WHERI ~S, SS is the owner of certain rea] estate located in Hamilton County, Indiana

which is incorpc ated herein by reference (the "Site Plan");
WHERI '-8, SS is the owner of another certain parcel of land adjacent to Parcel 4B

and Parce14A a d shall inure to the benefit of and be binding upon the Parcel 4B Owner and the
Parcel 4A Own{ . and all subsequent owners or other persons having an interest in all or any part

8. ~ odific~:ion. This Easement may be tenninated, modified, or amended only by a
writing executec by the i)WnerS ofParce14B and Parce1 4A.
9. ~ aintenance arid Repair. Parcel 4B Owner and its successors or assigns shall be
responsible for l 1 main1enance and repair of Parcel 4B and Parcel 4A Owner and its successors
or. assigns shall ~e resp()nsible for all maintenance and repair of Parce] 4A. In the. event that
Parcel 4B Ownt ' or Parcel 4A Owner fails to 1naintain or repair its respective Parcel, then the
Owner not respc lsible fbr such maintenance or repair shall have the rightt but not the obligation,
to perfonn any ~ Lch maintenance and repair obligations at the responsible Owner's sole cost and
expense, if the I :sponsil,le Owner fails to commence such maintenance and repair work within

Dear Mr. Bames:
We have reviewed the primary plans submitted to the Hamilton County Surveyor's Office on
October 4, 2004 for this project and have the fol1ow~ng comments:
1. This project falls within the jurisdiction of Hamilton County.
2. The proposed project DOES NOT fall in a Cannel Wellhead Protection Area.
3. Tl1e proposed project falls in the Park Northwestern Regulated Drain Watershed.
4. Since no apparent changes to impervious area or drainage are being proposed on
this project, the Hamilton County Swveyor's Office has no o~jection to the
proposed replat.

Re.marks: The enclosed "Replat of Lot #4 Park Northwestern" is being submitted to the City of Carmel
TAC review meeting to be held on October 20, 2004. This project consists of current Lot #4 being divided
into two lots as shown on the proposed Secondary plat as Lots 4A & 4B. A copy of the original ALTA
survey is 'also included for your information. The highlighted existing office building is being sold
separately creating the needed addi!ionallot description. All utilities, drives, & structures are in place
without any additional improvements to be made. . This project will not appear in front of the Carmel Plan
Commission. Please address any comments to the undersigned with cc to Mr. Jon Dobosiewizc at City of
Carmel Community Services.
