at the Southeast corner of the real estate; thence North 00 degrees 36
minutes 44 seconds West on the East line of the red estate described in
said Deed Book 319. page362, page 582 o distance of 232.70 feet to a 5/8
:nom at the Southwest corner of the real estate described in Deed Book
319, page 357 in said Office; thence South 90 degrees 00 minutes 00
seconds East on the South line of the real estate described in said Deed
Book 319, page 557 a distance of 16.00 feet to a 5/8 inch rebor which is
located on o line which bears South 00 degrees 36 minutes 44 seconds
parallel with the East line of said Southwest Quarter from the point of
beginning; thence North 00 degrees 36 minutes 44 seconds West parallel with
the East line of said Southwest Quarter 231.70 feet to the point of beginning,
containing 1.00 acres, more or less.
DEED OF DEDICATION
I the undersigned, owner of the real estate shown, described herein and with
Warranty Deed recorded as Instrument No. 200400076132 (Source of Title) in
the office of the Recorder of .- iomilton County, Indiana, do hereby certify that
I have laid off, platted, and subdivided and do hereby lay off, plat and
subdivide said real estate in accordance with the within plot.
This subdivision shall be knowr and designated as DULIN WOODS, on addition
in Hamilton County, Indiana. A! streets and alleys shown and not heretofore
dedicated are hereby dedicated to the public
Front and side yard building setback lines are hereby established as shown on
this plot, between which lines and the property lines of the street there shall
be erected or maintained no building or structure.
There are strips of ground 12, 16 and 35 feet in width as shown on this plat
and marked "easement ", reserved for the use of public utilities for the
installation of water and sewer mains, poles, ducts, lines and wires, subject at
all times to the proper authorities and to the easement herein reserved. No
permanent or other structures are to be erected or maintained upon said
strips of land, but owners of lots in this subdivision shall take their titles
subject to the rights of the public utilities.
All dwellings shall have a minimum ground floor area of 1,100 square feet.
The foregoing covenants, or restrictions, are to run with the land and shalt be
binding on all parties and oil persons claiming under them until January 1,
2030, at which time said covenants, or restrictions, sholl be automatically
extended for cucce-zciva pariodc of 10 yearc unlaac changed by vote of a
majority of the then owners cf the buildings covered by these covenants, or
restrictions, in whole or in part. Invalidation of any one of the foregoing
covenants or restrictions, by ,udgment or court order, shall in no way affect
any of the other covenants or restrictions, which shall remain in full force
and effect.
The right to enforce these provisions by injunction, together with the right to
cause the removal, by due process of low, of any structure or part thereof
erected or maintained in violation hereof, is hereby dedicated to the public,
and reserved to the several owners of the several lots in this subdivision and
to their heirs and assigns.
