C -1 Rezone, Arby's/Party Time/Langston Properties
Petition to rezone 6 properties from B -3 /Business and I -1 /Industrial district, within the Carmel Dr /Range Line Rd Overlay, to
the C -1 /City Center District. The properties are located at the northwest corner of Range Line Rd. and Carmel Dr. Filed by
the Department of Community Services, on behalf of the Carmel Plan Commission.
Please find enclosed the Plan Commission - certified ordinance to rezone parcels to the C -1 /City Center District.
The City of Carmel is petitioning to rezone several parcels located at the NW corner of Carmel Drive and Range
Line Road to the C -1 /City Center District, as established in Chapter 20E of the Carmel Zoning Ordinance. The
subject properties are currently zoned B -3 /Business and I -1 /Industrial within the Carmel Drive /Range Line Road
Overlay Zone. More specifically, the properties' addresses are:
1. 1132 S. Range Line Road (Langston Offices — includes 4 parcels of land)
2. 1212 S. Range Line Road (Party Time Rental)
3. 1224 S. Range Line Road (Arby's)

ON THE PETITION OF THE CITY OF CARMEL

From B- 3/Business to I -1 Industrial zoning, with the Carmel Drive/
Range Line Road Overlay Zone,
to the C -1 /City Center zoning classification.

Dear Members:
The Carmel Plan Commission offers you the following report on the application (Docket
No. 12120003 Rezone of Arby's/Party Time/Langston Properties), petitioning the
Commission for a favorable recommendation to rezone From B -3 /Business to I -1
Industrial zoning, with the Carmel Drive/Range Line Road Overlay Zone, to the C -1 /City
Center zoning classification.
The Carmel Plan Commission's recommendation on the petition of the applicant is
`Favorable."
At its regularly scheduled meeting of January 15, 2013, the Carmel Plan Commission
voted Eleven (11) in Favor, Zero (0) Opposed, Zero (0) Abstaining, to forward to the
Common Council the proposed Ordinance No. Z- 571 -13 with "Favorable."
Please be advised that by virtue of the Plan Commission's Favorable Recommendation,
pursuant to IC 36- 7- 4- 608(0, the Council has ninety (90) days to act on this petition
before it becomes effective as Certified by the Commission. Ninety days from the date of
the Certification is Sunday April 28, 2013.

5 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
6 INDIANA, REZONING DISTRICT CLASSIFICATION

8 Rezoning 6 properties northwest of Carmel Drive and Range Line Road from the B -3 /Business and 1-
9 1/Industrial District Classifications within the Carmel Drive/Range Line Road Overlay to the C -1 /City
10 Center District Classification

12 WHEREAS, pursuant to Indiana Code 36 -7 -4, the Common Council has lawfully adopted a zoning
13 ordinance, the terms of which are applicable to the geographic area consisting of the incorporated area of the
14 City of Carmel, Indiana, and the unincorporated area of Clay Township, Hamilton County, Indiana, which
15 zoning ordinance has been codified in Chapter 10 of the Carmel City Code; and
16
17 WHEREAS, pursuant to Indiana Code 36 -7 -4 -602 the Common Council is authorized to amend the
18 map that is part of the zoning ordinance; and
19
20 WHEREAS, the Carmel Advisory Plan Commission gave a favorable recommendation on Tuesday,
21 January 15, 2013, regarding the rezoning of the real property as described in Exhibit A, and which is
22 illustrated in the location map of Exhibit B also attached hereto.

24 NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana,
25 as follows:

27 Section 1. That the Official Zoning Map accompanying and made part of the Zoning Ordinance is
28 hereby changed to designate the real property from the B- 3/Business and I- 1/Industrial District
29 Classifications within the Carmel Drive/Range Line Road Overlay Zone to the C -1 /City Center District.

31 Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are
32 hereby repealed.

34 Section 3. This Ordinance shall be in full force and effect from and after its passage and signing by
35 the Mayor.

37 Ordinance Z- 571 -13 PASSED by the Common Council of the City of Carmel, Indiana this
38 day of , 2013, by a vote of ayes and nays.
