick base will help the sign to blend in with the building, the site, and the surrounding area.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property.because: If the menu board were 16 square feet,it would not have enough
space to effectively display the menu at a readable size.
Recommendation: The Dept. of Community Services.recommends.positive consideration of Docket.No. 12100022 V.
