of Septen1ber 22, 2004.
The comments from the City revie\v have been satisfactorily addressed.
Please submit seven sets of plans for approval. The Department \vill approve up to t\vo additional sets for at total of
nine sets. A11 availability fees must be paid and all perfonnance guarantees (if required) must be posted prior to
Departn1ent approval. After the Departn1ent of Engineering approves the drawings, you must take them to the County

Dear Mr. Burke:
We have reviewed the construction plans submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Streets and Right of Way - City of Carmel (Horseferry Road).
. Water - Indianapolis Water Company Service Area
. Sanitary Sewers -- Clay Township Regional Waste District Service Area
. Storm SewerslDrainage - Hamilton County Surveyor's Office (City of Carmel review).
. Regulated/ Legal Drains - Hamilton County Surveyor's Office.
3. Board of Public Works and Safety Requirements:
. Commercial Curb Cut Approval if applicable.
. Temporary Construction Entrance if applicable.
. Please be advised that allY open cuts of dedicated streets will require separate Board of Public Works
and Safety approval
. Any permanent improvement (including irrigation systems) to be installed within dedicated right of way
or dedicated easements. This approval would require a Consent to Encroach Agreement between the
Owner and the City of Carmel.
. Secondary Plat approval if applicable.
A schedule for Board of Public Works and Safety meeting dates and agenda deadlines was sent with previous
reviews. Please use the Engineering Department deadlines for submissions to the Board.
.Anysubmission to the Board requires prior approval by the Cartnel Clay Plan Commission and/or the
Board of Zoning Appeals (if applicable)cand completion of review by the Technical Advisory Committee.
All written requests to be placed on the Board's agenda mustinclude the appropriate Docket Number and
the date (or dates) of approval by the Plan Comn,ission and/or the Board of Zoning Appeals (if
applicable).
4. T.A.C. Revie\v/Drawings submitted for approval:
We request that all comments and .comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all Engineering Department issues have been resolved. The design engineer must certify
all drawings submitted for final approval. This office will require a minimum of three-sets of drawings for
approval after all issues have been resolved. The drawings will be stamped as approved and will be signed
by the City Engineer. The Owner will receive one-set which is to be maintained on the construction site at all
times'. Our Public Works Inspector will receive one-set and one-set will be maintained in the Engineering
Department. We will approve an ~dditional two-sets of drawings, totaling five-sets if desired. The additional
sets must be provided with the nlinimum three-sets.
5. Please be advised that any installation of signs, walls, irrigation syst~ms, etc. within dedicated right of way or
dedicated easements will require a Consent to Encroach Agreement with the City of Carmel's Board of
Public Works and Safetv.

BONDING REQUIREl\tIENTS
7. Performance/Maintenance Guarantees:
There does not appear to be any Performance or Maintenance Guarantee requirements for this development.
8. Right of\Vay Permits/Right of Way Bonding:
Any work in the dedicated street right of way of Horseferry Road will require a Right of Way Permit and a
License and Permit Bond. The bond amount will be determined by the number of instances of work in the
right of way at $2,000.00 per instance. Open pavement cuts in dedicated streets require separate approval by
our Boardofj->ublic Works anq Safety. Please contact our Right of Way Manager, Fred Glaser, to arrange
permitting and bonding.' .
COMMENTS CONSTRUCTION PLANS
9. Is the street running north from Horseferry adjacent to the proposed building site a private street or drive?
Does it exist or will it be constructed with this project? The curbed islands will be considered curb cut~
requiring Board of Public Works and Safety approval if Horseferry Road is a public street. Extruded curb
will not be accepted.
10. More detailed grading, drainage and utility plans will be needed before comments for those items can be
provided.
11. Is the increase in impervious area accounted for in the master drainage plan?
12. Please show the complete proposed 15' SE. How will this be dedicated?
13. A lot of the keynotes in the Legend on C 1 0 1 do not apply or were not used.
14. Please add notes for saw cutting existing 6" chair back curb to form valley gutter on proposed southern
modification.
15. The note on Sheet CI 02 that reads "Street centerline grades represent top of cur~" is confusing.
16. Please label public and private streets and public and private drives.
17. If Horseferry is a public street, please show complete removal of the existing chair back curb and
replacement with a formed valley gutter.
18. Please provide additional spot shots around the building and where the walk abuts the proposed curb.
These comments represent the Department of Engineering's initial review of this project. Please provide our office
with a follow.;up letter and revised plans indicating all revisions. Second and subsequent reviews will focus only on
revised items. It is critical that this office be made aware of all modifications made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our initial review.

Dear Committee Members:
'I'd like to introduce myself. My name is Ray Thoman. My wife Betty & I live
at 13214 Towne Rd. Our property (10) acres is part of the 30 acres on the
northwest comer of TowneRd which is under consideration for rezoning.
We have lived in Clay Township for 45 years, and at our present address for
35 years. I can rf;!callwhen .Carmel was a crossroads with only one blinker
light at 131 st and Ra"ge Line Rd. At that time Towne Rd. was a gravel road
with very few houses. After a few years houses began to appear in our area.
We were a :bit concerned that our lifestyle would be affected, but did not
protest their right to build there.
There have been astounding changes to the city of Carmel and the
surrounding .area. Mainly because of committees like you with the foresight.
to plan ahead and assure the residents of Carmel and West Clay as we enter
into the 21st century, we will have an environment that is safe,
accommodating, and aesthetically pleasing to all.
I have seen many builders who have built homes in West Clay and for the
most part have done a good job. I have also watched Brenwick Corporation
develop the Village of West Clay and there is no doubt in my mind that any
commercial development that they might undertake in regards to the
northwest corner of 131 st and Town. Rd. would be an asset to the
community, and increase the value of the surrounding homes.
We realize there are those who have built lovely homes in our area but we
were concerned when they came in to "our territory". Without progress
where would we be?
My wife and I are 71.years young a..d have purchased another home (again in
Clay Township) because we like the lifestyle that has been developed in the
past by committees like you.

We, the following residents of Laurel Lakes Subdivision located on the "southwest corner
of 126th Street and Towne Road in Clay Township, city of Carmel sign this petition in
protest of the proposed rezoning changes being brought forth by Brenwick Development
for. The Village of West Clay. We oppose this rezoning based on the initial plans that
called for all high density type housing to be situated on the east side of Towne Road.
We also oppose the proposal considering developing commercial property at the
northwest corner of 131 st Street and" Towne Road. As with the original plan all
commercial development should reside on the east side of Towne Road. Both of these
plan changes being sought by Brenwick are inconsistent with the original plan and will
effect this area of Clay Township in a negativ~ way.
