received September 2, 2004. This office has also reviewed modifications to the mitigation plan
submitted on your behalf by Mr. JeffMoodyofWilliams Creek Consultingdated September 17,
2004, and received by this office on September 20, 2004. According to-the application, you
propose to impact four Class I isolated wetlands totaling 0.53 acre to facilitate the construction of
a commercial development to be known as West Carmel Marketplace. You are claiming
Wetland F as a Class I exemption (0.34 acre); therefore, you are applying for an Isolated
Wetland Individual Pennit to place fill material into three Class I isolated wetlands totaling 0.19
acre: As mitigation for these ill1pacts, you propose-to create 0.20acfe ofCl~ss II wetland onsite
adjacent to jurisdictional wetland D. The project is located northeast ofthe intersection of 96th
Street and Michigan Road (U.S. 421) (Section 7, Township 17 North, Range 3 East) in Carmel,
Hamilton County.

This approval does not relieve the recipient dfthe responsibility of obtaining any other
permits or authorizations that may be required for this project or related activities from IDEM or
any other agency or person. You may wish to contact the Indiana Department of Natural
Resources at 317-232-4160 (toll ftee at 877-928-3755) concerning the possible requirement of
natural fteshwaterlake or floodway permits. In addition, you may wish to contact IDEM~s
Sto~water P~rmits Section at 317-233-1864 concerning the possible need for a 327 lAC 15-5
(Rule 5) 'permit if you plan to disturb greater than one (1) acre of soil during construction.
This approval does not:
(1) authorize impacts or activities outside the scope of this certification;
(2) authorize any injury to persons or private property or invasion of other private rights,
or any infringement of federal, state or local laws or regulations;
(3) co>>_yey any property rights of any sort, or any exclusive privileges;
(4) preempt any duty to obtain federal, state or local pennits or authorizations required by
law for the execution of the project or related activities; or
(5) authorize changes in the plan design detailed in the application.
This decisiQn is effective eighteen (18) days from the mailing of this notice unless a
petition for review and a petition for stay of effectiveness are filed within this 18-day period~ If a
petition for review and' a petition for stay of effectiveness are filed within this period, any part of
the decision within the scope of the petition for stay is stayed for fifteen (15) days, unless or until
an Environmental Law Judge further stays the decision in whole or in part.
This decision may be appealed in accordance with IC 4-21.5, the Administrative Orders
and Procedures Act. The steps that must be followed to qualify for review are:

Conditioned on Plan Commission approval of Docket No. 04080052 PP (West Carmel
Marketplace), the Petitioner Duke Construction Limited Partnership sets forth the following

2. Additionally regarding the North Augusta neighborhood, in the event that
homeowners in the neighborhood can prove with reasonable certainty that any
wells and/or septic systems within the neighborhood have been negatively
affected arising solely fro,m the construction activities of Petitioner, Petitioner will
promptly,offer an appropriate remedy pursuant to best engineering practices and
as otherwise required by Indiana law.
3. These commitments are binding on the owner of the real estate and each
subsequent owner of the real estate and persons ~cquiring interest in the real
estate following approval of the pending applications unless the commitments are
modified 'or tenninated by the governmental authority authorized to make' such
modification.
4. The undersigned agrees to record these commitments in the Office of the
Recorder of Hamilton County, Indiana upon granting of the approval of the

plans for the .above..mentioned project. After reviewing the plans the Highway
Department has the following comments (I have maintained the numbering from my July
14, 2004 letter):

stde entrances to anow the driveways to align with each other. The entrances will
need to be revised as discussed during our meeting held August 31.2004.

The lane must consist of a 100' taper, 150' lane and be 121 wide. OK. the 12' width

the minimum offset "distance. The entrance must be relocated or removed. As

This letter is in response to your primary plat application for West Cannel Marketplace. The
following issues must be resolved prior to signature of the plat by the director:
The following required supporting data must be submitted:
1. Area location map of 1 "==500' showing the following:
a. Existing adjacent uses.
b. Watershed boundaries.
c. Thoroughfares directly related to proposed subdivision.
d. Existing adjoining zoning classifications and proposed uses.
e. Title on area location map, its scale, north arrow and date.
Concerns and Comments are as follow:
1. Plat must be labeled as "Primary" Plat, and not "Preliminary".
2. The most current configuration of the proposed Walnut Creek Drive must be
shown (in regards to the realignment around the Speedway Gas Station property).
3. Blocl(s and lots must be clearly labeled along with their use and square footage.
Please note that the current submittal shows two blocks labeled as "Block A", and
no block labeled as "Block B".
4. Required 60 foot front yard setback must be shown on Block G along Commerce
Drive.
5. Access restricting easements should be shown in the locations indicated on the
attached diagram.
6. It is my understanding that the subdivision variance request will be withdrawn. If
so, the confonning alignment of Commerce Drive must be shown.

7. At the intersection of Commerce Drive and 99th street, Commerce Drive should
have an acceleration lane, deceleration lane, and a passing lane. Only a
deceleration lane is shown.
8. What is the total coverage of Lots 1,2, and 3? Be aware that lots zoned B-3 have
a maximum coverage limitation of 80 percent.
9. Dedicated right-of-way must be. shown clearly at the intersection of 99th street and
Walnut Creek Drive. The right-of-way at this intersection should include the
comer cut. See attached diagram.
10. Be aware that the right-in/right-out entry to Lot 1 off 99th Street (access point
closest to ,Commerce Drive) is not supported by staff. Staff feels this access is a
potential safety issue due to its close proximity to other access points and its
distance from the Commerce Drive/99th Street intersection.
11. The Alternative Transportation Plan requires a 10-foot multi-use path along both
US 421 (Michigan Road), and Commerce Drive. This path should be labeled and
shown accordingly along the primary plat extent of both roads.
Please wait to submit a revised primary plat until after the Technical Advisory Committee (T AC)
has met on this application. The resubmitted plat should include the above comments along with
any comments that arise from the T AC meeting. Additional comments may be made after the
requested revisions have been submitted.

1. Will this building .be protected by an automat.ic fire suppression system? If so a meeting will
need to be scheduled to discuss the location of the fire department connection and additional fire
hydrants for this project.
2. Weare requesting the installation of a Knox box for fire department access. If the building is
sprinklered, we.will be re'questing the Knox fire department connection cap(s). An application for
Knox products is available on-line at www.knoxbox.com

be located at the main entrance.

Prevention Plan for the project. The Plan submitted was not reviewed for the adequacy of the engineering design. All

by a qualified individual with structural measures designed by a qualified engineer. The Plan has not been reviewed

The construction component of the Stormwater Pollution Prevention Plan inclucles stormwater quality
measures to address erosion, sedimentation, and other pollutants associated with'land disturbance '~nd
construction activities. Proper implementation of the plan and inspections of the construction site are
necessary to minimize the discharge of pollutants. The Project Site Owner should be aware that

limitations.
B 1.& 13 Likely ,pollutants that I believe need to be addressed - fueling, service and repair of construction equipme,nt,
dewatering, solid wastes, concrete washout, dust and blowing soil, solvents and chemicals. The plan should provide for
those activities to prevent spills and an action plan if a spill occurs.
B2. This is a large site with a variety of different projects. A more detailed construction sequence is needed. Please show
only one sequence on the plan.
B4. Consider silt fence along US421 and on the east side of Commerce Drive. I think the fence along Walnut Creek Drive
and 99th Street could be eliminated. The fence along the east side of the large retail building could be eliminated.
B5 & B7. The site seemS to drain currently o ffs ite at the east end of 99th Street and across the large vacant lot. Sediment
basins and/or diversion swales are needed.

B 15- If there is a potential for. future projects that are less than one acre, a practice summary is needed for these outlots.
C3- For commercial projects we recommend fore bays, extended detention t~me for the stormwater and a wetland
component. Because these ponds are isolated, establishing native vegetation on the banks and perimeter would reduce
maintenance and add .an additional water quality practice. Future storm outlets. from parking areas that discharge into
Pond B would require fore bays.
C5. An all weather access.road or path is needed to maintain each of the ponds. Maintenance information is needed for
the ponds.
