Docket No. 04080056 PP: Villas at Morgan's Creek - Primary Plat The applicant seeks to plat a residential subdivision of 11 lots on 6.39 acres. The petitioner also seeks the following subdivision waivers: Docket No. 04080057 SW: SCO 6.03.07 -Street Layout & Design Standards Docket No. 04080058 SW: SCO 7.05.07 - Woodlands The site is located at 14309 Gray Road. The site is zoned S l/Residence. Filed by Adam DeHart of Keeler Webb Associates for Covenant Group, LLC. The Public Hearing for this item was held on November 16th. Comments form that hearing include the following: 1. Consistency with other neighborhoods in the area. 2. Requests to see all of the information related to the request. 3. Objections to the work being conducted along the legal drain. 4. Concern that the waivers allow excessive development. 5. Request to have the developer meet with residents prior to the Committee meeting. The Department recommends that the Subdivision Committee forward this item back to the full Plan Commission after all comments and concerns are addressed. Background: The applicant is proposing a 12-10t subdivision on 6.39 acres to be platted under the Residential Open Space Ordinance (ROSa) requirements. Please see the informational packet provided by the applicant to view the layout of the lots and the areas provided as open space. Two subdivision waivers are also requested. One is with regard to street length and the other regarding woodland preservation. Additional discussion is necessary regarding the following: 1. Tree Preservation and landscaping. The applicant is requesting approval to clear more woodland area than permitted. The applicant has submitted little relevant information to the Commission to base a decision. Information that is needed in order for the commission to review the request includes the percentages on what will be removed verses what the ordinance requires be maintained. Further the applicant has not satisfied staff that the proposed level of clearing is acceptable. There is also no language in the plan regarding tree protection procedures. 2. The plans need to identify the connection of sidewalk to the south of the site as well as crosswalks to the west side of Gray Road at the entrance. Committee Report 2004-1130
