The minutes of February 19, 2013 meeting were approved as submitted.
F. Communications, Bills, Expenditures, & Legal Counsel Report - We do not have any pending
litigation to report.
G. Reports, Announcements & Department Concerns
1. Committee Meeting Dates Calendar: The Planning Dept. requests that the Plan Commission
votes to change the Tues. July 2 Committee meetings to Thurs. June 27, due to conflicts with
Carmel Fest and Independence Day events.
Date changed to June 26th @ 6pm per availability of Sub Committee Members. I" Motion to

H. Public Hearings
1. Docket No. 13010010 DP /ADLS: The Legacy Towns & Flats, Phase 1I.
The applicant seeks site plan and design approval for 23 buildings on 6.9 acres, containing
attached dwellings and apartments. The site is located at approximately 7499 E. l 46 St., west of
River Rd. The site is zoned PUD /Planned Unit Development. Filed by Charlie Frankenberger of
Nelson & Frankenberger, for J.C. Hart Company, Inc.
Present for petitioner: Charlie Frankenberger and Jon Dobosiewicz — Nelson & Frankenberger,
Randy Sherman — Weaver Sherman Design, Johnny Hart and Todd May — JC Hart
• Legacy PUD approved in Jan 2007
• Phase I is complete and located just south of 146th St and east of Community Drive. JC
Hart is ready for Phase 11
• Phase II is approx. 7 acres and is located just east of Phase
• Phase II will include 77 dwellings, 20 of 77 will be apartments located in building along

the north of Phase 11 adjacent to 146th Street, 57 of 77 will be townhomes and attached in
small groups of 2, 3 or 4. Two townhomes will be detached.
• All townhomes and apartments will initially be rented however will be constructed as
attached single family dwellings
• Each townhome will have private green space and direct access to a one or two car garage
• Each townhome will be located on its own individually platted lot and will be separately
metered for utilities — will be impossible to distinguish to between renters and owners
• Options for selling individual town homes will be at a later date
• Phase II complies in all respects to the Legacy PUD ordinances
No public comments were heard during this meeting.
Department comments Rachel Boone:
• Summarized petitioners comments
• Woodland preservation and open space surrounds area
• Retail lining 146th on the northwest and to the east on the corner of River Road and 146th
Street in the future
• Connection between both Phase I and Phase II
• Most apartments and townhomes will have a view into the wetland and open space
• Apartments at north end, townhomes at south end
• Garages at most townhomes and some apartments
• Remaining issues include building orientation, possible addition of sidewalks, final
details on architecture and parking concerns
• Preliminary PUD site /concept plans are included in Department Report
Recommended to be forwarded to the Wednesday March 27th Special Studies Committee.

John Adams: Excellent job, looking forward to development of Phase II plat
Susan Westermeier: Concerns about parking and sidewalks
Charlie Frankenberger: We are working with staff to finalize remaining issues
Rachel Boone: Will be working through issues with Petitioner before Special Studies Meeting

Nick Kestner: Open space will not be developed?
Charlie Frankenberger: Open space will remain as indentified in initial Legacy PUD, only
development that might occur would be trails and structures that go adjacent to well heads
Susan Westermeier: Jon, please review 2007 Phase I to refresh our memory.
Jon Dobosiewicz: explained locations of housing sections of Phase I which was completed in
2007 and future work sites
Charlie Frankenberger: Area east of River Road is mostly open space except for small space that
is zoned for residential purposes and is now owned by Conner Prairie but is subject to Legacy
PUD and zoning
Ephraim Wilfong: building elevations — please specify: brick masonry veneer
Randy Sherman, Architect — brick masonry veneer is a standard masonry brick, will supplement
with stone and brick heads. There will be 4 different combinations of materials. Will review
color schemes with Committee.
Ephraim Wilfong: would like to see more real life pictures of elevations as opposed to artist
renderings, Joshua Kirsh and John Adams concurred.

development, comprising of townhomes and apartments. The site is located at 9801 Westfield
Blvd. and is zoned PUD /Planned Unit Development. Filed by Pittman Partners, Inc.

• DP has already been approved, just ADLS needs approval
• Project was previously known as Aramore PUD
• 256 units on 21 acres, approx 12 units per acre — zoned PUD
• Garages under buildings
• Elevators in buildings
• Stone, brick and siding will be used
• Lodge like common area with fireplace, deck and pool

• Shade study done on pool area for maximum sun for tenants
• 2 story fitness facility

Department Comments Rachel Boone:
• Single family residential surrounds the property
• Petitioner will install left turn lane on Westfield Blvd into development, accel and decel
lane for north bound traffic, working with City to possibly continue path on Westfield to
increase pedestrian connectivity, missing segment of Maple Drive, which will have
removable bollards for Fire Department and to keep separation from the neighbors to the
south until the street is improved
• Remaining issues: architectural details and sidewalk materials

Committee Member Comments:
John Adams: Connection to Maple Drive — narrow streets
Steve Lawson: Moron trail connection? Put crosswalk where round about?
Steve Pittman: The multipurpose path on the south edge of our property will connect this
development and the neighbors to the east to the Monon Trail. The south path will go across
Westfield Blvd., and connect to the existing path that runs on the west side of Westfield Blvd. It
will provide connection through the park by the roundabout, which is a trail head for the Monon.
Joshua Kirsh: Have you discussed with Park Department and connectivity with pedestrian oasis?
Susan Westermeier: What commitments are you planning for multipurpose path from 99th to 96th
Street?
Steve Pittman:
• We are committing to install a multipurpose path across the south portion of our property
into Chesterton and along the west side of our property along Westfield Blvd. as required
by the PUD
• Will also install a crosswalk with pedestrian refuge across Westfield Blvd. to access the
path system on the west side of Westfield Blvd.
• We are NOT going to pay to build a path all the way from 99th to 96th (There was
confusion based on a comment by Staff - the Petitioner will talk with the City about
future City projects and will do their best to coordinate construction efforts so that paths
do not need to be re -done after street and utility work is done in the immediate area. The
Petitioner is not obligated to build paths that are not located on their property. But they do
recognize the need in this area for greater connectivity and are being pro - active to help
get this accomplished with the City, for the greater good of all residents in the area.)
