NOTICE OF PUBLIC HEARING BEFORE THE
PLAN COMMISSION OF THE CITY OF CARMEL, INDIANA
For Development Plan,/ADLS—Docket No. 10f110012 DP/ADLS
And Zoning Waiver—Docket No. 10110013 ZW
NOTICE IS HEREBY GIVEN that the Plan Commission of the City of Carmel, Indiana
("Plan Commission"), meeting on the 19th day of January, 2011, at 6:00 o'clock p.m., in the
Council Chambers, Second Floor, City Hall, One Civic Square, Carmel, Indiana 46032, will
hold a Public Hearing regarding applications, identified by the Docket Numbers referenced
above, seeking approval of a site plan, design approval and zoning waiver approval for a
automobile fuel station, retail store and car wash (the "Applications") pertaining to the real estate
generally located on the southwest:corner of River Road and 146th Street in Carmel, Indiana, and
legally described in the attached Exhibit "A" (the "Real Estate"). The Real Estate is zoned under
the Legacy PUD and is approximately, 7.012 acres in size.
The Applications seek approval of the (i) development plan, (ii) architectural design,
lighting, landscaping and signage, and (iii) zoning waiver for the maximum front yard building
setback regarding an automobile fuel station, retail store, and car wash to be constructed upon
the Real Estate.
Copies of the Applications are on file for examination at the Department of Community
Services, One Civic Square, Carmel, IN 46032, telephone 317/571-2417.
All interested persons desiring to present their views on the Application, either in writing
or verbally, will be given an:opportunity to be heard at the above-mentioned time and place.
Written objections to the Applications filed with the Department of Community Services
either prior to or at the Public Hearing will be considered, and oral comments concerning the
proposed Application will be heard at the Public Hearing.
The Public Hearing may be continued from time to time as may be found necessary.

A part of the Northeast Quarter of Section 23, Township 18 North, Range 4 East of the 2nd
Principal Meridian, Clay Township, Hamilton County, Indiana descried more particularly as
follows:
Commencing at the Northeast Corner of said Section 23 thence North 89 degrees 15 minutes 40
seconds West (bearings based upon the Indiana State Plane Coordinate System Grid North)
along:the north line of the Northeast Quarter of said Section 23 a distance of 337.40 feet; thence
South 20 degrees 07 minutes 12 seconds West a distance of 149.74 feet to the Point of
Beginning being the southwest intersection of the rights-of-way for 146th Street and River Road

curve to the right having a radius of 688.98 feet, the radius point of which bears North 89
