1. There is no balance on the front elevation. Utilize either the arch or ga~Sign for both elements.

are preferred.

frame sign area lie LJS sign for balance.
11. I would like to discuss some options on the LJS sign that may allow it to be larger than proposed (no
variance required). The proportions look better in the Frankfort elevation and I this we may be able to be there
without a variance.
Overall this is a good start. However the final rendering presented to the commission should have the same level
of effort in preparation of the exhibit as the Frankfort plan.

Dear Mr. Oyster:
The City has received your drawings dated February 11,2005 based upon the City review of December 13,
2004.
The conlIDents from the City review have been satisfactorily addressed with the following exceptions:

16. Comment on previous revie\v: "Please add a note the pavement, walk and curb in the right of way
shall be sa\v cut to a clean edge at limit of removal and indicate on the drawings. W alkmay be
renloved to the nearest joint. Thank you for adding the notes. Please add similar sa\v cut note to
keynote 3 (remove to nearest curb joint)." Repeat previous comment: Please add similar saw cut
note to keynote 3 (remove to nearest curb joint).
Based on additional 'revie\v, the City provides additional comments:
1. Please indicate removal of mainline pavement as necessary to place depressed curb and new
aprons. The Department \vould expect that some portion of mainline pavement would need to be
removed to facilitate the \vork. Please indicate removal limits with a keynote 33 reference and a
note for replacement in accordance with City standard street cut patch detail.
2. Sheet C2.0 ~ The "PROP. R/W" label is in a location at the east edge of the south entrance. This
label obscures the fact that the concrete apron is to extend to the proposed right-of-way line.
Please place the "PROP. R/W" label else\vhere.
3. Sheet C2.0, Keynote 5 - Please specify #53 stone instead of "crushed aggregate or gravel."
4. Please provide the City standard detail for the 6" wide P.C.C.curb within the right-of-way. A
copy of this City standard is enclosed for your use. This curb differs from the on-site curb and
will need to be delineated.
5. Thank you for providing the Department standard detail.for the valley gutter as requested.
Because of long-term problems experienced \vith installation in accordance with this detail, the
'Department is in the process of revising the detail. In the cross-section of the valley gutter, please
indicate four epoxy-coated #5 steel reinforcing bars. The bars should be placed at a depth of three
inches_ fron1 the botton1 of the valley gutter section. The distance from'the edge of the valley
gutter to the first bar on each side should be three inches and the remaining two bars should be
placed at three spaces of six inches each.
6. Please remove Sheet L1.0 - Landscape Pla~1 and Sheet L1.1 - Landscape Details from the set of
plans subnlitted for approval. Approval of the Landscape Plan does not come. from the
Department of Engineering.
7. Please address the drainage revie\v conlll1ents on the attached "Revie\vChecklist". There are three
itenls that need to be addressed and should be Hunor revisions to the plans.

City revie\v of September 21, 2004.
The comments from the City revie\v have been satisfactorily addressed \vith the follo\ving exceptions:

14. Comment on previous revie\v: "Please add a right of way pavement section for asphalt pavement
in the right of\vay." Please sho\v either a full concrete apron to proposed right of\vay line, or
sho\v as right of way asphalt section, up to the right of way line with a different hatching. Detail
1, Sheet C2.1, please indicate course thicknesses. The right of way pavement section needs to be a
separate detail and needs to be 1.5 inche,s H.M.A. # 11 surface on 2 inches H.M.A. # 9 binder on 3
inches H.M.A. # 5D base on 7 inches # 53 stone on 4 inches # 2 stone.

the delivery trucks anticipated to serve this site.

to Site Details." Tha-nk you for adding the depressed curb. Please revise Detail 4, Sheet C2.1 per
the attached detail. -
19. Utility Plan-Sheet C4.0
. Why is the drain outlet in back being abandoned? Have you done an analysis of the ability of the
existing 36" pipe to r~ceive all \vater from the site? The proposed drainage outlet is not as we
have discussed previously. The City's comment that detention would not be required \vas based
on the drainage system more or less functioning as it does today (utilizing Rangeline Road and the
outlet to the east). Detention \vill need to be provided so that the drainage to Rangeline Road does
not exceed the peak flo\v rate to Rangeline in the existing condition unless you can demonstrate
that the Rangeline Road drainage system can adequately receive the entire site's runoff. The City
does not have drainage calculations for the sizing of the pipes in Rangeline Road.
If you agree \vith our comments, please make the revisions and submit all copies necessary for
approval and we will approve the dra\vings. All bonqs and performance guarantees (if required) must
be posted prior to Engineering Department approval. Also, Board of Public Works and Safety

Proposed Kentucky Fried Chicken & Long John Silver's (#04080042 DP Amentd/ADLS)

Dear Ms. Conn:
As you are aware, Kentucky Fried Chicken and Long John Silver's Restaurant are proposing
to demolish the existing Kentucky Fried Chicken located at 1331 Rangeline Road. The
existing building will be replaced with a single building that consists of both Kentucky Fried
Chicken and Long John Silver's Restaurant. The new restaurant boasts sixty seats and is
designed to complement the surrounding architecture.
The proposed site consists of thirty-five (35) parking spaces and a twelve (12) car drive thru
stack, both of which exceed the City's standards. A drive thru bypass lane is also provided.
The proposed site will utilize two access drives, one ingress/egress drive and one egress
only drive. The proposed building and parking lot are 6.5' east of the 45' right-of-way line,
and are encroaching into the building and parking setbacks. However, the city requested
that the building and parking lot encroach into the setbacks because of the future zoning
requirements of the area.
On behalf of Kentucky Fried Chicken and Long John Silver's Restaurant we are re-
submitting the following documents per direction from Ms. Conn:
1. An-updated application for Board of Zoning Appeals Action
2. An updated "Findings of Fact"
3. Revised Development Plans (per comments received August 30th 2004 from
Angie Conn)
4. Revision of Development Plans Response Letter
Two distinctly different restaurants within one building is gaining popularity with today's
consumer, since the consumer is demanding more choices. In order to adequately convey
the two brands to the community, and to sustain the architectural integrity of the building
and site, we are requesting that the City of Carmel grant the following sign age variances and
:)etback variances:
1. To allow 2 blade signs to be installed on the face of the building. Section
25.07.05-09.

2. To increased the size and height of menu boards. One menu board @ 47.3
square feet, 8'-4" feet high, and one preview board @ 19.57 square feet, 7' feet
high in lieu of one (1) menu board @ 16 square feet and 6 feet high.
3. To allow the parking to encroach into the front and rear buffer yard setbacks.
The city has requested that the building be moved as close to the right-of-way as
possible. In doing so, the parking needs to be shifted towards the right-of-way
line as well, thus creating a need for a variance. The rear parking is currently
setback 0' from the property line. The proposed site plan creates a 10' buffer;
however, a 20' rear buffer is required. Section 26.04.05.
4. To allow the rear parking to encroach into the required 30' greenbelt. Currently
there is not a greenbelt at the rear of the property. The proposed site has a 10'
greenbelt. Therefore we are requesting a variance for the greenbelt
encroachment. Section 19.06
5. To allow the building to encroach into the front setback. The required front
setback is 25'; however, the city has requested that the building be moved as

I have attached some information on Callery Pears and our approved street tree list, and
my comments are as follows:
1. Along Rangeline Road, please do not use crabapple (Malus) species or small growing
ornamentals. And please do not use Maple (Acer) species. Our street tree population is
over 60% maples now. Please substitute large maturing shade trees, something like ginko,
Bloodgood london plane tree, tulip tree, or sugarberry. Three trees between the drives
and one south of the south drive is sufficient.
2. Please check with Carmel's Engineering Department as to the alignment of the sidewalk.
It does not line up with sections of sidewalk to north and south of the property.
3. Please do not use callery pears on this site. We do not consider them desirable
trees. You may use species from the Carmel Street Tree list for small or medium maturing
ornamental trees.
4. Please do not use Tilia cordota species due to Japanese problems.
(Silver Linden) or another substitution from the street tree list.

HOUSING - The aluminum housing is available in two sizes for Greenbriar Flat
Lens Reduced Envelope 1000 Watt lamp and Greenbriar Flat Lens Reduced
Envelope 400 Watt lamp. Both housings are the same dimensions square,
however, the GFR is deeper. Both are finished to produce a clean, sharp
appearance, and designed to ensure weather-tight construction. Top-access
covers provide ease of installation and servicing.
LENS/GASKET - Ttle flat clear tempered glass lens is sealed to the housing
with an EPOM gasket, preventing entry of moisture, dust and insects.
TOP COVER FASTENERS - The four captive stainless steel fasteners secure the
top-access cover to the housing.
SOCKETS - Porcelain tllogul-base sockets. All sockets are pulse-rated.
LIGHT SOURCES - Pulse-Start Metal Halide, Super Metal Halide Reduced
Envelope, Metal Halide, Metal Halide Reduced Envelope, or High Pressure
Sodium. Clear lamp is supplied as standard.
BALLASTS - Pulse-Start Metal Halide fixtures feature a Super CWA type ballast.
Super Metal Halide, Metal Halide, and High Pressure Sodium fixtures feature a
high-power factor type CWA ballast. All ballast types are designed for -200 F
operation.
REFLECTORS/DISTRIBUTION PATTERNS - The series is available in a variety
of reflector systems and distribution patterns, all with vertical oriented lamps:
GFR: Type II (2), ~ype III (3), Perimeter Forward Throw (FP), Type V (5) and
Automotive Forward Throw (FA).
GFM: Type II (2), Type III (3), Perimeter Forward Throw (FP), and Type V (5) .
Field-rotatable reflectors provide flexibility in distribution patterns without
rlloving the fixture. Photometric data is tested in accordance with I ESNA
guidelines.
BRACKETS - Arm Mount: 2-1/2" x 5-3/8/1 x 12" extruded aluminum bracket
is shipped standard. An 8" bracket is available for single or 01800
configurations, but rnust be ordered from the Options column of the ordering
chart. A Round Pole Plate (RPP2) is required for mounting to 3"-5" round
poles. (See Accessories chart.)
Pole Top: The cast aluminunl mounting hub conceals the wiring
compartment and mounts directly to LSl's unique "pole-top mounting plate",
via a high-strength grade five steel bolt with nylon insert and split lock
washer for double locking. Support arms consist of four 11/16" 0.0.
aluminum rods and are pre-wired for ease of installation.
FINISHES - Each fixture is finished with LSl's OuraGrip@ polyester powder coat
finishing process. The DuraGrip finish withstands extreme weather changes
without cracking or peeling, and is guaranteed for five full years. Standard
colors include bronze, black, platinum plus, buff, white, green, and graphite.
DECAL STRIPING - LSI offers optional color-coordinated decals in 9 standard
colors to accent the fixture. Decal is guaranteed for five years against peeling,
cracking, or fading.

We have reviewed your submission for the September 22 Technical Advisory Committee meeting. We
offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Street and Right of Way - City of Carmel (Range line Road).
. Water - City of Carmel
. Sanitary Sewer - City of Carmel
. Storm Sewer - City of Carmel
3. Board of Public Works and Safety Approval Requirements:
. Water and Sanitary Sewer Availability.
. Commercial Curb Cut. The request for Board approval should include 8 ~" x 11" exhibits that
will indicate the existing and proposed curb cuts and all appropriate data and dimensions including
width, radii, etc. Please indicate all existing and opposing driveways and their relationship to the
proposed curb cuts for this development.
. Temporary Construction Entrance. Separate BPWS approval \vill be required if this entrance is to
be located anywhere other the site of the permanent curb cuts.
. Consent to Encroach approvals for any permanent improvement to be installed within dedicated
easements and/or dedicated right of way. If an irrigation system is planned for this project,
additionalW ater Availability approval will be required from the Board and additional Water
Connection Fees will be due.
. Dedication of Right of Way (if applicable). Preferred dedication forms are available electronically
from this office.
I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior final approval by the Carmel Clay Plan Commission
and/or the Board of Zoning Appeals and con'pletion of review by the Technical Advisory
Conlmittee. All written requests to be place on the Board's agenda must include the appropriate
Docket Numbers and the date (or dates) of approval by the Plan Comnlission and/or BZA.
4. Water and Sanitary Sewer Availability and Connection Fees:
Water and Sanitary Se,ver Availability (acreage) Fees - This site and previous development was
served by and connected to Carmel Utilities. That being the case, Availability or Acreage Fees.would
not be applicable for this development.
"Vater and Sanitary Se,ver Connection Fees - In order to calculate Connection Fees for this
development, additional information is required. You have indicated a total of 60-seats are planned for
this facility. Please provide us with the total number of seats in the current facility. Restaurants are
calculated at 0.10EDUs per seat. Current Connection Fees are $1,310.00 per EDU for water and
$795.00 per EDU for sanitary sewer. I am enclosing Average User Factor Sheets for water and for
sanitary sewers.

5.T AC Review/Drawings submitted for approval:
\Ve request that all comments and comment letters generated by this office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Carmel Utility issues must also re resolved. The
design engineer must certify all drawings submitted for final approval. This office will require a
minimum of five-sets (maximum of seven-sets) of approved drawings after all issues have been
resolved. The drawings will be stamped approved and signed by both the City Engineer and Director
, Carmel Utilities. The Developer/Owner will receive one-set which is to be maintained on the
construction site at all times. Carmel Utilities will receive two-sets. Our Construction Manager will
receive one-set and one-set will be maintained in the Department of Engineering. If more than the
minimum of five-sets are requested to be approved, the additional sets (maximum total of two
additional) must be submitted with the five required sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
easements and/or right of way will require Consent to Encroach approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
and sanitary sewer main locations.
8. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues.

BONDING REQUIREMENTS
1 O. Upon initial review, it appears the following bonding requirements may apply to this project: .
Performance GuaranteeslEngineer's Estimates
Due to the extensive construction and improvements planned in the right of way, we request a
Performance Guarantee be posted for this work. This would include right of way demolition, right of
way pavement, curbs, sidewalks and ramps and storm sewer connection. Please provide a Certified
Engineer's Estimate for 100% of the cost of labor and materials for these improvements. Please post a
Performance Guarantee, in the amount of the Engineer's Estimate, for the Right of Way
Improvements. Upon completion of right of way improvements and release of the Performance
Guarantee by our Board of Public Works and Safety, a 3-year Maintenance Guarantee, in the amount
of 15% of the Performance amount, will be required.
Street Cut/Right of \Vay Permit and Bonding Requirements _
Any work in the dedicated right of way of Range line Road, not included or covered by a Performance
Guarantee, will require a Right of Way Permit and a License and Permit Bond. The bond amount will
be determined by the number of instances of work in the right of way @ $2,000.00 per instance. Open
pavement cuts in dedicated streets require approval by our Board of Public Works and Safety. This
would include open pavement cuts for storm and utility connections. Please contact our Right of Way
Manager, Fred Glaser, to arrange permitting and bonding.
. 11. We have engaged Crossroad Engineers to review drainage plans and drainage calculations for all
projects submitted to this office for review. Please provide drainage calculations for this project so
that we may submit the plans and calculations to Crossroad for review. We will share Crossroad's
comments as they are received. .
PROJECT COMMENTS-CONSTRUCTION PLANS
12. Please provide a Title Sheet for the plans. Typically, the Title Sheet will contain the project name and
address, Site Plan, Vicinity Map, Sheet Index, etc.

13. Please label existing and proposed right of way. Proposed right of way shall be 45-foot half right of
way. Any additional right of way will require formal dedication and acceptance by our Board of
Public Works and Safety.
14. Please add a right of way pavement section for asphalt pavement in the right of way.
15. Have you checked with the County regarding restricted discharge based upon the site being in the
Hawkins Drain Watershed?
16. Please add a note the pavement, walk and curb in the right of way shall be saw cut to a clean edge at
limit of removal and indicate on the drawings. Walk may be removed to the nearest joint.
17. Demolition Plan-Sheet C1.0
. Please advise the Owners and Contractors involved in this project that the City of Carmel has a
strict ordinance regarding mud and other substances or debris deposited on City streets by vehicles
and equipment used in excavation, construction, demolition or otherwise within the City Limits.
Be prepared to clean Rangeline Road as required for the duration of this project.
. Please indicate the width of each of the five lanes shown on Rangeline Road. Are these existing
or proposed?
. Please show the curb on the west side of Rangeline Road.
. As a courtesy, we would suggest that the adjacent property owners be advised of the planned
offsite removal of rip rap at the southeast comer of the ,site. If this area is an easement, it needs to
be identified on the plans. Please see comments regarding drainage.
18. Site Plan-Sheet C2.0
. The curb return and radii for the entrances need to be a minimum of 40' instead of 15' .
. There are two signs indicated in the right of way. If these are to remain in the right of way, a
Consent to Encroach Agreement between the Owner/Developer and the City of Carmel will be
required.
. There does not appear to be a pedestrian access from the public sidewalk in the right of way of
Rangeline Road to the building. Please provide pedestrian access.
. Provide sidewalk handicap ramps on either side of both curb cuts or does the walk come flush
with the drive?
· The existing curb gutter flow line on Rangeline. Road needs to be maintained through all new
construction.
· Are there existing easements on the site? If so, they need to be identified.
· Does the proposed entrance and exit scheme match the existing configuration?
· Please ensure that proposed driveways match other drives in the area in terms of extent of concrete
apron in relation to right of way line.
· Please confirm with our Department of Community Services regarding any requirements for right
of way improvements (walks, multi-use paths, etc.).
· City standards for curb sidewalk in the right of way must be delineated on the Site Plan and details
included on Site Details.
· Please indicate a depressed gutter across entrances and add detail to Site Details.
19. Utility Plan-Sheet C4.0
· We do not allow HDPE in our right of way. Please replace the 62' of 12" HDPE in the southwest
comer with reinforced concrete pipe.
· Any open cuts in the pavement of Rangeline Road will require Board of Public Works and Safety
approval. It appears that the cOlll1ection to the existing storm structure in Rangeline will require
an open cut.
· Does the site today drain to the west or to the east?
· Why is the drain outlet in back being abandoned? Have you done an analysis of the ability of the
existing 36" pipeto receive all water from the site? The Department is still reviewing the
proposed outfall.

This letter is in response to your Development Plan Amendment/ ADLS Application for Kentucky Fried
Chicken/Long John Silver's. Members at the TAC Meeting will make additional comments on September 22.
Please complete the following items after you have received additional comments at the T AC Meeting.
1. Please provide copies of your letters of transmittal to T AC members.
2. Show/label easements on the landscape plan and site plan.
3. Note the buffer yard setback requirements: 20-ft rear, 15-ft front, and 5-ft side (Section 26.04.05).
(Variance will be needed if these cannot be met.)
4. A 30-ft greenbelt is required adjacent to a residential use. (Variance will be needed per Sec. 19.06).
5. The number ofplantings is insufficient. Please work with the Urban Forester.
6. Please provide a copy of the landscape plan approvalletter/e-mail from the Urban Forester.
7. Please provide light pole details/photo and building light fixture details. Also, show light fixtures
with flat lens and 900 cutoff.
8. Please correct the north arrow direction on El.0 - site photometric.
9. Show property lines of site on photometric. It is suggested that foot-candles are less than .1 when
adjacent to residential and less than .3 when adjacent to business uses.
10. Please remove the word "Yum" from the clock.
11. Signs facing a road frontage: Only one wall sign per business (2 total) OR 1 ground sign with both
businesses (1 total) my be utilized per 25.07.02-09. Two variances will be needed for 2 signs facing
south and for 2 signs facing north (not facing a frontage).
12. Please make directional signs less than or equal to 3 sq. ft. in area. Please limit text on these signs
to read Enter and Exit only, with no additional restaurant logos/language.

Dear Mr. Dobosiewicz,
Kentucky Fried Chicken and Long John Silver's Restaurant are proposing to demolish the
existing Kentucky Fried Chicken located at 1331 Rangeline Road. The existing building
will be replaced with a single building that consists of both Kentucky Fried Chicken and
Long John Silver's Restaurant. The new restaurant boasts sixty seats and is designed to
complement the surrounding architecture.
The proposed site consists of thirty-five (35) parking spaces and a twelve (12) car drive thru
stack, both of which exceed the City's standards. A drive thru bypass lane is also provided.
The proposed site will utilize two access drives, one ingress/egress drive and one egress
only drive. The proposed building and parking lot are 6.5' east of the 45' right-of-way line,
and are encroaching into the building and parking setbacks. However, the city requested
that the building and parking lot encroach into the setbacks because of the future zoning
requirements of the area.
On behalf of Kentucky Fried Chicken and Long John Silver's Restaurant, we are requesting
site plan approval. Enclosed with this letter, you will find:

Two distinctly different restaurants within one building is gaining popularity with today's
consumer, since the consumer is demanding more choices. In order to adequately convey
the two brands to the community, and to sustain the architectural integrity of the building
and site, we are requesting that the City of Carmel grant the following signage variances:
1. Number of wall signs on the fa~ade be increased from two (2) to four (4) in
addition to the monument sign.
2. Increased size and height of menu boards. One @ 45 square feet, 7.5 feet high,
and one (1) @ 22 square feet, 6.7 feet high in lieu of one (1) menu board @ 16
sq uare feet and 6 feet high.
