HomeMy WebLinkAboutZ-571-13 Rezone NW of Carmel Drive/Rangeline Road/Langston Offices, Party Time Rental, Arby'sSPONSORS: COUNCILOR RIDER ORDINANCE Z- 571 -13 AS AMENDED AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REZONING DISTRICT CLASSIFICATION Rezoning 6 properties northwest of Carmel Drive and Range Line Road from the B -3 /Business and I- 1 /Industrial District Classifications within the Cannel Drive /Range Line Road Overlay to the C -1 /City Center District Classification WHEREAS, pursuant to Indiana Code 36 -7 -4, the Common Council has lawfully adopted a zoning ordinance, the terms of which are applicable to the geographic area consisting of the incorporated area of the City of Carmel, Indiana, and the unincorporated area of Clay Township, Hamilton County, Indiana, which zoning ordinance has been codified in Chapter 10 of the Carmel City Code; and WHEREAS, pursuant to Indiana Code 36 -7 -4 -602 the Common Council is authorized to amend the map that is part of the zoning ordinance; and WHEREAS, the Cannel Advisory Plan Commission gave a favorable recommendation on Tuesday, January 15, 2013, regarding the rezoning of the six (6) parcels of real property described in Exhibit A, and illustrated on Exhibit B, both exhibits incorporated herein by this reference (the "Real Property Parcels "). NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby changed to designate the Real Property Parcels from the B -3 /Business and I -1 /Industrial District Classifications within the Carmel Drive /Range Line Road Overlay Zone to the C-1/City Center District, the same being expressly subject to and contingent upon said re -zone, as well as the design plan, project agreement, use, and all related matters (except for ADLS) regarding and for the Real Property Parcels, receiving the approval of both the Carmel Redevelopment Commission and the Carmel Common Council prior to any new building permits being issued. Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section 3. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. To: The Honorable Common Council Of the City of Carmel Hamilton County, Indiana Dear Members: The Carmel Plan Commission offers you the following report on the application (Docket No. 12120003 Rezone of Arby's/Party Time/Langston Properties), petitioning the Commission for a favorable recommendation to rezone From B -3 /Business to I -1 Industrial zoning, with the Carmel Drive/Range Line Road Overlay Zone, to the C -1 /City Center zoning classification. The Carmel Plan Commission's recommendation on the petition of the applicant is `Favorable." At its regularly scheduled meeting of January 15, 2013, the Carmel Plan Commission voted Eleven (11) in Favor, Zero (0) Opposed, Zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z- 571 -13 with "Favorable." Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36- 7- 4- 608(0, the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission.
