CONSENT TO ENCROACHMENT ~
This Consent to Encroachment ("Consent") is created as of the 25"" day of ~eri1r,
2004, by Park Northwestern ,Service Association, Inc., an Indiana non-profit corporation
(sllccessor to Northwest Development Corpora1ion, Northwest Associates, William H. Merrill,
Jr. and George P. Sweet) ("Declarant").
RECITALS:
WHEREAS, Declarant is the successor to, Northwest Development Corporation,
Northwest Associates, William H. Merrill, Jr. and George P. Sweet, as the administrator of Park
Northwestern Section One ("Development"), which Development i~ more particularly described
in Exhibit A, attached hereto and made a part hereof;
WHEREAS, Declarant 'reserved a minimum rear yard and side yard setback of fifteen
feet (15') ("Rear and Side Yard Setback") and a minimum front yard setback of sixty five feet
(65') ("Front Yard Setback") pursuant to that certain Declaration of Development Standards,
Covenants and Restrictions for Park Northwestern recorded in boqk 158 page 592 in the Office
of the Recorder of Hamilton County, Indiana, as amended and supplemented (collectively, the
"Declaration") ;
WHEREAS, Simply Storage Zionsville, LLC, an: Indiana limited liability company
("88"), is the owner' of Parcel 4 in t~ Development and SS desires to subdivide Parcel 4 into
two parcels, Parcel 4A and Parcel 4B, which Parcel 4A and Parcel 4B will not comply with the
Rear and' Side Yard Setback; -
WHEREAS, SS desires. to construct a kiosk upon Parcel 4B that will encroach upon the
FrantYard Setback; and
WHEREAS, Declarant desires to execute this Consent to allow SS to subdivide Parcel 4
and to construct the kiosk upon Parcel 4B.
NOW THEREFORE, in .consideration of the/ benefits to Declarant, Declarant hereby
declares as follows:

1. Consent to Encroach. Declarant hereby consents to the encroachment by SS over;
(a) that portion of the Rear and Side Yard Setback as may be encroachedupon by the buildings.
and, kiosk currently located on Lot 4B and Lot 4A as shown by Exhibit B,attached hereto and
. made a part hereof, and (b) that portion of the Front Yard Setback that may be encroached upon
by the kiosk currently located on Lot 4B as shown by Exhibit B.
2. Continued Effect of the Declaration. All provisions of the Declaration shall remain
in full force and effect. except as modified by this Consent.
