2-3. Docket No. 10110012 DP/ADLS: Legacy PUB - Turkey Hill Minnit Market
The applicant seeks site plan and design approval for an automobile fuel station,retail store,and
carwash. The applicant also seeks the following zoning waiver approval for building setback from River
Rd.:
Docket No. 10110013 ZW: Section 9.02,Legacy PUD ordinance Z-501-07, maximum 15-ft front
yard building setback. The site is located at 7729 E. 146th St. and is zoned PUD/Planned Unit
Development. Filed by Charlie Frankenberger of Nelson&Frankenberger.
The applicant seeks site and design approval to construct a fuel station with car wash and convenience store at
the southwest corner of 146th St. and River Rd. A fuel station is a permitted land use at that corner. The subject
site will be heavily landscaped, and the building will comprise of brick, cast stone, glass, and fiber cement
panels. Some green/sustainable building practices will also be incorporated. The zoning waiver requested is due
to the fact that the building cannot be pulled up to the 15-ft building line along River Rd. because there are
major water lines in that location.No BZA variances are needed,thus far.
The site is located within one of the City's wellhead protection areas, and the City departments are being very
detailed with their review of the plans for the underground storage tanks(USTs), car wash grey water collection
and stormwater runoff, making sure that the petitioner's project plans go above and beyond what is normally
required for these plans to ensure maximum protection of the regional water supply. The City has been
contacted by the City of Westfield and Hamilton County Emergency Management Agency because the proposed
development may also have an impact on Indianapolis and Westfield wellhead areas. The City of Carmel is
giving serious consideration to the concerns of adjacent communities, to make sure that all groundwater and
surface water stakeholders are protected.

Staffs outstanding comments for the petitioner:
1. The Planning Dept. would like a copy of the Spill Prevention,Control and Countermeasure Plan,for the
file.
2. The Forestry Dept. is close to approving the landscape plan.
3. The Carmel Engineering Dept. is okay with the plan in general, but is working through some issues.They
won't support the requested right-in access from River Rd. and are looking at the building's finish floor
elevation and flood protection grades. The development still needs to be reviewed by the Local Planning
Team for the wellhead protection aspects. Also,they still need a response to their TAC comments.
4. The Hamilton County Surveyor's Office sent a letter on Jan. 10.
5. The Hamilton Co. Highway Dept. is waiting for the Traffic Impact Analysis. After the TIA is received and
reviewed,they will determine if it meets the criteria for a hearing by the Hamilton Co. Board of
Commissioners. When/if access is granted to 146th St. by the BOC,they will review/approve the plans.
6. Remember to include the Development Plan application's Findings of Fact sheet in your final info packets.
7. Provide the filled out and notarized Affidavit of Notice of Public Hearing page of the application.
8. Provide the filled out Notice of Public Hearing page of the application.
9. Provide the filled out and notarized Public Notice Sign Placement Affidavit page of the application.
10. Provide a copy of the Official List of Adjacent Property Owners from Hamilton County Auditor's Office.

11. Please show that the exterior lighting of the building or site is designed so that light is not directed off the
site and the light source is shielded from direct offsite viewing. (See ZO CH. 23F.12.02, referred to by the
PUD.) Per the PUD, all fixtures shall be downcast fixtures/90 degree cutoff.
12. Please make the gas canopy cornice a light grey color,to match the lighter grey color on the building's
cement fiber panels.
13. Please provide a copy of the canopy cornice/fascia details.
14. The Dept. does not particularly like the proposal for the outdoor ice merchandiser box, outdoor propane
merchandiser box, and outdoor Redbox dvd rental dispenser.Is there a way to place these amenities inside
the store or surround them with a`shelter' built with similar colors and materials of the principal building?
15. Please provide photo examples of similar roof exhaust fans.And, if possible,please move their proposed
location to area where the rooftop mechanical equipment is placed& screened from view.
16. Need landscape plans for bases of both ground signs.
17. B. Regarding waiver for the electronic scrollers—this can be a Plan Commission zoning waiver or a BZA
variance. You can choose which voting body you want.
18. G.The sign company specs regarding the ground signs still say pin mounted letters. If they are truly
internally illuminated,please have them update the specs page to show internally illuminated letters.The
specs also still say the monument wall will be illuminated by ground lights. Please have them change this
as well if it is not correct.
19. M.The building rendering shows the north sign going into the brick"border".Please have the either the
brick border expanded to provide enough width for the sign or reduce the size of the sign to fit within the
border. We would like to see it framed, not looking like it doesn't fit or is an afterthought.
20. S. We did find the other directional/info signs for the site/car wash on sheet C102. However,we did not
find specs for the Car wash height bar or do not enter signs. There is nothing on page C202 that refers to
either of those items. Please provide more information for those items.
21. U. Thank you for the ATM signage info.However, please remember that only one illuminated window
sign is allowed. This must be 3 sq. ft. or less. Having this sign would not allow them to have an illuminated
"open"sign.The Department would prefer the illuminated open sign over the illuminated ATM sign.
Recommendation:
The Dept of Community Services(DOCS)recommends that the Plan Commission sends this item to the
February 1 Special Studies Committee meeting for further review and discussion.
