The meeting was held at 5 :30 PM in the Caucus Room of City Hall, Carmel, Indiana on Monday,
April 25, 2005. The Hearing Officer was Earlene Plavchak.
Department of Community Services Staff in attendance was Angie Conn. John Molitor, Legal Counsel,
was also present.

Id. Windemere, Sec 5, lot 92: Altavilla pool house
Petitioner seeks the following development standards variance approval:
Docket No. 05030014 V Chapter 25.01.01.B.3.B.i.b accessory building setback
The site is located at 10417 Windemere Blvd, and the site is zoned S-l/Residence.
Filed by Brian Robinson of Stoeppelwerth & Associates.
Present for the Petitioner: Mark Gradison, Gradison Building Corporation, contractor for the pool house.
The variance is for the rear yard drainage and utility easement. The-Hamilton County Surveyor's office
approved it as long as there were no other utilities in the easement. Photos were shown of the property. The
rear yard contains quite a few trees they are trying to preserve. The rear yard is bordered by a private golf
course. Placing the pool house at the side of the pool would impact the trees.
Mrs. Conn gave the Department Report. The County Surveyor's office has approved the encroachment. The
pool house would still be set back 20 feet from the rear property line which is the setback requirement in
that zoning district. The Department recommended positive consideration.
Members of the public were invited to speak in favor or opposition to the petition; no one appeared.

2d. Specialty Risk International
Petitioner seeks the following development standards variance approval:
Docket No. 05040001 V Chapter 17.04.03.02 side yard setback
The site is located immediately west of 501 Congressional Blvd and is zoned
B6/Business.

Present for the Petitioner: Elizabeth Hobbs. A site plan for these corporate headquarters for Specialty
Risk International was shown. This will be a 12.5-foot encroachment into the 60-foot side yard. In all

Ms. Hobbs stated that this was a pre-existing site with the 111 building on one side, a Duke buildi g on the

building at some time.
Mrs. Conn stated that the Department recorrnnended positive consideration.

Docket No. 05030012 V Chapter 25.07.02-08.d sign height
The site is located at 11939 N Meridian St, and the site is zoned B~6/Business within the
US 31 Overlay Zone.
Filed by Paul Reis of Drewry Simmons & V ornehm for Wagner Reese & Crosse LLP.
Pres€nt for the Petitioner: Paul Reis. They looked at the site plan in the packet. They have added a larking
area to the rear for employees. There is adequate drainage with rip-rap. There has been no other 1
construction to affect the drainage. The parcel is wooded area. Rather than provide for the planting around
the fbot of the building, they have parking spaces. They did not want to sacrifice the trees for a 10-1 oot
plan~ng strip. Forty square feet is permitted for the wall sign. A rectangle around the proposed si would
be aJpltoximately 59 square feet. The components themselves are less than the permitted 40 squard feet. The
buildmg sets back ITom US 31 and the letters need to be an appropriate size.
Mrs. Plavchak did not feel that anyone could see "InjuryAttomeys.com" from the highway.

Mr. teis stated that it is a very important matter of advertising and is significant for the practice. T ey felt it
was important to keep rather than making "Wagner Reese & Crossen" larger. I
MrsJp\aVChak felt it would be alright ifthe sign could be made without a variance, but she did not see any
reas n for a variance so that an email address could be added to the sign. .
DiscLsion continued on ways to change the sign.
Mrs. Conn stated that the email address is also on the ground sign.

Mr. Reis stated that the ground sign needed the height variance for the cap at the top of the sign.
Mrs. Conn and Mr. Molitor did not feel the petitioner would need to go back to the Plan Commission if the
wall sign was configured like the ground sign.
Members of the public were invited to speak in favor or opposition to the petition; no one appeared.
Mr. Reis TABLED Docket No. 05030011 V, sign area, to further discuss the design with the petitioner.
If the new design is less than 40 square feet, they will not need a variance.
Mrs. Plavchak APPROVED Docket Nos. 05010014 V, 05010015 V, and 05030012 V, Wagner Reese &
Crossen.
