As mentioned before, we are going to go ahead and install the depressions in the curb as if we are installing the path on the west side of Community Drive instead ofthe east as currently designed. We really think this is the best solution and this does notmake any changes to any other infrastructure and will not change any grading on Community Drive. We will not install any path or sidewalk until this is resolved. If for some reason, you, decide it should be left on the east side, we will make the appropriate changes to the curb at that time. Section 14. Lighting. Section 14..1. Commercial Lighting. All site lighting within the Primary Office Use Block, Village Core Use Block, and the Corner Use Block shall comply with the standards of the Carmel Drive - Range Line Road Overlay Zone (Article 23F.12 of the Zoning Ordinance). All fixtures shall be downcast fixtures /90> degree cutoff. Section 14.2. Street lights shall be as depicted on Exhibit 15, and consistent throughout the Real Estate. Section 14.3. Street lights along all collector streets and within the Primary Office Use Block, Village: Core Use Block, and Corner Use Block,; shall be provided at regular intervals. Street lighting on residential streets shall be confined to the intersections and corners. Section 14.4. Lighting for permitted activities shall be permitted within the Open Space Area. Section 14.5. Lighting in the Village Core Use Block, the Primary Office Use Block, the Corner Use Block, and parking lots shall be designed and maintained so that it is reduced to the minimum amount reasonably required for security purposes during the hours that retail establishments are not open for business. Section 15. Signs. Section 15.1. Residential Signs. Unless variances are granted by the BZA, signage for all residential areas shall meet the requirements of Article 25.7 of the Zoning Ordinance. Typical residential signs depicted on Exhibit 16, (Typical Residential Area Signage). Illumination of any such signage shall be from a source external to such signage. Section 15.2. 'Commercial Signs. Unless variances are granted by the BZA, all signage on Commercial Buildings shall meet the requirements of Section 25.7 of the Zoning Ordinance. 'In addition, unless variances are granted by the BZA, signage for all 23 open space and paths or sidewalks located therein may be included in the required area computations. Those. comments were addressed as follows: CONSTRUCTION PLAN COMMENTS: I. The construction. limits line type has been added to the legend on all applicable sheets. PLAT 2. Right of way dedication at .Community. Drive and River Road will be Handled with a Right of Way Grant exhibit that will cover the extents of the acel /decel lanes proposed with-Master Infrastructure Phase II: That yvill be completed upon completion of the improvements and a recorded copy will be provided to your office: Right of way dedication at future Cherry Creek Boulevard and River road will be completed in the same manner when construction of that entrance is completed. We have now denoted the correct easement denotation on the plat as well. 4. We have added a variable D.U_&S.E. at the southeast portion of Lot #1 for the storm sewer that runs between Str.'s 305 & 361. 5 The storm sewer along the south side of Lot #1 is 10' South of the property line. Therefore, we have added a 5' Drainage :and Sewer Easement along the South property line of Lot #1:. We have denoted the 15' dimension from the easement to the storm sewer on -sheet C200. 6. The roadways, as proposed, whether they are public.or private, do (NOT) meet any City standard or PUD`standard. We could probably have lengthy discussions with Jon about this fact and subsequently what standards apply and what do not Our recommendation has been to make these public streets and make them conform to the Frontage Place standards. I believe that this is the direction they are heading.. We met'with Platinum and took a long look at access points and the areas where the frontage places do not connect back into perimeter roadways. The roundabouts restrict the ability to have the perfect 600 -foot access spacing and we agreed to allow a variance to this There are two instances I believe where they will not satisfy this requirement; but they agreed to add additional access points to try to come close to conforming to this standard. I think they are adding „two additional access points beyond what might be shown currently. I think this is a case of other conditions dictating the design of facilities that do not conform to the standard. The terminal ends that do not connect back into the perimeter roadways are the biggest compromise. With the current layout, we do not want these roadways to connect back into the perimeter roadways so close to the major intersections. As such they have limited options: The plan the last time that we talked was to turn the proposed hammerheads into cul -de -sacs so it would be easier for larger vehicles to turn around. Due to schedule conflicts I will not be able to attend the hearing, however I would like to voice my opinion and concerns regarding the proposed primary plat. I am in favor of the development of this property with one caveat... the promises made to the surrounding homeowners when the PUD was first approved be honored. Prior to this property being rezoned to the current PUD many of us met with the developers at multiple open meetings (held at Prairie Trace School) to share our concerns regarding this higher density-project (higher density than the original zoning, even more so when you consider a large part of the green area for the development is located across River Road, away from the housing sections). One of the issues that was raised at the time was the density of the housing boarding the Settlers Ridge section of the Haverstick development. At that time the developer agreed that all of the lots boarding Settlers Ridge would be the larger home sites for the development. I have attached the map file The Legacy provided which shows the lots boarding Settlers Ridge, as you can see these are equal in size to the largest lots planned for the development. Additionally at the time of the public meetings the original Legacy plan called for a pond to boarder Settlers Ridge (backing up to our pond to separate the two communities). At some point this was changed to the plan that l have attached. The plan displayed a large pond, the pond that was built appears to be a smaller pond (and if you look at Google maps, one that is not very attractive and holds very little water). Now the developer is requesting that smaller lots be platted next to Settlers Ridge.. Originally the portion of the development (next to Settlers Ridge) affected by this request was to hold 32 homes. The new design appears to cover about two and a half times the original area but will hold four and a half times as many homes, almost double the original planned density for this area 1 understand economic conditions are much different today than when the PUD was put in place, at the same time prior to this being approved I would expect the developers would have met with the surrounding neighbors to allow them to discuss this complete reversal of the original plan, and to provide a drawing of the proposed lot plat. We were told that the homes boarding Settlers Ridge would be priced at a much higher level than the homes in our neighborhood therefore helping our property values. It is generally not a tree chosen for high quality landscape designs. It would have been on the not recommended list but it is so rarely planted it is not listed. 4) On sheet SP2 of the Legacy Stormwater Master Infrastructure Drawings, please replace all of the red maples with bald Cypress and Swamp white oak. Red maples are on our not recommended list for many reasons, one being that they are over 20% of the population of trees in the City. A "conditional" storm water permit will be issued only to allow work on the items listed below. All items must be completed in a manner acceptable to the City and must be completed to the City's satisfaction. 1) Removal of the retaining block walls, which shall be disposed of off site. 1. Plans for the replacement walls shall be submitted to our department for review and approval. 2. The replacement walls shall be constructed under supervision deemed necessary by our department. 3. Details for connections of storm pipe runs through any walls shall be submitted for review and approval. 2) Clean -up all existing waste materials on site, including/ but not limited to pallets, concrete block, and cement /mortar mix. 1. The remediation of any areas where mortar mixtures have been exposed to the elements must be completed to the City's satisfaction. Soil excavation of these areas, proper disposal of the soil, and soil testing will be necessary at a minimum. 3) Re- condition lakes 1 thru 5 to original plans & specs. 1. All rip -rap used as temporary stabilization of rills and gullies shall be removed in their entirety. 2. Clean fill and proper compaction that will restore the soil structure shall be used to backfill all existing gullies and rills. 3. Rilled and gullied areas shall be stripped of topsoil, clean fill placed, and reworked to remediate compromised soil structures. 4. New topsoil, seed (per plan), and erosion control blanket must be placed on all reworked areas above normal pool. 5. Erosion control blanket must be placed within one week of establishing final grade. 6. All ponds shall be excavated to their design depth. 7. New clay liners shall be placed in all ponds. 8. For the full depth of the new liners, new, clean clay must be used. 9. By the use of wells or other means (well approvals and inspections adhere to the Water Utility's requirements), all ponds shall be filled, in a manner that doesn't cause erosion of the liners, to their normal pool within one week of final grade. 10. Silt fence shall be placed around all ponds when they reach final grade to protect them during stabilization. 4) Re- inspection of all infrastructure materials, currently stored on site, such as precast concrete structures, prior to placement. 1. Engineering department inspectors must be notified prior to placement of all on site materials so that they may be inspected for integrity. 2. Any compromised materials must be replaced with new materials acceptable to the inspector. 5) Repairs of existing infrastructure. 1. Settling is present around most storm structures and inlets. These must be re- inspected prior to any repairs and then repaired per the inspectors requirements. Including but not limited to structures 234, 235, 182, 183. 1 4 2. Outlet grates are missing from outlet structures and must be installed per plan. Including but not limited to structures 185 and 132. 3. Pipe backfill that has been exposed by gullies causing it to erode, must be restored per the inspector's requirements. Including but not limited to the pipe between structures 190 and 189. 4. All end section and scour protection must be repaired per plan and cleaned of any material. Including but not limited to structure 233, 179, and 189. 6) All SWPPP requirements needed to complete the items above must be in place and functional during operations, beginning with the repair of the existing construction entrance. Platinum Comments 1. Plans are approved. Need feedback from Carmel regarding bonding, NOI and stormwater permit requirements related to the change of ownership. 2. Need feedback from Surveyors Office regarding which structures are actually considered as part of the legal drain reconstruction. They have as- builts and have completed inspections of all structures from Haverstick up to Lake #2, but Luther thought there may be a few other structures up stream of lake 2 that should be included as well. Carmel's Response: A. Due to the change in ownership, a new storm water permit application will need to be submitted for the project. B. We are compiling a list of items for Residential Phase 1, Section 1 that will need to be completed prior to any additional work being permitted. This list will include (1) existing improvements that are now substandard due to the timeframe that they have remained uncompleted and (2) any deficiencies noted while this section was under construction. Any existing roadbed proofroll tests will be considered invalid. We anticipate sending it to you soon. When this list is developed, we will need a plan of action and a firm timeline for remedying these issues. C. Before the permit can be issued; i. We will need to verify that all bonds are in good standing. ii. We will need a commitment to repair all items noted by our Department, or any other City Department, to our satisfaction, prior to any other work. D. A pre- construction meeting will need to be held prior to any construction activities including the repair activities. E. Once all repairs have been made and approved by the City, the project may commence per the approved plan. F. Outstanding issues with the retaining wall need to be resolved. Legacy Master Infrastructure Phase 2 (excluding Cherry Creek Boulevard: from existing RAB to River Road). Platinum Comments 1. The entirety of Legacy Master Infrastructure Phase 2 construction plans were previously approved. Bonds, NO1 and necessary permits were previously submitted to construct Project 1 as listed in the plans which included Community Drive, a portion of Cherry Creek Blvd west of the existing RAB, construction of the entirety of the stormwater basin east of Community Drive and placement of soil throughout the site as described on the SWPPP for the excess soil to be excavated from the stormwater basin. Construction at this time will include the completion of the earthwork necessary to complete the stormwater basin and the Community Drive portion of Project 1, but not the Cherry Creek Blvd portion. 2. Need feedback from Carmel regarding bonding, NOI and stormwater permit requirements related to the change of ownership. 3. As part of the construction of Community Drive, we are requesting approval to include the revised stormwater basin plan titled "Southeast Residential Stormwater Basin, Legacy - Stormwater Master Infrastructure" as prepared by Williams Creek Consulting as an addendum to the currently approved Master Infrastructure Phase 2 Plans. a. Need feedback from Carmel to recommence construction and include the revised stormwater basin plan and are requesting approval to be provided in two steps: i. First, after the bonding, NOI and stormwater permit requirements related to the change of ownership are addressed, approval would be granted to commence construction under the current approved plans. However, excavation of the stormwater basin would be restricted to stay above an elevation of 745. ii. Second, after comments of all agencies regarding the revised stormwater basin plan have been addressed, approval would be granted for the final construction of the stormwater basin below the 745 elevation. b. Need feedback from The Surveyors Office regarding any petition or permit changes that may be necessary related to the change of ownership. We also will provide a spreadsheet analysis of the original cross section locations to describe how the new plan affects the fill in the floodplain variance including revised stormwater detention calculations. Carmel's Response A. A new set of plans specifically, outlining what will be constructed with this project will need to be submitted in lieu of an addendum to the approved set. The current set of plans is outdated and contains items which will not be constructed at this time. B. The plans must include not only the earthwork necessary to complete the stormwater basin but the installation of stormwater quality features as well. C. Construction of the roadways indicated will be the only work in the eastern watershed allowed to be constructed simultaneously with the Stormwater Park. We will not allow the roadway to be constructed prior to the Stormwater Park being constructed. D. New bonds will be required for this project due to the change in scope of work and plans. E. Due to the change in ownership, a new storm water permit application will need to be submitted for the project. F. We will not support the proposed plan to work this area above a certain elevation and then come back in the future to complete the improvement. G. We are compiling a list of items for this section that will need to be completed prior to any additional work being permitted. I am not certain how much of this construction actually occurred. This list will include (1) existing improvements that are now substandard due to the timeframe that they have remained uncompleted and (2) any deficiencies noted while this section was under construction. When this list is developed, we will need a plan of action and a firm timeline for remedying these issues. Legacy Master Drainage and Water Quality Plan. Platinum Comments • A. We are requesting review and final approval of the overall Master Drainage and Water Quality plan for the Legacy as presented at the meeting yesterday which was last revised in 2010. We acknowledge that some of the areas described in the 2010 plan have changed. However, the initial intent of the Master Plan was to provide an overall baseline for handling stormwater retention and water quality across the entirety of the Legacy. Then as individual developments are added in, the responsibility to show how those individual developments fall within the guidelines of the master plan falls on construction documents for those individual developments. To follow that model, we will provide supplemental drainage and water quality calculations to show how the new developments we are submitting above (the Overlook and Meadows) fall within the guidelines of the 2010 version of the master plan. B. Need feedback from Carmel regarding what they will need to re- commence the review process and if the current revised 2010 presentation is acceptable. If the 2010 version is not acceptable, are there certain overarching items that we can add without actually starting over with an entirely new master plan? C. It is understood that this will take some time to address. It would be our intent to have this track with the overall approvals of the Meadows and Overlook which based on the preliminary plat schedule for plan commission meetings would not be complete until June 19, 2012. Carmel's Response 1. We need a formal submittal of the Final Master Drainage and Water Quality Plan. This needs to be a complete plan that will not be subject to further changes. The plans for Legacy Infrastructure Phase 2, which must include construction of the stormwater park will be checked for conformance to this plan. 2. Please be advised - With the exception of the modified Legacy Master Infrastructure Phase 2 project, all projects that drain to the Stormwater Park (the eastern watershed) will not be reviewed until the Master Plan has been approved in our office. Subsequently, all future projects in the eastern watershed will not be approved until the Stormwater Park has been fully constructed. The Overlook and The Meadows Platinum Comments A. We will be submitting a preliminary plat approval request for two new residential sections to be known as (1) "The Overlook at Legacy" that will front Community Drive and Cherry Creek Boulevard in the southeast quadrant of Legacy, and (2) "The Meadows at Legacy" that will replace the previously submitted retirement community by Baptist Homes of Indiana known as Prairie Landing (see attached). B. We also will be submitting secondary plat and construction plan approval requests for the first section of each of these subdivisions. We plan to go through the typical approval process and intend to file on March 16, 2012. Carmel's Response 1. These sections rely on master planned detention and storm water treatment facilities that have not yet been approved or constructed. All previous approved sections were allowed to move forward with the understanding that construction of the storm water park would follow. We allowed initial development to proceed with the knowledge that the runoff from the approved areas would not leave the site or would need to travel across long distances before doing so. We are no longer able to support our previous position due to the fact that the master planned facilities have not yet been installed. 2. The storm water permit for The Meadows and The Overlook will not be issued until the Storm Water Park AND Modified Master Infrastructure Phase 2 have been constructed to the City's satisfaction. 3. Once the Stormwater Park and Modified Legacy Master Infrastructure Phase 2 have been approved and constructed; the Engineering Department can focus on the approval of The Overlook and The Meadows. General Items Lift Station 1. Broken and cracked concrete at the entry to lift station needs to hauled away and new concrete placed. 2. If this facility has not yet been transferred to the City: a. Trash and debris needs to be cleaned at, around, and on the road leading to the City's lift station. b. The existing road to the lift station needs to be graded and re- stoned to the original condition 4 Community Drive 1. Clean, adjust, and place new erosion control mats along the roadway. 2. Clean streets, pavers, and all stub streets of trash and debris. 3. Re -place broken and cracked curbs and walks as marked. 4. Repair /or remove broken barricade. 5. Repair /replace cracked cross -walk at Simplicity Community. 6. There are outstanding issues with a pipe opening in a retaining wall as 1 recall. The installation was not installed per the approved plans or the plans that were subsequently submitted. Former Staging Area 1. Remove fuel tank, clean -up oil spill and return area to original condition. Hamilton County Surveyors Office 2. Any outstanding issues with the Hamilton County Surveyors Office need to be resolved.
