Box 3161 Carmel, IN 46082 Re: Protection of prohibited materials or equipment in a plenum Dear Mr. Wilds, The material you have suggested to use to protect the PVC waste and vent piping in the plenum of the project Car Max, 3M Fire Barrier Duct Wrap, appears to conform to an appropriate fire resistive level to protect the piping. Proper installation of these types of tim resistive products is key to obtaining the level of protection stated in testing results. If done properly we agree that the piping will be protected from generating smoke or fire levels above those minimums stated in the code. Thank-you for working through this issue with our department. I'd like to document these conditions in this letter so it may be attached to the TCO and used for follow up. First of all, we are seeking a TCO dated January. Ail life safety and other certifications will be delivered to the City on or before that date. The conditions of the TCO will be: Required to open for business: 1. Removal of the utility poles in the Gray Road entrance and accel / decel lanes. Not required to open for business, must be complete for final CO: 2. Provide grassing per the approved landscape plan; 3. Plant two additional serviceberry trees just north of the Gray Road entrance; 4. Complete the asphalt path in the right-of-way; 5. Complete the restoration of the right-of-way in front of adjacent properties; 6. Complete the 96th Street entrance apron and entrance lanes; 7. Replace the temporary paving at the 96th Street median with permanent paving; 8. Complete the striping requirements at the 96th Street median; 9. Complete the milling and msurfacing of Gray Road as required by Carmel Engineering; 10. Complete the paving at the Gray Road passing blister. I believe the above list is comprehensive, but if any other conditions must be imposed as a result of final inspections, please let me know. This letter confirms our commitment to complete the project in accordance with the Cannel requirements as you expressed to me. We are having HGOR, the Landscape Architect, submit a revised plan showing the landscaping configuration per the May 2003 drawings and with the addition of two serviceberry trees just north of the Gray Road entrance. The revised drawing should be delivered to you on or before January 5, 2004. It is my understanding that this is required for your sign-off to obtain a Temporary Certificate Of Occupancy (TCO). We desire to obtain the TCO on January 6, 2004. If there has been no formal request for an inspection so that you can agree to this TCO date, please consider this such a request. The conditions we agree to meet to obtain a final Certificate Of Occupancy are as follows: Provide grassing per the landscape plan as soon as weather permits; and Plant two additional serviceberry trees just north of the Gray Road entrance. If there are any other conditions that must be imposed as a result of you inspection, please let me know. Also, based on past discussions, the above conditions will not prevent CarMax from opening for business, tf you have any questions, please call me at 404-479-4020. (I am particularly concerned about the permanent paving at 96th Street. Specifications for that paving require ambient temperatu}es of 60 degrees or higher.) As has been the case throughout construction, I will be the primary point of contact for Certificate of Occupancy issues, even after CarMax takes possession of the facility. Due to the weather and the fact that asphalt plants are closing, we may have a great deal of d fficulty completing either entrance wiih permanent or temporary construction. This is a little bit different and more stringent than I though the discussions were leading to, so I would ask some concession / further clarifications from the City. This message is therefore directed to both you and to Jim Blanchard. Due to the weather and the fact that asphalt plants are closing, we may have a great deal of difficulty completing either entrance, with permanent or temporary construction. Therefore, if the City Will allow, I would propose that CarMax be all(~wed to bring cars in ahd begin their preparatory work but NOT PLACE THEM IN THE DISPLAY LOT until a! least the Gray Road entrance s okay for use. Aisc, we have already proposed additional conditions for the TCO - the grassing and planting work to be completed. Therefore, I do not mind a 30 day TCO but this will only run through January and t is unrealistic to assume we will be able to complete the landscapihg work, and also the construction of the entrances, during that time.
