The new ordinance would allow it to be placed at or near the vehicular entrance. I was mistaken that it had to be placed at or near the pedestrian entrance to the building. So there is no need for a variance for it to be located near the road. The sign will however, need to represent all the tenants of both buildings. A positive change for you is that the new ordinance does not require that all tenants be equally represented. So the main tenants could have a larger portion of the directory sign than the smaller tenants. Another option would be to make the Dunkin Donuts and C -Store smaller, since they will have larger identification on the main complex identification sign. Regarding using part of the old sign ordinance and part of the new sign ordinance, the old sign ordinance would not have allowed a multi- tenant building complex directory sign because the site is not zoned B -4, B -7, B -8, M -3, or the US 31 overlay zone. The old sign ordinance would have also limited the changeable copy area to 2/3 of the sign area. The new sign ordinance does not limit this. So in conclusion, it is best to go by the new sign ordinance for all signs in this petition. At the meeting, we will amend our Dept. report to not have any conditions regarding the signage. If a traffic signal is ever warranted at this entrance, then the entrance will be restncte at t at point and a signal win -o-Me permitted. Could you please communicate this to your client? Regarding stormwater quality treatment, John Thomas is going to follow up with you. The plans do not specify two stormwater quality BMPs, but you alluded to two planned BMPs (with the pond not being one of them) in your response letter to our department. Here is a brief synopsis from looking through revised plans this morning: Regarding ther)unkin DonutsjI am going to send. them an email today stating that the 98th Street entrance may become a right- intright -out entrance in the future if a traffic signal is ever warranted. INDOT will not support a traffic signal at this entrance in the future. Hadley Grove — I know there are issues with right -of -way on 1.31" Street. The TP requires a 70 -foot half, and they only want to dedicate 50 feet. Their entrance is in excess of the allowable 45 feet. I also need to review the road configuration with Gary due to some of the curve radii. The drainage swales are shown in 20 -foot easements instead of the required 30- foot easement. Park Grenshire has submitted. to the BPW for several variances of stormwater standards. They will be on the first BPW meeting in January. The Bridges — We issued comments on November 30 and have not received a response. Attached is our continent letter. No curbs are shown around CVS. Maximum allowable commercial driveway width is 30 feet. They need a straight arrow for through traffic across Springmill to the LDS property. Is the north entrance on Illinois consistent with what was approved in the PUD? The plans rely on a stormwater detention facility that has not been approved or constructed. When we met with INDOT last week, we looked at access for the Pet Suites /Dunkin Donuts that is proposed on the west side of Michigan Road at 98th Street. The retail center has proposed two access points...a full access at 98th Street and a right -in /right -out at the southernmost property line. INDOT stated that in order to ensure the southernmost entrances is used as a right -in /right -out, they will require median across the frontage; this median is indicated in green. There is an existing median that extends from 96th Street to just north of 97th Street. The existing median is indicated in red. We have stated in the past to all that have looked, 98th and Michigan will likely be limited to right -in /right -out when /if a traffic signal is warranted. With all this considered, INDOT desires to extend the median between the existing and proposed median for the retail development. This is an additional 400 -feet of median and is indicated in blue. This median will likely draw remonstrance from the hotel and Bartlett Trees. INDOT has asked if there would be support (engineering, planning and politically) to the request for a continuous median in this area. They have asked for something in writing. I have attached a revised site layout that illustrates the changes that have been made to the site. This is an earlier version of what Eric sent with the dimensioning turned off. As you can see the site plan has been revised so that both buildings meet the 120' setback. We need to meet with Rachel Boone so we get the revisions to the sign in compliance regarding the logo and overall square footage. With these items addressed variances would be required for (I) building offset reduction, (ii) second sign, and (iii) drive - thru stacking on the side of the building. The revisions eliminate the need for variances regarding (i) maximum 120' setback, (ii) maximum sign area, and (iii) logo percentage. A two multi- tenant buildings with a fuel canopy is proposed on the west side of Michigan Road on land zoned I- 1 /Industrial. They will be seeking a number of variances from the BZA: a. Drive -thru lanes on the side of the building rather than behind. b. Reduced facade offsets on two sides of the building. c. An additional sign, which also puts them over the permitted sq. ft for signs. d. Increasing the size of the logo on the sign from the permitted 25% of the sign to 32% . e. Setting the building more than the 120' feet from the road that the Overlay Zone requires a variance As one of the original writers of the Michigan Road Overlay Zone, we wanted the rules in place to make the requirements easy for the developers to follow. I am a little surprised that this developer wants to change rules this late into the development of the overlay zone. The land is generally flat and rectangular. It does not have a stream on it or unusual characteristics. The Starbucks, Wendy's, Burger King, and Walgreens have their drive thur's in the rear of their buildings. The buildings are screens to this. The drive -thru needs to remain the back. We need to continue with our facade requirement like the rest of the new buildings. We need to maintain our sign conditions as to colors, style, height, numbers, and size. The sign logo should remain at 25% like the rest of the overlay zone. Can you rotate the commercial retail building 90- degrees and slide it closer to Michigan Rd, to be sited closer to the north property line? Reply: The site plan works best from a logistical and functionality standpoint as it is laid out currently. The traffic circulation through and around the site is ideal as it is now. Rotating the commercial building 90- degrees and moving it closer to Michigan Road could impede access into the site from the northern curb cut. The location of the northern curb cut is being dictated by INDOT to line up with 98th Street on the East side of Michigan Road. Also, rotating and moving the commercial building would cause the back of the building to be visible from Michigan Road which is not desirable. In addition, tenants ideally will need to face Michigan Road directly for the best visibility. Daren Mindham with the City Forestry Dept, will review the Tree Preservation Plan and Landscape Plan. Reply: We received two minor comments from the Urban Forester and have addressed those with this revision. BZA variance will be required for the drive thru stacking location, per ZO Chapter 23C.11.G. Signage review & additional review comments: Dunkin Donuts /BP and commercial retail buildings: a) We don't think the EIFS is placed in the best possible location. Please use the Engineering Department deadlines for submissions to the Board. • Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and /or the Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee. All written requests to be placed on the Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by the Plan Commission and /or the Board of Zoning Appeals (if applicable). • Water Availability and Sanitary Sewer approval from the Board will be required. This is an EDU approval based upon the proposed use of the site. Reference Items #33 to #35 below for additional details /explanations. Please note that if an entryway or other irrigation system is planned for this development, additional Water Availability Approval from the Board will be required and additional Water Connection Fees will be assessed based upon the size and usage of the system as determined by the Director of Carmel Utilities. • Commercial Curb Cut Approval. Please provide 81/2 x 11 exhibits with the request for approval. Provide all pertinent information including lane widths, overall width, radii, lane markings, location of opposing drives or streets, relationship to the location of previous curb cut, etc. • Temporary Construction Entrance Approval. If the construction entrance is to be located separate from a permanent curb cut, then Board of Public Works approval is required if it will be located within City right -of -way. • The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Cannel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. • Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. • Dedication of right -of -way if not platted. This is based upon the City of Carmel 20 -Year Thoroughfare Plan requirements. Dedication documents are available upon request. Please be advised that all Right -of -Way Dedications must be accompanied by a Sales Disclosure Agreement completed by the owner for the property being dedicated to the City. The dedication document cannot be recorded without a completed Sales Disclosure. The form is available upon request. • Any open pavement cuts of City right -of -way will require Carmel Board of Public Works and Safety approval. BONDING REOU1REMENTS • Please contact Mr. Dave Barnes to review performance guarantee requirements. Please contact Mr. John Duffy to review water and sanitary sewer bonding requirements. • The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes, and materials, etc. • Upon completion and release of individual Performance Guarantees, a three -year Maintenance Guarantee will be required (see Street Sign comments above). A cross access easement has been added to the Detailed Development Plans. Please see revised sheet C2.0. 21. The site has been adjusted to provide the full 36' greenbelt adjacent to the parking along Michigan Road. Please see the revised Detailed Development Plans. 30. A &F Engineering has been commissioned to perform a full traffic impact study (TIS). Based on meetings and correspondence with INDOT, they have dictated the scope and requirements for the TIS. The traffic counts have been completed and once the conclusions and report are compiled, they will be submitted to INDOT for approval. 31. We have had multiple meetings with INDOT regarding the proposed driveways for the project. INDOT has given us the scope and requirements for a full traffic study (TIS) which is currently underway. INDOT will not issue a final approval for the driveways until they have had a chance to analyze the completed TIS. However, based on the preliminary correspondence, INDOT would be willing to approve the two driveways as long as they are supported by data from the TIS and will cause a minimal impact to traffic patterns in the area. 32. Bicycle parking areas were labeled on the previously submitted plans. A detail of the proposed bicycle rack has been added to revised sheet C2.0. 33. We have verified with the site lighting vender, TechLite, that all proposed fixtures on -site are indeed flat lenses with 90- degree cutoffs. It will be screened by a wall with gates. Please see the revised Detailed Development Plans. 37. The site plan works best from a logistical and functionality standpoint as it is laid out currently. The traffic circulation through and around the site is ideal as it is now. Rotating the commercial building 90- degrees and moving it closer to Michigan Road could impede access into the site from the northern curb cut. The location of the northern curb cut is being dictated by INDOT to line up with 98th Street on the East side of Michigan Road. Also, rotating and moving the commercial building would cause the back of the building to be visible from Michigan Road which is not desirable. In addition, tenants ideally will need to face Michigan Road directly for the best visibility. 38. We received two minor comments from the Urban Forester and have addressed those with this revision. BZA variance is required for the parking spaces located along the front of the site, where it is not setback 36 -ft to accommodate the 30 -ft wide greenbelt, plus the 6 -ft wide parking perimeter buffer, per ZO Chapter 23C.10.03.5.a. Also, per ZO chapter 23C.11.F: Parking within front yard setbacks shall be discouraged and limited to a maximum of two (2) rows of parking, subject to minimum Greenbelt width, minimum bufferyard requirements and maximum building setback standards. 22. Is there not more detailing or a changeup of materials that can be done to break up the upper EIFS portion of the building? 23. Maybe remove the awnings from the windows, or at least place them lower than they are shown. Right now, it looks awkward. 24. The grids in the windows and the door entries: please make them the same pattern or proportionate. 25. Please paint the backs of the taller parapets a brick color. 26. Please provide more detail on the metal canopies. Also, can you make them deeper, to provide more of an overhang? 27. Please submit to -scale floor plans or typical store layouts for the Dunkin Donuts and C- store. 28. Please label the mechanical equipment locations (rooftop or ground level) on the site plan and building elevations and provide details on how they are screened from view or camouflaged. This includes electric and gas meters; see ZO Chapter 23C.10.02.5.. 29. Please consider using additional LEED or 'green' site and building practices, such as a white membrane roof, solar panels, native plants, rain gardens, etc. List is attached. 30. Please verify with the City Engineering Dept. that no type of traffic analysis is required. 31. Please provide correspondence from INDOT about the 2 curb cuts and their approvals of that. 32. Please show /label the bicycle parking areas and provide the bike rack details, per ZO Chapter 27.06 of the ordinance. 33. Please verify that all parking lot pole light fixtures have flat lenses and /or 90- degree cutoffs so that the light is downcast. 34. Please provide the wall sconce design details/ cut sheets. 35. Per ZO Chapter 23C.12.B, please amend the parking lot pole lights to be a maximum height of 24 feet. 36. Would like a commitment to have no or very little outdoor sales and displays associated with the gas station /convenience store to limit the propane gas exchanges, mulch stacks, washer fluid displays, etc. per ZO Chapter 23C.14.01, storage areas must be completely screened from view. 37. The Dept. would like the plan modified to shift one or both of the buildings closer to Michigan Rd. Can you rotate the commercial retail building 90- degrees and slide it closer to Michigan Rd, to be sited closer to the north property line? 38. Daren Mindham with the City Forestry Dept, will review the Tree Preservation Plan and Landscape Plan. 39. BZA variance will be required for the drive thru stacking location, per ZO Chapter 23C.11.G. 40. Signage review & additional review comments: Dunkin Donuts /BP and commercial retail buildings: 2 a) We don't think the EIFS is placed in the best possible location. It should be utilized above the entry doors to aid in installation and visibility of the signage. Right now, the signage blends into the building and does not stand out against the brick. b) Where the EIFS is located, it would be best to continue the brick all the way up the facade to the cornice element, or even use a different color brick to make it stand out from the feature entrances /protrusions of the tenants' areas. c) On the commercial retail building, l don't think using the CMU block all the way up the entry feature is an appropriate material. This should be kept at the base. Then perhaps a different color brick could be used to call attention to that particular part of the building, to that tenant's entry feature. d) We would also like to see some more architectural elements built into the sign band area of each building. It would be good to see some brick detailing around the EIFS, to call out a specific sign band area or placement for the sign - to frame each sign, in a way. e) For the both buildings, the recessed brick detail is very distracting. Perhaps this feature would be better on the other facade elevations where the EIFS top half is proposed, but not the main ones. f) Would also like to see more detailing to define the two spaces (Dunkin and BP). Perhaps some edge molding at the corners of the building and a matching one in- between the spaces would help add some detail and separation. g) If EIFS is required above the entry doors to the tenant spaces, perhaps have less scoring on them to make it stand out less and /or paint it to match the surrounding materials so it does not stand out as much. Right now the buildings look very busy with so many different elevations and materials. h) Staff would like to see the same window awning colors for all sides of the Dunkin Donuts /BP building. Dunkin Donuts /BP building Signage: a) Each tenant is allowed 40 square feet per sign chart B. b) We will consider the main signage /ROW to be facing north, so there is consistency between the signage for the two tenants. c) Dunkin Donuts signage and awning detail facing south will need BZA variance approval. We will not support these variances for additional signage and signage not facing a right -of -way. d) Dunkin Donuts signage facing east will also require a BZA variance for number of signs and going over the total square footage allowed. These variances might be supported by Staff. e) Dunkin Donuts signage facing all directions will be subject to the 25% logo rule for their coffee cup logo. Please submit additional size information for the logos. f) BP will require a BZA variance for a 100% logo sign. g) Need to see more detail on the drive thru menu board, menu canopy, etc. The size is limited to 6 feet tall and 16 square feet in size. Staff would like a masonry base on this sign. Commercial retail building: a) Please submit information on the signage requirements for tenants, including but not limited to: i. Size ii. Color iii. Lighting style iv. Installation method v. Signage on awnings permitted? b) If they would prefer it just meet the Sign Ordinance requirements, that is okay, too, but we just need to know. Gas Station island & canopy areas: a) Signage is not allowed on the roof of the gas station canopy. This will require a BZA variance that the Dept. will not support. b) The design of the canopy as all EIFS material is not preferred. Perhaps the color needs to change? Or have less breaks or scoring in the material? It looks very choppy. We have seen more ornate and detailed canopies recently and this one needs a bit more substance. c) The gas canopy seem a little top- heavy. Is there a way to widen the columns or to reduce the thickness of the canopy, to remedy this? 3 d) Need to see signage details for the gas station bumps and pump markers. All signage for pumps and markers needs to be 3 square feet or less to be considered exempt. Otherwise, BZA variances will be required. Ground signs: a) The height for the Dunkin Donuts /BP ground sign is ok. We need more detail on the size, though. b) The ground sign which is for the tenant panels is limited to 20 sq. ft. and 5 -ft tall. Please provide more detail on the size. c) The tenant signage sign with four panels will also require the name of the shopping center development to be at the top of the sign. d) if possible, Staff would like to see a more pronounced base for each sign, to balance out the top cornice of the sign. On each building, please provide the percent of EIFS of all non - window facade areas, per ZO Chapter 23C.09.K.2. (It must be less than or equal to 10 %, otherwise a BZA variance will be required.) 13. Please lower the parapet to reduce the total percent of EIFS OR use more brick between the heights of 4 -ft and 14 -ft, possibly, for a 10 -ft wide band of brick at least. The ratios look 'off. 14. Both the C -Store south elevation and Commercial retail building west elevation have long and monotonous walls, which are not permitted by ZO Chapter 23C.09.B. 15. What is the bollards color? Gas canopy location might need BZA variance approval. See ZO Chapter 25.01.02 and ZO Chapter 25.19.c - Setbacks of accessory buildings & uses. 17. Is there not more detailing or a changeup of materials that can be done to break up the upper EIFS portion of the building? 23. Maybe remove the awnings from the windows, or at least place them lower than they are shown. Right now, it looks awkward. 24. Please provide more detail on the metal canopies. Also, can you make them deeper, to provide more of an overhang? 27. Please label the mechanical equipment locations (rooftop or ground level) on the site plan and building elevations and provide details on how they are screened from view or camouflaged. It should be utilized above the entry doors to aid in installation and visibility of the signage. This should be kept at the base. Then perhaps a different color brick could be used to call attention to that particular part of the building, to that tenant's entry feature. d) We would also like to see some more architectural elements built into the sign band area of each building. It would be good to see some brick detailing around the EIFS, to call out a specific sign band area or placement for the sign - to frame each sign, in a way. e) For the both buildings, the recessed brick detail is very distracting. Perhaps this feature would be better on the other facade elevations where the EIFS top half is proposed, but not the main ones. f) Would also like to see more detailing to define the two spaces (Dunkin and BP). Perhaps some edge molding at the corners of the building and a matching one in- between the spaces would help add some detail and separation. g) If EIFS is required above the entry doors to the tenant spaces, perhaps have less scoring on them to make it stand out less and /or paint it to match the surrounding materials so it does not stand out as much. The new building is much closer to Michigan Road and the rear half of the site will be used for tree preservation and detention as needed. There is significantly more greenspace on this revised plan (over 55 %) due to the difficult soils located on the rear half of the subject parcel. On each building, please provide the percent of EIFS of all non- window facade areas, per ZO Chapter 23C.09.K.2. (It must be less than or equal to 10 %.) 26. Multitenant Building : Please lower the parapet to reduce the total percent of EIFS or use more brick, higher than 14 -ft. The ratios look 'off'. Is there not more detailing or a changeup of materials that can be done to break up the upper EFIS portion of the building? 27. Please submit to -scale floor plans or typical store layouts for the Dunkin Donuts and C- store. 28. One the black /white gas canopy elevations, please label the material on the gas canopy columns that is above the face brick utility size (near the height where the pump number flags will be erected). 29. The gas canopy seem a little top- heavy. Is there a way to widen the columns or to reduce the thickness of the canopy, to remedy this? 30. Please show the drive thru stacking area as being able to accommodate 10 vehicles, per ZO Chapter 23C.11.G. 50. Signage review & other miscellaneous comments: A. Ground sign: 1. Would it be possible to move the sign location away from the entrance? It would be nice to have a bit more visual separation between the two signs for the site. 2. The Dunkin Donuts sign: it would be nice if it could be evenly placed within the space available. Right now it looks bottom heavy. Perhaps a smaller logo would allow this to appear centered. 3. What type of gas price numbers are proposed? If electronic, a BZA variance will be required. 4. If a gas station is not the second tenant in this building, how will the sign be divided up amongst tenants? Could the directory sign be eliminated if there were no gas station tenant? 5. Recently, it has become common practice to use an opaque background on cabinet sign panels. This is to help make the sign appear like it has individual letters. The Department would prefer to see that technique used here as well. 6. (The sign size is 39.72 sq. ft., which is within the 45 allowable square feet. Also, the height at 6 -ft is correct for the US 421 overlay zone.) B. Directory sign: 1. Again, the Department would prefer to see that the background of this sign is opaque, so that it appears more like individual letters, rather than a cabinet sign. 2. (The size is 19.44 sq. ft., which is within the allowable 20 sq. ft. for a directory sign. Also, the height is at 5', which is correct for a directory sign. ) C. Directional signs: 1. Please show /label where these signs would be placed on the site plan. 2. (The height is correct at 2'6" — less than 3' tall. ) 3. Please provide dimensions of the actual sign itself, so we can be sure it is 3 sq. ft. or less. D. Gas pumps /canopy: 1. Please provide details on all signage that will be placed on the gas station pumps, canopy, canopy columns, and pump number flags. 2. Please keep in mind that all proposed signage should be 3 sq. ft. or less, so that it can be considered exempt, and therefore allowed. 3. Please know that no additional advertising signs are allowed on the pump or on the canopy. Any advertising would need to be accomplished through window signage on the building, which cannot exceed 30% of the tenant's window area. E. Outlot building: 1. The Department would prefer that both tenant wall signs face the same direction. The Dunkin Donuts sign seems odd not placed over the front door. Perhaps it would be best to seek a variance to add another sign (to face north) or perhaps a logo on the east elevation wall. This could be done for both Dunkin Donuts and the gas station tenant. (This has been done at another location: the NE corner of Keystone and 116`" St. and has worked out well in helping them with identification.) 3 2. Please make the awning colors consistent. Why change the awning colors for the building? The Department would prefer that they maintain the same color throughout the building. ZO Chapter 23C.09.I discusses consistent store fronts. 3. I like the design. It looks very classic and clean. 2. Would it be possible to move the sign location away from the entrance? It would be nice to have a bit more visual separation between the two signs for the site. 3. The Dunkin Donuts sign — it would be nice if it could be evenly placed within the space available. Right now it looks bottom heavy. Perhaps a smaller logo would allow this to appear centered. 4. What type of gas price numbers are proposed? If electronic, a variance will be required. 5. If a gas station is not the second tenant in this building, how will the sign be divided up amongst tenants? Could the directory sign be eliminated if there were no gas station tenant? 6. Recently it has been common practice to use an opaque background on cabinet sign panels. This is to help make the sign appear like it has individual letters. The Department would prefer to see that technique used here as well. 7. The size is 39.72 sq. ft., which is within the 45 allowable square feet 8. The height at 6' is correct for the US 421 overlay zone Directory sign: 1. Again, the design is nice. Thank you for keeping it similar to the main ground sign. 2. Again, the Department would prefer to see that the background of this sign is opaque, so that it appears more like individual letters, rather than a cabinet sign. 3. The size is 19.44 sq. ft., which is within the allowable 20 sq. ft. for a directory sign. 4. The height is at 5', which is correct for a directory sign. Directional signs: 1. Please show where these signs would be placed on the site. 2. The height is correct at 2'6" — less than 3' tall. 3. Please provide dimensions of the actual sign itself, so I can be sure it is 3 sq. ft. or less. Gas pumps /canopy: 1. Please provide all signage that will be placed on the gas station pumps, canopy and pump number flags. 2. Please keep in mind that all proposed signage should be 3 sq. ft. or less, so that it can be considered exempt, and therefore allowed. 3. Please know that no additional advertising signs are allowed on the pump or on the canopy. Any advertising would need to be accomplished through window signage on the building, which cannot exceed 30% of the tenant's window area. Outlot building: 1. The Department would prefer that both tenant signs face the same direction. The Dunkin Donuts sign seems odd not placed over the front door. Perhaps it would be best to seek a variance to add another sign or perhaps a logo on the east elevation wall. This could be done for both Dunkin Donuts and the gas station tenant. Think the building design overall is nice, but would like to see less roofing material. Did they explain the reason for the steep slope? 2. Should the entire building not be brick?
