SURVEYOR'S REPORT The purpose of this project was to prepare a land title survey to ALTAIACSM specifications of a site described in a title commitment prepared by Escrow & Title Services, LLC, Commitment No. 101673 dated December 1, 2004. -Field work was conducted in February, 2005. Research concerning adjoiner information and section corner - reference ties was conducted on the Hamilton County web site and at the office of the Hamilton County Recorder. In accordance with Title 865, Chapter 12, of the Indiana Administrative Code, the following observations and opinions are submitted regarding the various uncertainties in the locations of the lines and comer established on this. result of: = a.) Availability and condition of reference monuments; b.j Occupation o r po sess i on lines; c.) Clarity or ambiguity of the record descriptions used or adjoin er s es so or both and; d.) The theoretical uncertainty of measurements. a.) Availability and condition of reference monuments Refere n ce monumen tati n r ecov er ed for thi s survey -consisted of the following: - . - 1) Ma g Nail f ou n d at th e s outhwest c o rner of Section 19, Township 18 North, Range 4 East The Hamilton County Surveyor (HCS) only has a tie sheet for the northeast corner of Section 24, Township 18 North, Range 3 East, which is in the vicinity of but not necessarily in the same position as the said southwest corner. 2) No monument was found at the south quarter corner of Section 19. The latest HCS tie sheet from 1963 indicates a stone -16" down with 4 references. All of the references are gone. We did not attempt to dig down to the stone. The location of this corner.was established from prior surveys by Mid - States Engineering in 2002, Paul 1. Cripe, Inc. in 1995, and Weihe Engineers in 1990. 3) Large bolt found per HCS ties at the southeast corner of Section19. 4) Railroad spike found in the approximate location of the east quarter corner of Section 19. HCS ties last checked in 1982 were not found. • 5) Harrison Monument found per HCS ties at the northeast corner of Section 19. 6) Type C Monument found per HCS ties at the north quarter corner of Section 19. 7) . No HCS ties were available and no. viable existing monuments were found at the northwest, west, or center of Section 19. It is my opinion that the maxis Ain, discrepancy associated with the above monuments related to the Surveyed Tract is 0.4 foot,. 8) Part of the boundary of the Surveyed Tract is along the south right -of -way of the Indiana Union Traction Company (" /LIT "). The only, best evidence of the location of that right -of -way are the abutments of the former bridge over Cool Creek. When I reestablished the boundary of the north adjoiner, which also follows the south right -of -way tine and has a more modern, higher - precision description t:3an the record description of the Surveyed Tract, its location of the right - of -way line is within 0.5 foot of the line joined by the physical centers of the two abutments. I accepted the location of the right -of -way as established by this adjoiner's deed. 9) The record deed of the Surveyed Tract and some adjoiners' deeds refer to a common boundary corner being "the southwest corner of the west abutment of the old IUT bridge over Cool Creek ". This corner is also described as being on the south right -of -way line of the IUT. A capped ( "WEIHE") rebar was found in this area. However, it lies about 28 feet from the center of the two abutments and the right -of -way of the IUT is a total of "4 rods" or 66 feet, half of which _ is 33 feet, leaving a 5-foot gap from this rebarto the right -of -way as established for this Survey. b.) Occupation orpossession lines 10) The Surveyed Tract is bounded on the south by Smokey Row Road. 11) A woven wire fence varies from 2.0 feet west to 2.0 feet east of the surveyed east boundary line. 12) A chain -link fence varies from 4.2 feet to 5.1 feet south of the surveyed north boundary line. 13) A woven wire fence on the west side of Cool Creek varies from 0.7 to 0.8 foot east of the surveyed west boundary line. 14) A woven wire fence on the east side of Cool Creek varies from 0.8 foot west to 0.1 foot east of the surveyed west boundary line. 15) The southern end of the west boundary line of the Surveyed Tract meanders Cool Creek. It is not possible to know of any changes in the location of Cool Creek over the years, but the current location of the "center" 'of Cool Creek is within a few feet of. the entry distance of the record description. c.) Clarify or ambiguity of the record descriptions used or adjoiner's descriptions, or both 16} The east adjoiner qualifies its west tine to the east line of the Surveyed Tract, therefore there is no discrepancy along that line. The bearing -of this line per the record deed o e Surveyed Tract simply 'North" and "on d along a fence line". The final bearing I used for this Survey : ac s m an n . matches the east adjoinees bearing. 17) The north adjoinees south line-begins 1353 feet north of the south line of Section 19, then goes "West" to the south line of the Traction right -of -way. The Surveyed Tract's north line begins 1356.6 feet north of the south line of Section 19, then also goes "West" to the south line of the. Traction right -of -way. If both "West" calls are considered to be on the same bearing, this would relate to an overlap of 3.6 feet. The Surveyed Tract does qualify the north end of the 1356.6 line to "a corner post" of a fence. The first deed that related to the fence and the corner post-was in 1950. There is a fence of some antiquity along the east line of the Surveyed Tract, but it is not known if it dates back to 19500 The only corner postfor this fence, too, is 18 feet shy of the 1356.6 feet. The 6 -foot chain -link fence - apparently put up by the north adjoiner is, for the most I part, within 0.3 foot of a line 1353 feet north of and parallel with the south line of Section 19. This still leaves an ambiguity, though, of at least 3.6 feet.. 18) That portion of the Surveyed Tract's west line that is not along the creek has a specific bearing of "South 11 degrees 8 minutes West" per the record description. The description of the west adjoiner along this begins at the same point but runs simply "South ". Taking "South" as at least approximately "South 0 degrees ", the resulting variance between these two lines along the length of their, commonality would be about 100 feet. The south end of this line is also qualified in the record description of the Surveyed Tract as being "484 feet West of the east line of said property ". !t is, in fact, around 512 feet from said east line. The record description of the Surveyed Tract also qualifies this line as "on and along a fence line" (the adjoiner's description makes no such qualification).' if a line is drawn from the northern point of this line (at the southwest corner of the west abutment of the ! U T bridge over Cool Creek) at the called -for length of 511.5 feet and set this endpoint in the center of Cool Creek as it exists today, the line does very closely follow an existing fence of some antiquity (see Items 13 and 14 above). 19) The record description of the Surveyed Tract calls for a distance of 831 feet along the creek back to the point of beginning. The sum of the meander calls created for the Modern Description is 836 feet. 20) The west adjoiner along Cool Creek and the Surveyed Tract both qualify their common line as being along the creek, therefore there is no discrepancy between these two parcels. d.) The theoretical uncertainty of measurements The theoretical uncertainty of the location of the corners of this tract is within specifications far a Class C (0.5 feet) survey as defined- in Title 005, Article 1, Rule 12, Scotionc 1 through 10 of tho Indiana Administrative Code. GENERAL NOTES YOB'S .. _. 1. The zoning classification for the Surveyed Tract, as established by governmental record, has _ not been shown. Per 865 IAC 1 -12 -13 (14), "Show zoning ordinance classification- references- according to documentation provided by client. Any. other zoning use certifications shall be - ' limited to those facts that -can be c e counted or measured." No documentation was provided to the Surveyor by the client in reference to any zoning related matters. The zoning setback requirements are subject to legal interpretation. This Surveyor cannot -make a certification on the basis of an interpretation. Therefore the corresponding setback requirements have not # been shown on this Survey. 2. The underground utilities depicted on the attached Survey Plat have been shown per field observations, atlas maps as may be available from municipalities or utility companies (Indiana Underground Plant i Protection Agency), prior - surveys, and existing drawings only. The Surveyor makes no guarantee that the underground utilities shown comprise all such utilities in the area, either in service or abandoned. No warranty, either, expressed .or implied, is made to the accuracy andlor completeness of Information. presented on underground utilities or as to its fitness for any particular purpose or use. in no event will Mid- States Engineering,. LLC, its employees, agents, andlor assigns be liable for any damages arising out of the furnishing andlor use of such information. The path of the utility lines on said Survey .Plat should be considered approximate until they are either relocated, by calling the Indiana Underground Plant Protection Agency at 1- 840 -382 -5544, or until they are excavated to verify the location and path of E the utility lines. Part -of the Surveyed Tract lies within Special Flood Hazard Zone A Flood Hazard Boundary j (areas within the 100 -year floodplain) as shown on the Flood Insurance Rate Maps, Community Panel No. 18057CO226 F, effective date of February 13, 2003, prepared by the Federal Emergency Management Agency. Attention is called to the fact that there are substantial uncertainties associated with said map and with information taken therefrom. Cool Creek.is along the west side of the Surveyed-Tract and is shown on the Survey Plat. ' 9. ITEM 9— "Grant of an Anchor Permit to Public Service Company of Indiana, Inc. by instrument dated June 27, 1952 and recorded August 20, 1952 in Deed Record 137, Page 402." The west line of the property owned by the Gran;::e at the time of this document was the east line of the Cemetery that is approximately 500 eet west of Cool Creek. The location of the anchors specified in this document is described as being 40 feet east of the southwest s fence corner of the Grantee's property. Therefore, it is my opinion that the location of the anchors called for in this, document lies outside the Surveyed Tract. ! 10. ITEM % — "Terms, provisions and conditions of the Ma4ter Plan ordinance for the Town of { Carmel as recorded in Miscellaneous Record 56, Pages 380 and 381." The Surveyed Tract is currently, within the city lim ±s of Carmel. It is not known from this document or any documents provided whether the Surveyed Tract is within the boundaries described on this document. 11. ITEM 11, — "Right of Way Grant granted to County of Hamilton as per instrument recorded in j Deed Record 213, Pages 82, 83 and 84." This document granted 40 feet from the center line of Smoky Row Road. The area of Grant 1 is shown on the Survey Plat, 12. ITEM 12 — "Grant of Anchor Permit to Public Service of Indiana, Inc. by instrument dated June 27l 1959 and recorded August 20,1952 in Deed Record 272, Page 443." There is a utility pole at the approximate location as described in this document. 13.
