COR.,SE 114 SEC. 11, T 17 N, R 3 E P.K. NAIL FOUND •f SURVEYOR'S REPORT The subject tract is part of the Southeast Quarter of Section 11, Township 17 North, Range 3 East, Hamilton County, Indiana. The bearings in this survey are based upon a survey performed by Schneider Engineering Corporation for Duke Construction Management (Job No. 649, dated December 21, 1988). This survey is based upon a previous survey performed by Wooipert Consultants for Duke Construction Management (.lob No. 65- 17943 -06, dated November 25, 1992). In accordance with Sections 8 through 12, of Rule 12, Article 1, Title 865 of the Indiana Administrative Code, the following observations and opinions are submitted regarding the various uncertainties of the location of lines and corners established on this survey as a result of: A. availability and condition of reference monuments; B. inconsistencies in occupation or possession lines; C. discrepancies or ambiguities in record descriptions and lats and D. random errors in measurements (theoretical uncertainty The following are the findings of the above uncertainties: A. Availability and condition of reference monuments. PK Nails were found at the southeast and southwest corners of the Southeast Quarter of Section 11, Township 17 North, Range 3 East, per references provided by the Marion County Surveyor's Office. An Iron Pin with cap was found 40.08 feet west of the northwest corner of the subject tract. Another Iron Pin with cap was found at the northeast corner of the subject tract. Another Iron Pin with cap was found 50.00 feet south of the southeast corner of the subject tract. The uncertainty in the reference monuments is 0.3 feet (radial). B. Inconsistencies in occupation or possession lines. No inconsistencies were found. C. Discrepancies or ambiguities in record descriptions and plats. No discrepancies or ambiguities were found. s D. Random errors in measurements (theoretical uncertainty). Due to random errors in measurement, the theoretical uncertainty in position of the corners of this survey are within the specifications for a Class B Survey as defined in the above mentioned code. NOTES: 1. The subject parcel is Zoned S -2 Residence District 2. Subject to certain deed restrictions contained in the first deed of conveyances of each lot recited as follows (restrictions regarding race, color, religion, or national origin have been omitted): "At no time shall any part of the said land be used . . occupied for the manufacture, brewing, distilling or sale of spirituous or malt liquors, nor shall the said lot or any part thereof or any building erected thereon at anytime thereafter, be used or occupied as a bone — boiling establishment, tannery, slaughterhouse, glue, soap, candle, starch or gun — powder manufactory, or for any offensive or dangerous purpose. No signs for advertising purposes shall be erected or placed thereon. That all buildings erected thereon shall be placed and set back not less than 25 feet from the street line; provided that steps, windows, porticos and other projections appurtenant thereto may be within said distance.
