To Whom in May Concern:
I recently received a Notice of Assessment of $585.00 in regards to the Cool Creek North
Improvement District and the property I formerly owned at 181 Hawthorne Drive, Carmel. I do
not believe this pertains to me for the following reasons:
1) As I discussed with Ms Karen Huffman on 29 October, I sold the property involved
to Mr and Mrs Todd Vonderohe on 15 June 2001. (see Warranty Deed enclosed).
2) I had lived at 181 Hawthorne for less than 2 years, having purchased it from Mr and
Mrs Tom Collins, the original owners, in June 1999. I was not around when the decisions were
made to improve the district and/or to adopt a Barrett Law Improvement District for Cool Creek
North.
3) The pendency of this assessment was not disclosed to me when I purchased the
property in June 1999. In fact, I was completely unaware of it until receiving notice in May of
2001, just 1 month before I was to close /sell the property.
4) The subject of this assessment came up at the financial closing of the property on 15
June 2001. Discussions between my real estate agent (Mr Jay O'Neil, RE/MAX, 99 Carmel
Drive) and the Vonderohe's real estate agent (name unknown) concluded that the Vonderohe's
would be responsible for the assessment. The figure of $585.00 was used in these discussions.
While it may be immaterial, I should like to point out that the reason I move so often is
that I am on active duty with the US Navy. I had been ordered to command the Naval and
Marine Corps Reserve Center in Indianapolis in early 1999, yet by early 2001 had orders in hand
to transfer to Naval Air Station, Jacksonville Florida as soon as possible. Frequent changes of
station are part of military life!

This Indenture Witnesseth, that Joseph D. Harrington and Judith M. Harrington, husband and
wife ( "Grantor ") of Hamilton County, State of Indiana, CONVEYS AND WARRANTS to Todd R. Vonderohe
and Angela J. Vonderohe, husband and wife, of Hamilton County, in the State of Indiana, for the sum of One
and no /100 Dollars ($1.00) and other valuable consideration, the receipt of which is hereby acknowledged, the
following described real estate in Hamilton County, in the State of Indiana:
Lot Number 69 in Cool Creek North, Section Two, an addition in Hamilton County, Indiana, as per
plat thereof, recorded in Plat Book 4, pages 167 -168, amended by Surveyor's Certificate of Correction
recorded in Miscellaneous Record 144, page 271 in the Office of the Recorder of Hamilton County,
Indiana.
Subject to taxes for 2000, due and payable in November 2001, and subject to taxes payable thereafter
Subject to covenants, agreements, easements, restrictions and rights of way of record.
Subject to the following mortgage(s) which shall be paid in full from the proceeds of the sale:
Mortgage for $163,400.00 from Joseph D. Harrington and Judith M. Harrington, husband and wife to Navy
Federal Credit Union dated June 29, 1999, and recorded July 2, 1999 as Instrument No. 9909939832 in the Office
of the Recorder of Hamilton County, Indiana.
