HEARING OFFICER OF THE CARMEL BOARD OF ZONING APPEALS
Docket No. 05060004 V
The Hearing Officer of the Carmel Board of Zoning Appeals will conduct a meeting on
the 27th day of June, 2005, at 5:00 p.m. at Carmel City Hall, 1 Civic Square, Carmel, Indiana
46032 for the purposes of holding a public hearing on BFI Properties, LLC's ("Petitioner")
developmental standards variance application for the property located at 479 Gradle Drive. The
Petitioner requests a developmental standards variance of 926.04.01 of the Carmel Zoning
Ordinance to reduce the perimeter landscape buffering consistent with the plans on file with the
Carmel Department of Community Services.
The property that is the subject of the developmental standards variance application is
located at 479 Gradle Drive in Carmel, Indiana and is further described in the following legal
description:
Part of the Northeast Quarter of Section 36, Township 18 North, Range 3 East in Clay Township,
Hamilton County, Indiana, described as follows:
Commencing at the Northeast comer of the Northeast Quarter of Section 36, Township 18 North,
Range 3 East;. thence South 00 degrees 00 minutes 00 seconds (assumed bearing) on the East line
of said Northeast Quarter 1188.00 feet; thence South 89 degrees 27 minutes 30 seconds West
parallel with the North line of said Northeast Quarter 1191.63 feet to the West line of Third
Avenue, S.W.; thence South 01 degrees.07 minutes 44 seconds West on said West line 638.97
feet; thence South 00 degrees 38 minutes 00 seconds East on said West line 291.47 feet; thence
South 89 degrees 22 minutes 00 seconds West 508.20 feet; thence South 00 degrees 38 minutes
00 seconds East parallel with the West line of Third Avenue, S.W., 205.05 feet to the place of
beginning of the within described real estate; thence South 00 degrees 38 minutes 00 seconds
East parallel with said IWest line of Third Avenue, S.W., 223.76 feet; thence North 85 degrees 00
minutes 00 seconds' West 216.98 feet; thence North 00 degrees 41 minutes 45 seconds West
202.46 feet to a point on a line which bears South 89 degrees 22 minutes 00 seconds West from
the place of beginning, said point being 250.00 feet North 89 degrees 22 minutes 00 seconds East
from the East line of Gradle Drive; thence North 89 degrees 22 minutes 00 seconds East on said
line 216.16 feet to the place of beginning.
Together with an easement for ingress and egress to and from said real estate being 26 feet in
width as reserved in a Warranty Deed recorded in Deed Record 330, page 683-684 in the Office
of the Recorder of Hamilton County, Indiana.
The application is identified as Docket No. 05060004 V.

given the. opportunity to be heard at the aforementioned time and place. Written comments may
be filed prior to the hearing. The application and plans may be reviewed at the Carmel
Depart~ent of Community Services office located, at Carmel City Hall, 1 Civic Square, Carmel,
Indian'a46032. The hearing m'ay be continued from time-to-time as may be found necessary.
