Kevin Rider brought meeting to order.
The Special Studies Committee will meet to consider the following items:
I . Docket No. 12120016 DP /ADLS: Butler Hyundai Development at 96`h/Randall.
The applicant seeks site plan and design approval for a 37,500 sq. ft. car dealership building, 2
outlots, and Randall Bypass road. The site is located at approximately 4200 E. 96th St., west of
Randall Dr. The site is zoned B -3 /Business and partially lies within the Floodplain & Floodway
Districts. Filed by Timothy Ochs of Ice Miller, LLP, on behalf of 4148 96th St, LLC.
Petitioner: Tim Ochs of Ice Miller
Overview:
1. Hours of operation 7 am — 9 pm
2. No more than 1 outdoor speaker oriented towards the south
3. All auto body repair activities not be seen from Randall Drive
4. No test drives through Williamson Run — including maintenance test drives
5. No large flagpole, blimps, balloons, banners etc
6. Lighting be dimmed between 10 pm to 6:30 am and not exceed 0.3 foot candle
7. Size and number of signs not to exceed signage plans dated 1 -30 -13
8. Landscaping to comply with the Planting Plan and Details prepared by Context Landscaping
Architecture
9. Buffer yard to comply with Carmel Zoning Ordinance
10. Drainage requirements to comply with Carmel City Code
I I. Maintain retention or drainage ponds
12. Sidewalk to be installed along Randall Drive
13. 60 day notice at least of 1" hearing of any petition(s) with Carmel DOCS
14, Vacate southern part of Randall Drive and waives right to remonstrate

15. Fence to be installed prior to opening dealership for business
Buzz Weisiger of CWC passed around the following:
1. picture of fence
2. finish of retaining wall
3. concrete wall to be painted
4. exterior wall finishes for west and east elevations
Department Report Rachel Boone:
• Update drawings on things already agreed on
• Flagpoles are allowed as long as corporate or American — per sign existing ordinance
• Foot candles — residential .01, commercial .03
• Bufferyard needs to be extended to be 10 ft on northern parcel
• Pedestrian connectivity — proposed asphalt sidewalks to concrete
• Sidewalk now to be located on west side next to detention pond
• Permeable Pavers changed to asphalt along main 96th Street path
• Maintenance agreement between owner and city for path along 96th street if not in an easement
• Site lighting — shielded to meet ordinance requirements
• Retaining wall to be smooth finish — (recommended to stain concrete it by Kevin Rider)
• Asked to pick wrought Iron rather than chain link fence
• Entrance gate on south elevation to be a stand alone arch
Recommended to March 27`h Special Studies Committee Meeting so Ice Miller has time to complete
the Traffic Study
Committee Comments Alan Potasnik:
• Clarification of 60 day notice to HOA of any petitions with DOCS
• Clarification of fence material
Tim Ochs read Brad Grabow's email to committee members
• Access to outlots will be internal via Randall Drive/Bypass
• Tree study to be done — no intent for trees to be removed at this time
Kevin Rider:
• Add to commitments that nothing be removed until plans for northern parcel was developed
• Jim Adams agrees to adding commitment
• Urban Forestry Department to confirm any dying trees be removed
Susan Westermeier:
• Traffic study has been initiated by City and paid for by Ice Miller, Inc.
Steve Feribach - A& F Engineering is conducting traffic study
• Currently collecting traffic count
• Present at this meeting to gather information for possible locations of traffic counters
• Commitments on east side auto mall the same as ours? Yes per Tim Ochs
• Outlots are going to come back? Yes per Tim Ochs
• Aerials pictures were shown
• Stronger commitments made to prevent test drive through Williamson Run Subdivision
• Pedestrian connectivity still a concern regarding location of sidewalks and walkways

Michael Casati
• Who maintains split rail fence? HOA has maintained a few times but was then told it was in
the ROW
• Kevin Rider — Dept. to call Street Department regarding fencing
Dave Frische - Williamson Run HOA Board President
• Maintenance drives to be included in no drives through Williamson Run
• Lighting — cannot leave the property — lights will be LED, staff will go out and measure this
after project is complete
• Zoned B3, are we meeting the 80% usage, 20% green space? Yes per Rachel Boone
• Buffer will now be 10 ft on northern end of parcel
• Maintenance of retention pond — chemicals? Geothermal 12 -14 ft deep, designed with safety
shelf
• Sidewalk timing on Randall Rd west side will be built when northern part of property is built
• Traffic study — who is cutting thru and where
• Outlot I and 2 commitments — is a continued concern for homeowners
• Start of construction could be as early as April or May
• Zoned B -3
Public can contact Plan Commission Members but it is not recommended. Website information needs
to be updated.
Very unlikely that the City will approve closing off Randall Drive at southern end of Williamson Run.
Williamson Run Homeowners Comments:
Jody Swind
• LED lighting at similar dealership that can be used as comparison?
dealership in the state has LED lighting
• Purpose of tree study? Buzz Weisiger — all trees to be salvaged or saved if possible
• The south end of Randall Drive will be disconnected and no longer a flood issue for driving
Kurt Snyder
• Traffic study before this is approved? Kevin — project will not be approved before traffic study
is completed
• Compare in a few years, do study again? Steve Feribaugh will repeat study in the future
• Pin oak trees in landscape plan? Specific trees will be approved by Urban Forester
• Access road to the west - this plan does not stop this from being done (unknown resident)
• Large transport vehicles would use road to the west to exit from dealership

• AT &T U -verse box is located at end of Randall Drive. Service is interrupted when flooding
occurs. Staff will reach out to AT &T.

• What is happening in outlots'? Buzz Weisiger — They will be used as construction; zones then
graded out and seeded
• Test drives — insurance company requires that a sales person goes with each customer
• LED lighting adjustable - measure at niax, turned down at night

• Monitoring test drive — similar commitments with other dealerships, possible monitoring drives
electronically? Ice Miller, Inc. will follow up with GM at Butler

• Concerns about test drives and people driving too fast
• Kevin Rider suggestion to email him and he will get with Traffic Dept about radar

• Set time limits on construction? city ordinances regulate times
• Flood plan — water will flow south and not into subdivision
• Who maintains property of house? Owners
• Unmarked car /police situation through his backyard — sending Kevin Rider email

• No construction vehicles going thru Williamson Run — will put into subcontractors contract and
post signs

• Tear down fence on Randall Road
• Portion of road will be taken out up to ROW on 96th Street, property maintenance on portion of
road still existing
• Wants to be added to email list for all correspondence
• Continuing sidewalk that goes north after north property is complete
• What streets are being studied? Traffic study is currently on Lakeshore Drive and 96th Street
and will do 3 additional locations at neighbors suggestion

• Will existing house be torn down? — not occupied and will tear down when construction starts
• Randall Road hidden from east, turn lane installed? Turn lane will be installed
• Deliveries — will be using access points for deliveries
• How many cars can park between service bay and Randall Bypass'? Service lane is 2 lanes wide
plus storage for up to 8 inside
• When would roads be complete? Will coordinate with city, road construction takes place at end
of project
