The Board does not sign these commmitments so we need to have Kunkle aware of these issues before he picks them up. I apologize for throwing this at you at the 1.1t hour! We have a commitment from Mr. Kunkle which we approved. We gave it to the Law Department for review-,,and have since found out that this should have been part of the Plan Commission approval since it is for compliance with'the Thoroughfare Plan, and the Thoroughfare Plan is required by Zoning. So at-this point,for this particular project,,does this require an amendment to the Letter of Grant(that:has already been issued),,or should I just have Mr. Kunkle record it and we will add the number to the cross reference on the final plat? That's the million dollar question today! Going forward with these commitments,it sounds like all commitments should be made to the Plan Commission to demonstrate compliance with the Thoroughfare Plan,and thus Zoning Ordinance. This is obviously a change from how things have been done in the past. In addition, the Law Department will not be reviewing the language in these commitments. So-I am not sure if that:means John Molitor would review'the language "legally" speaking to ensure the City is protected? Or maybe that is not necessary? • Thank you for your help Angie. At the Plan Commission level,that wasn't really brought up that Mr. Kunkle had to make the commitments directly to the Plan Commission, as it was kind of assumed that he would make it to the Engineering Dept. or to the BPW... In other words, a draft of the commitments was never created for the Commission, the Dept., or John Molitor to review. The secondary plat document makes reference to a commitments,too. Now any review of nearly any subdivision in Carmel will show that there is not a sideyard easement between each lot, and most lots do not. However, a rear yard easement of 20-feet in width minimum is common. If we enforce the 20-foot easement along the sideline of 1/2 of Kunkle, we'll have to get waivers on the existing garage and driveway being within such easements, or perhaps we can figure out how we the other subdivisions have been approved without the same sideyard easements between interior lots. My memory says we've had a slight exchange concerning this item before and that's where I thought I came up with my most recent lot layout. Now, my latest documents show an easement along the back side of Lot#1 where it abuts Lot#2 for a 20-foot easement, but not along the sidelines. Unless current Carmel subdivisions were granted waivers/variances, I don't think it was intended/implied for side lot lines for lots within the same subdivision. I'm using Section 6 and 7 of Lakeside Park as an example, that the majority of lots have no sideyard easements, and the ones that do are mainly for storm sewer access. However, they almost all have rear yard easements for such utility purposes. Please advise. Was there a formal waiver for such design or an internal ability to approve? It would seem with both a driveway and existing garage subject to the 20-foot easement, that the intent of it being a rear yard easement between abutting lots may be easier to let slide then having to waive existing encroachments and/or non-conforming uses.
