RESPONSE TO DEPARTMENT REPORT
AND 11/4 SPECIAL-STUDIES COMMITTEE MEETING
Request # 1 : Dedication of right of way per site plans.
Response #1: There was a dedication by Deed, by the current owner, per Instrument No. 2003-
88445, which granted 38.43 feet for Guilford Road along most of the frontage of subject property.
Equicor will dedicate so much right of way so as to create a 40 foot half (1/2) right of way along the
entire frontage of Guilford, as shown on the site plans submitted. Equicor cannot dedicate a 45 foot
half (1/2) right of way as suggested in the report for tonight's hearing, due to site constraints.
Request #2: Limit signs to two colors; white against brick, white and darker color against EFIS.
Response #2: Petitioner will agree to sign criteria limiting sign colors as requested; however,
Petitioner must have flexibility to provide those tenants with proprietary or trademarked logos with
colors other than as stated above with ability to incorporate such logos into their sign packages.
Logos shall be limited to 25% of sign square footage.
Request #3: Signage per Tab 11.
Response #3: Signs featured in Tab 11 are non-illuminated, and oriented to interior of center.
Equicor shall keep the "discs" one color and the "push-through" lettering shall be consistent.
Request #4: Color Elevation of Dumpster Enclosure requested.
Response #4: Being submitted tonight (11/4/2004). Equicor agrees to make the doors to the
enclosure higher.
Request #5: Access easements to be provided to north and west.
Response #5: Site plan proposes access to west, which is a parcel that also wraps around north of
subject property. Petitioner will grant access to west adjoiner, provided west adjoiner agrees to
contribute to maintenance costs of access driveways, and other terms, conditions and reasonable

consideration acceptable to Petitioner. The Petitioner respectfully declines to provide access to the
north, because of the adjoining parcel shape described earlier, and the planned residential uses to the
north, which would be incompatible.
Request #6: Right of Way lighting to be consistent with City fixturing of 116th Street.
Response #6: Need to see fixtures from Carmel Department of Public Works. Equicor will
coordinate with the Department of Public Works.
Request #7: Conclusion/Approval letter from Scott Brewer, Urban Forester.
Response #7: Plans submitted to Mr. Brewer and approved with revisions, removing Hawthorns
and replacing them with Serviceberries.
NEW REQUESTS/RESPONSES
Request #8: The Committee inquired about the window treatments within the proposed building.
Response #8: Equicor will not permit "decals" on windows, and intends to install a standard,
consistent interior window shade in all tenant spaces. The glass being used in the windows is clear
insulated glass.
Request #9: The Wood Park Owners Association expressed a desire to have three houses fronting
on 116th Street buffered from the affects of the development and the planned improvements to 116th
Street. They requested a height extension to the existing Wood Park "wall" located just to the south
of the south right of way line of 116th Street.
Response #9: On Wednesday, November 10th, Equicor tendered a proposal to the neighborhood
association, offering an evergreen buffer to be planted in the affected homeowners rear yards, or a
contribution of $5,000 toward a buffer or wall extension, as determined by the neighborhood
association. On Tuesday, November 16th, the neighborhood association responded, asking that
Equicor contribute to the cost of an 8 foot wood fence to be placed on the inside of the wall, and
running the entire length of the wall, or approximately 300 feet, together with other incidental
items. Equicor has offered to contribute $7,000 to the cost of the fence, representing approximately
50% of said cost.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on September 16, 2004, 2004 for this project and have the following comments:
1. The proposed proj ect falls in tIle jurisdiction of the City of Ca.rmel.
2. The proposed project DOES NOT fall in a Carmel Wellhead ProteotionZone.
3. Please submit an outlet permit for the discharge into the W.R. Fertig Regulated
Drain. The application is available on our website at
http://wwwoco.hamilton.in.us. go to Departments, Surveyor, and Forms.
40 Please coordinate the storm sewer design with both the City of Cannel Engineer
Department and this office.
5. The proposed site falls in the WoRt Fertig watershed, wllich has an allowable
release rate set at 0.24 efs per acre, by the Hamilton County Drainage Board.
6. Please add a stann structure data table to the constmction plans.

7. Per the City of Carmel, the existing CMP under Guilford Road will be removed
with the 116th Street Road Project. Please work with this office or the Department
of Engineering for Carmel to detennine where the site will outlet.
8. Please provide product infonnation for the Stormtech underground detention
system for our review.
9. The Hamilton County Surveyor's Offioe has oompleted an initial review of the
submitted drainage calculations and it appears the site is in compliance with the
watershed release rate. This office witl1 further review the drainage calculation to
detennine if the underground detention is sized property and issue an additional
comments letter after that revieW4
10. Please provide this office with copy of all revisions made to the construction
plans or drainage calculations4

We have reviewed the construction plans and secondary plat submitted for the September 22, 2004
Technical Advisory Committee meeting. We offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Street and Right of Way - City of Carmel (Guilford Road/116th Street).
. Water - City of Carmel
~:. Sanitary Sewer - Clay Township Regional vVaste District.
. StonnSewer - City of Carmel/Hamilton County Surveyor's Office
3. Board.ofPublic Works and Safety Approval.Requirements:
. Water Availability.
. Commercial Curb Cut. The request for Board approval should include 8 ~" x 11" exhibits that
will indicate the existing c~rb cut, the proposed curb cut and all appropriate data and dimensions
including width, radii, etc. Please indicate all existing and opposing driveways and their
relationship to the proposed curb cut for this development.
. Temporary Constnlction Entrance. Separate BPWS approval will be required if this entrance is to
be located anywhere other the site of the permanent curb cut.
· Consent to Encroach approvals for any permanent improvement to be installed within dedicated
easements and/or dedicated right of way. If an irrigation system is planned for this project,
additional W ater Availability approval will be required from the Board and additional Water
Connection Fees will be due.
. Secondary Plat approval (If applicable).
· Dedication of additional right of way (if applicable).
I am enclosing a schedule for Board of Public Works and Safety meeting dates.and agenda deadlines
for your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior final approval by the Carnfel Clay Plan Comnlission
and/or the Board of Zoning Appeals and conzpletion of review by the Technical Advisory
Committee. All written requests to be place on the Board's agenda must include the appropriate
DocketNunzbers and the date (or dates) of approval by the Plan Conlmission anillor BZA.

are based upon total acreage of the project. Current Water Availability Fees are $1,010.00 per acre.
\Vater C'onnection fees - We will require a listing of the buildings, tenant spaces per building and
type of tenant if known. Water availability approval from the Board of Public Works and Safety is
based upon total EDU's. EDUs are determined by type of use from our Utility Ordinance. I am
enclosing copies of our Equivalent User Contribution Multiplier from the Ordinanc.e. The current
Water Connection Fee is $1,310.00per EDU.
5. TAC ReviewlDrawings submitted for approval:
We request that all comments and comment letters generated by this office be ans\vered in writing and
be aG~ompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Cam1el Utility issues must also re resolved. The
design engineer must certify all drawings submitted for final approval. This office will require a
minimum of four-sets (maximum of six-sets) of approved drawings after all issues have been resolved.
The drawings will be stamped approved and signed by both the City Engineer and Director Carmel
Utilities. The Developer/Owner will receive one-setwhich is to be maintained on the construction site
at all times. Carmel Utilities will receive one-set. Our Public Works Inspector will receive one-set
and one-set will be maintained in the Department of Engineering. If more than the minimum of four-
sets are requested to be approved, the additional sets (maximum total of two additional) must be
submitted with the four required sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
easements and/or right of way will require Consent to Encroach approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
main locations.
8. Cannel Utilities will provide a separate review of this project for water issues.
9. I am including copies of the following with this correspondence:

1 O. We have engaged Crossroad Engineers to review all drainage plans and calculations for all projects
submitted to this office for review and approval. We will share all Crossroad reviews as this office
receives them.
BONDING REQUIREMENTS
11. Upon initial review, it appears the following bonding requirements may apply to this project:
Performance GuaranteeslEngineer's Estimates
Please provide a detailed and itemized Certified Engineer's Cost Estimate for 100% of the cost of labor
and materials for the construction of the following improvements: .
. 8-inch water main and service lines (from proposed water main extension to site).
. Sidewalks in dedicated right of way.
Individual Performance Guarantees will be required in the amount of the Engineer's Estimate.' Upon
completion of these improvements and release of'the Performance Guarantees by our Board of Public
Works and Safety, individual 10% 3 -year Maintenance Guarantees will be required.
StreetCut/Right of Way Permit and Bonding Requirements
Any work in the dedicated right of way of Guilford Road and/or 116th Street, not included in
construction covered by a Performance Guarantee, will require a Right of Way Permit and a License
and Permit Bond. The bond amount \vill be determined by the number of instances of work in the right
of way @ $2,000.00 per instance. It appears that a Right of Way Permit will be required for

construction of the 2 cuts (if2 are approved), sanitary sewer installation and crossing of 116th Street,
water main installation and crossing of Guilford Road and storm sewer construction in the right of way
of Guilford Road. If the sanitary sewer and water main crossings on 116th Street and Guilford Road
are intended to be open cuts, both will require separate approval by our Board of Public Works and
Safety. Please contact our Right of Way Manager, Fred Glaser, to arrange permitting and bonding.
PROJECT COMMENTS-CONSTRUCTION PLANS
12. Please show the existing pavement widths and existing centerlines of 116th Street and Guilford Road.
13. Is the entrance shown for Guilford Road and existing or proposed entrance? Please label
appropriately.
14. Please do not consider the curb cuts as indicated on this set of plans as being approved curb cuts. The
City will require additional time to determine the feasibility of the proposed curb cuts.
15. Please incorporate the 116th Street plans into construction plans subInitted for this project.
16. Weare requesting that appropriate right of way, per the City of Carmel 20- Year Thoroughfare Plan, be
dedicated for 116th Street and for Guilford Road. Please refer to the 116th Street Plans for any
additional right of way requirements beyond the Thoroughfare Plan.
17. Where is the location of the temporary construction entrance for the site?
18. Please sho\v demolition of the two existing drives into the property. Reconstruction of these drives
will be deleted from the road proj ect.
19. Site Plan - Sheet C201
. Label and dimension all right of way lines.
· There is a solid and dashed line on the west side of Guilford that is dimensioned as 40' half right
of way. What does the solid line adjacent to the right represent? Is this right of way that has been
purchased forthe 116th Street project?
. Right of way paving is indicated on the legend but not on the drawings. Please show right of way'
paving section on the plans.
· What does the herringbone hatching indicate?
· There is no break in the pavement striping for the proposed Guilford Road entrance. The City
requests the entrance to be aligned with the opposing existing. entrance to the north.
· A provision for a left turn lane into the development must be provided. This will be a problem per
the current road striping since the right turn only lane would not be able to be used as a passing
blister. Please contact this Department to review this issue.
· The proposed entrance into 116th Street must be striped and signed as a right-in/right out only.
· The proposed striping at the existing entrance is incorrect and needs to be revised for the entrance
at the revised location.
· The 10' sidewalk shall be a 10'. a~phalt multi-use path. Please note as such. Does your grading
and the road project grading allow for the installation of this path?
20. Grading Plan- sheet C202
· Please identify any direct discharge areas in the drainage report.
· Please grade the 116th entrance such that a grade break is provided at the right of way. Drain the
majority of this back onto the property.
· Please add s Structure Data Table that references the details provided on the Detail Sheets.
· The existing 18" CMP, which is the proposed outfall connection, is being removed as a part of the
road proj ecl.
· Please add theproposed storm system for the road project to these plans and re-considerthe
outfall. You will need to demonstrate that the road drainage system can receive the discharge
from the on-site system.
· Please consider the entire roadside-grading plan, including back of curb and side slopes behind
curb in your grading plan.

. How will the Guilford side of the building drain?

. Please label the outlet control structures on the drawings.
21. Utility Plan - Sheet C203
. Has our Utility Department given indication as to when the Guilford Road water main extension
will occur?
. W ill the existing sanitary sewer indicated on the south side of 116th Street remain in its present
location or will it be relocated with the 116th Street road project?
. What is the western terminus of the underground storm running east' and' west in the middle of the
site? Does this pipe originate somewhere else? Will this be extended in the future?
. Please identify the storm structures and pipes including pipe size, material, slope, etc.
. The site seems to have a shortage of storm structures to adequately drain the parking lots.
. Please provide arrows to indicate surface drainage flow in the parking lots.
. It is our assumption that the storm drainage system, onsite and offsite, will be a private system to
be maintained by the Owner/Developer.
. Will there be easements provided for the water and sanitary sewer mains?
22. Site Details - Sheet C801
. Provide a right of way paving section for the portion of curb cuts in dedicated right of way.
. Please indicate City standard, curbing and sidewalk for any curbing and sidewalk in the right of
way.
. Add an Asphalt Path Detail per City standards.
We reserve the right to provide additional comments as this project proceeds through the approval process.
The above comments are based upon the Engineering Department's initial review of the construction plans
and secondary plat. Please provide our office with a follow up letter regarding this review and revised
plans, indicating all revisions. A second review will focus only on detailed construction plans. It is critical
that our office be made aware of all modifications made on the plans being re-submitted, particularly if any
such changes are considered "new" or fall outside of our initial review.

This letter is. ip response to the application filed for a DP/ADLS at the northwest .comer of 1 16th &
Guilford for 116th Street Centre. Members at the TAC Meeting will make additional comments on
September 22. The: following review is based on the property. receiving B-2/Business rezone approval.

The site is perri1itted one complex ground sign per frontage as requested. However, only
one wall sign is permitted per tenant per frontage. D<;)CS will support a request for relief
to allow 1 additional sign per tenant subject to the following condition: consistent sign
color and style/design, with variation allowed for logos, which are only allowed to take
up 25% of the sign area.
Provide greater detail of proposed signs' for this application~

width, but not number of plantings.
