HomeMy WebLinkAboutFindings of Fact 12020015-17 CARMEL/CLAY ADVISORY BOARD OF ZONING APPEALS FINDINGS OF FACT-DEVELOPMENT STANDARDS VARIANCE Docket No.: 12020015 V—Building Orientation— Building not occupying 70% of frontage Petitioner: KRG Centre, LLC &Centre Associates 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the variance will allow the petitioner to redevelop and revitalize an existing retail center that is suffering from reduced occupancy resulting from the relocation of the anchor tenant. The proposed design and construction of the redevelopment will not affect the public health,safety or morals of the community and will improve the general welfare of the community by enhancing the value of the property. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the variance will allow for the redevelopment of the property,the enhanced appearance and operation of the retail center and the increase in the value of the property;all of which will enhance the use and value of the area adjacent to the property. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: this is only a partial redevelopment of the site.The strict application of the Zoning Ordinance,specifically certain provisions of Chapter 23F—Carmel Drive-Range Line Road Overlay Zone and the provisions of Section 27.08, will result in practical difficulties in the use of the property and effectively preclude the proposed redevelopment and revitalization of the property DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. '1 20 260/5- V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
