5 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
6 INDIANA,REZONING DISTRICT CLASSIFICATION

8 Rezoning 6 properties northwest of Cannel Drive and Range Line Road from the B-3/Business and I-
9 1/Industrial District Classifications within the Carmel Drive/Range Line Road Overlay to the C-1/City
10 Center District Classification

12 WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted a zoning
13 ordinance, the terms of which are applicable to the geographic area consisting of the incorporated area of the
14 City of Carmel, Indiana, and the unincorporated area of Clay Township, Hamilton County, Indiana, which
15 zoning ordinance has been codified in Chapter 10 of the Carmel City Code; and
16
17 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the
18 map that is part of the zoning ordinance; and
19
20 WHEREAS, the Carmel Advisory Plan Commission gave a favorable recommendation on Tuesday,
21 January 15, 2013, regarding the rezoning of the six (6) parcels of real property as described in Exhibit A,
22 and which-is illustrated ' on Exhibit B, both exhibits incorporated herein by this
23 reference (the"Real Property Parcels")

25 NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana,
26 as follows:

28 Section 1. That the Official Zoning Map accompanying and made part of the Zoning Ordinance is
29 hereby changed to designate the Rceal Property Parcels from the B-3/Business and I-1/Industrial District
30 Classifications within the Carmel Drive/Range Line Road Overlay Zone to the C-1/City Center District, the
31 same being expressly subject to and contingent upon said re-zone, as well as the design plan, project
32 agreement, use, and all related matters (except for ADLS) regarding and for the Real Property Parcels,
33 receiving the approval of both the Carmel Redevelopment Commission and the Carmel Common Council
34 prior to any new building permits being issued.

36 Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are
37 hereby repealed.

39 Section 3. This Ordinance shall be in full force and effect from and after its passage and signing by
40 the Mayor.
