Dear Mr. i3nd Mrs. Smalstig:
In response to your most recent inquiry dated September, 23 2004 (received on September 29, 2004)
regarding reparation for the removal of the Walnut Tree from your property, and as follow up to our meeting
and phone conversations over the last few weeks, Platinum Properties, LLC will do the following:
1. The logs that were generated from the tree removal will be returned to you in a manner that is
agreeable to you and Platinum.
2. VIe will contract with Vine and Branch to meet with you and complete the cleanup of your property
to your satisfaction including the removal of the pine tree damaged by the walnut tree removal.
This cleanup may also include removal of some under brush and scrub trees that are immediately
g,)uth of our shared property line and west of the location of the walnut tree removal to allow us to
better place required buffer-yard landscaping for Cherry Creek Estates Section 6 to create a
s~reen between future homes in Cherry Creek Estates and your home.
3. The old stump left from the walnut tree removal will be ground down to just below grade.
4. Four (4) 7' tall Serbian Spruce trees to be installed on your property around the location of the
\~'a!nut tree and pine tree removal. The locati.on of the trees v'Jill be coordinated ~vith you and \line
and Branch as is described in number 2 above.
5. In lieu of the 3 board fence with welded wire fabric that was previously committed to you and Mr.
Lunik, a 6' tall dog eared, cedar shadowbox fence will be installed along the north property line of
(;herry Creek Estates Section 6. The fence will begin at the eastern edge of the property and
extend 1020' west, and it will be located approximately 6" south of the property line. The fence will
be installed as soon as is practical following the completion the utility stubs to the Smalstig and
Lunik properties and prior to the commencement of home construction along the same north
property line. It is also noted that the fence will be installed in a platted tree preservation
easement, and under the current covenants and restrictions for this property the fence will
therefore have 1) ongoing care and maintenance solely at the expense of the Homeowners
P.ssociation, and 2) the fence will be restricted from any modification without written
cammunication to all homeowners and adjacent property owners. Finally, we understand that you

This is to inform you that we accept your proposals as spelled out in your
E-Mail and letter of Nov. 2,2004. The specifics include the stump grinding,
property clean up, evergreen tree planting, wood return, and fencing changes
(1020 linear feet of 6 ft tall cedar shadowbox fencing, in lieu of 1320 ft of 3
board fencing with welded wire originally agreed to).
The Lunik Family has been consulted and agree to the proposal you presented.
We would also request a written acknowledgement from Pulte Homes to the
ongoing maintenance and care of the fencing to be installed, as well as their
agreement that no changes in the fencing will be made without approval of adjacent
property owners as well as their homeowners.
Our desire is for continued cooperation with your Company for our mutual
benefit.

Sewer Corrections:
We have met with Jim Haag concerning the sanitary sewer.
The sewers were'revised accordin,gly
Water Corrections:
The watermain was revised to go straight into Vestal Court
and deadend with a valve and hydrant.
The tie-in at Klingensmith Boulevard and Cherry Tree
Road was shown to have a wet tap.

Sewer Corrections: We have,met with Jim Haag concerning the sanitary sewer. The
sewers were revised accordingly.
Water Corrections: Lots 353 and 310 now have valves. Fire hydrant assembly was
added to Lot 300. Afire hydrant was not added at Lot 286. The
water. line was revised.
At Lot 301 a valve was added on the East side of the tee.
A valve was added on the main across from Lot 296.

Board of Zoning Appeals (ifapplicable) and completion of review by the Technical Advisory Conlmittee.
All written requests to be placed 011 the Board's agenda ",ust include the appropriate Docket Number and
the date (or dates) of appro val by the Plan Commission and/or the Board of Zoning Appeals (if
applicable).
4. T.A~C. Review/Drawingssubmitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all Engin~ering pepartment and Utility Department issues have been resolved. The design
engineer must certify all drawings submitted for final approval. This office will require a minimum of five-
sets of dra\\fings for approval after all issues have been resolved. The drawings will be stamped as approved
and will be signed by the City Engineer and the Director of Carmel Utilities. The Owner win receive one-set
which is to be maintained on the construction site at an times. Carmel Utilities will receive two-sets, our
Public Works Inspector win receive one-set and one-set will be maintained in the Engineering Department
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way or
dedicated easements will require a Consent to Encroach Agreemeht with the City of Carmel~ Board of
Pub1ic Works and Safetv.
6. Carmel Utilities should be provided drawings for review of water and sanitary se\ver issues. They will
provide a separate review regarding these issues.
7. Carmel Utilities does not subscribe to "Holey Maley" and should be contacted'directly for all water main and

9. As you are aware, we have' engaged Crossroad Engineers for review of drainage plans and calculations for all
projects submitted to this office for review. We have submitted the extra set of plans and calculations to
Crossroad. We will share their comments when we receive them.
BONDING REQUIREMENTS
10. Individual Performance Guarantees will be required for the following subdivision improvements:
. Streets
. Curbs
. Water Mains
. Sanitary Sewers
. Storm SewerslDrainage
. Monuments and Markers
. Street Signs
. Sidewalks (builders lot sidewalks and common area/perimeter right of way sidewalks may be bonded
separately).
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost
of labor and materials to construct the individual improvements, to be provided by the design engineer.
Please provide detailed Engineers Estimates for each improvement including unit costs, quantities, materials
and types of mat~rials, etc. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the
Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements.
Performance Guarantees may be Performance or Subdivision Bonds, lIl,'evocable Letters of Credit or
Cashier's/Certified/Official Checks. Please reference the enclosures for more detailed explanation of our
procedures.
AVAILABILITY AND CONNECTION FEES
11. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been
satisfied and prior to start of construction activities (the exception is that you are allowed to move dirt on
site). Availability Fees are based upon total platted acreage for the development at the current rate of
$1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary Sewer Availability. Based
upon the plat presented with the construction plans, the following Availability Fees would apply:
