Main Street in Carmel, which sits on the southwest corner of the roundabout at Main Street and 4th Ave SW. The final design plan for our client resulted in a lot coverage that was approximately 44% where the zoning ordinance allows for 35% coverage in the R -2 area. Lot coverage includes all structures (house & garage), porches, patios, sidewalks and driveways. A majority of the additional coverage was created by a swimming pool and outdoor living area behind the home. This area will be screened from the street by the home and from the adjoining properties with high quality fencing and landscaping. We have requested a maximum of 50% lot coverage to accommodate our design plan. We've also requested a variance for a reduction in the front yard setback. The zoning ordinance calls for a 35' front setback in the R -2 zoning area. However, all other properties at this corner have front setbacks of 15' or less. After discussion with the city planning staff we determined it would look more appropriate for the home to be consistent with the buildings on the other three corners of the roundabout intersection. We have requested a minimum 15' front setback to create consistency with the adjacent properties. We look forward to presenting our variance request at the BZA Hearing Officer meeting on April 22. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The approval of a reduced front yard setback will bring the southwest corner of Main Street and 4th Ave SW into conformance with the structures on the other three corners which all maintain setbacks of less than 15'. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The new structure proposed for this location will be of substantially greater architectural and economic value than the previous structure on the property. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The appropriate aesthetic treatment for this intersection on a prominent roundabout dictates a smaller front yard with the structure placed closer to the right -of -way. Maintaining a 35' front yard setback will create a single property that is incongruent with the other three intersections. A majority of the requested increase in coverage is created by the addition of a swimming pool and patio. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: A single family residence is proposed for this property which will have a much greater architectural and economic value to the Arts & Design District and Main Street than the former structure that was in poor condition. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The owner would not be able to develop the property as desired and in a manner consistent with the adjacent uses in the Arts District /Main Street area.
