The approval of this variance will not be injurious to the public health,safety,morals and general welfare of the community because: a. The structure is a residential property for single family use within an existing community b. The structure will be built to city code and HOA guidelines 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: a. The structure will be built to city code and HOA guidelines b. The developer Pulte has approved the structure and owns the home which is immediately adjacent to the proposed structure c. The proposed garage will be built to match the architecture of the existing prairie style home with side facing garage doors d. The proposed structure is approximately 56'from the street and 14'from the building line e. There is an existing exterior garage in the neighborhood already,and lot 29 was approved by Pulte with an exterior garage similar in design as the proposed. f. The structure will be approximately 80'from the neighboring home 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: a. The current zoning size restriction of 24'X 30'isn't large enough to store all of the personal use items. b. The current zoning height restriction of 18'doesn't allow for the internal height of the boat to be stored on the trailer with a hoist mount on the ceiling. A garage door of at least 10'is required with a clearing space internally of approximately 14'to 15'.This is difficult to achieve with the flat roof of a prairie style architectural design required by the HOA. c. The current zoning restriction of a front yard setback of 25'behind the principle structure,or 25'behind required front yard setback causes appearance issues and moves the structure into the back yard which slops from front to back. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Petitioner or representative to sign. Statement of Variance The following are Development Standard Variances being requested: 1. Front yard setback shall be the greater of the following: 25'behind front of principle structure,or 25'behind required front yard setback. 2. Accessory structures may not exceed 24'X 30' 3. Accessory structures may not exceed a height of 18 Statement of Support The following are statements of support for the variances requested: 1. The HOA/developer(Pulte Homes) is in support of the project and owns the home adjacent to the proposed exterior garage. 2. Pulte has approved another exterior garage similar to our proposed structure on lot 29,and there is an existing home in the development with an exterior garage similar to the proposed. 3. The structure will be built within the architecture of the existing prairie style as the home using the same building materials. 4. There are no garage doors facing the street, and the front of the structure is in line with the existing home. 5. The structure will be approximately 56'from the street and 14'from the front building line of 40' 6. The structure is approximately 80'from the adjacent home 7. The size of the proposed garage is 1;316 square feet,which is less than the 75%rule of the primary structure. The primary structure first floor is approximately 2,686 square feet. 2,686*75%equates to 2,014 square feet so we are well within that guideline. 8. The height of the structure is required to house a 24'boat on a trailer and to allow working space above the boat for storage,loading,maintenance,etc. 9. The boat on trailer is approximately 27'with a breakaway tongue,so to allow this to be stored the existing code would not allow this boat to be stored. 10. The garage will be used for personal use and house personal items 11. Some of the items to be stored in the garage are as follows;boat as described previously, a trailer for 5 off road motor cycles,the 5 motor cycles,golf cart,bicycles, sporting equipment,and one additional truck,and one additional car.
