Due to the ongoing legal battles the owner has not released us to complete the engineering/construction documents, therefore this plat is based upon the approved DP, requests made during that process;and modifying the existing recorded plat. After review by this office-the foilow,ing items need to be discussed: ®. The right-of-Way for`Smokey Row Road as it appears on the plat does not meet the ROW requirements for the. Carmel Thoroughfare Plan. 1 The ROW is shown as was requested during DP-ADLS and is consistant with the previous plat with the addition of a 50' half ROW along the north side of the property. The ROW around the curve and on the west side of the property appears to be more than the 50' half and also to be part of the highway ROW. Please let me know what you think it should be, since this has not been mention previously in the myriad of DP discussions. • The Tree Preservation Area is to be noted as a Tree Preservation E asement and defined as one within the restrictions of the plat. I was advised by the owner's council to show the Tree Preservation Area as it appeared on the existing recorded plat. So what has changed? • There is a drainage structure under Smokey Row Road which will require a drainage easement be shown on this plat. This is not consistant with the existing recorded plat. Please advise which drainage structure (there are two) and what size easement, etc. • There are also Stormwater Quality Easements which will need to be added to the plat., Final construction documents have not yet been authorized by the owner,therefore we have no idea as to the exact size or location of these items. Please reply to all of the above with your comments pertaining to these items. Thank you. I do have a couple of questions/comments. Items 42 and #6 are on the drawing already; do we need to do something different? Item #5 has been described to me as being platted with the original rezoning and that the area shown on the DP is a commitment, but not a plat item, according to Jon Dodosiewicz.
