This is to certify that this map or plat and the survey on which it is based were made in accordance with "Minimum Standard Detail Requirements for ALTAIACSM Land Title Surveys," jointly established and adopted by ALTA, ACSM and NSPS in 1999, and includes Items 1, 3,4,79 and c, 8 through 10, 1 la, and 13 in Table A thereof, Pursuant to the Accuracy Standards as adopted by ALTA, INSPS, and ACSM and in effect on the date of this certification, undersigned further certifies that the Positional Uncertainties resulting from the survey measurements made on the survey do not exceed the allowable Positional Tolerance, SURVEYOR'S REPORT In accordance with Title 865, Article 1, Rule 12, of the Indiana Administrative Code, establishing minimum standards for the practice of land surveying in Indiana, effective August 16, 1991 , the following observations and opinions are submitted regarding the various uncertainties in the location of the lines and corners established on this survey as a result of.- a) Variances in the reference monuments; b) Discrepancies in record descriptions and plats; c) Inconsistencies in lines of occupation; d) Random Errors in Measurement (Theoretical Uncertainty); The Theoretical Uncertainty (due to random errors in measurement) of the comers of the subject real estate established by this survey is within the specifications for a Class "C" survey (+1-0.50 feet) as defined in IAC 865. POINT OF'BEGINNING D.R. 298,1PAGE 622 (a) PERIMETEO DESCRIPTION The within survey is based in pad upon a survey performed by WAe Engineers, Inc. on July 15, 2003, Job No. W03-0523. The within survey is also based in pad upon a survey performed by Miller SOUTH (D.) Surveying Inc. on April 23, 2004, Job No. B29531. —S 00'36*11" W (M-) The basis of bearings is assumed and referenced to the East line of the Southeast Quarter of Section 25, Township 18 North, Range 3 East. 32.21' The location of the comers and the lines of the subject real estate is dependent upon the location of the East line of the Southeast Quarter of Section 25, Township 18 North, Range 3 East, The East line of said Southeast Quarter was established from a copper pin found (5 inches below surface) at the Northeast corner and a brass plug found in a metal box (at the surface) at the Southeast comer of said Southeast Quarter. The Hamilton County surveyor ties for said Northeast comer called for a Harrison monument at the surface above a copper pin. The bra plug found at d Southeast 8 ss sai comer agrees with the ties. The distance measured between the two comers was 0.58 feet shorter than the distance shown on said Veihe" survey. There may be some error because the "Weilhe" survey calls for a p.k. nail set according to the surveyor tea at the Northeast comer. The Southeast comer of the Northeast Quarter of said Southeast Quarter was not searched for in the field. The location was established from holding the distance of 1322.63 feet from the Northeast comer of said Southeast Quarter as shown on said "Miller' survey. No surveyor ties were found for the comer. The uncertainty for all comers could be as much 0.6 feet. 3RD STREET SOUTHWEST J.W. MORROW ETAURIEGULATED DRAIN EASEMENT FTAI "B"14 A No monument was found at the Northwest comer of said Southeast Quarter to establish the North line of said Southeast Quarter. Said North line was established from holding the angular relationship of 89 degrees 00 minutes 54 seconds between the North and East lines of said Southeast Quarter as shown on said "Miller survey. The "Welhe survey shows an angle of 89 degrees 00 minutes 47 seconds between the quarter section lines. The right-of-way for Rangeline Road was determined from the plat of Warren & Phelps Addition (D.R. H, page 258) which shows a width of 66 feet. The West right-of-way line was calculated parallel with and 33 feet West of the East line of said Southeast Quarter as shown on said Velhe!'survey. In our initial analysis, the lots of said Warren & Phelps Addition were laid out from the record dimensions based on the location of the West right-of-way line of Rangeline Road as determined by the curb splits. The location of said right-of-way line was approximately 5 feet West of the right-of-way as determined from the East line of said Southeast Quarter. When holding the location based on curb splits the East line of Lot 17 of said plat does not fit the monuments found at the Northeast and Southeast corners of said lot by more than 5.5 feet and the building located on the West end of Lot 21 of said plat would encroach upon the Amoco site as much as 3.4 feet. From this information it was determined that the best Solution was to hold the location of the Quarter Section line as the center line of Rangeline Road. The right-of-way of 1st Street Southwest was determined from the record plat width and curb splits. There is approximately a 0.5 foot difference between the location of the street right-of-way as compared to the monuments found along the South line of said street. The East right -of -way line of 1 st Avenue Southwest was determined from holding the record plat dimensions West from the East line of said Southeast Quarter. The location of said right-of-way line lies only 0.6 feet West of a 518 inch rebar found near the Southwest corner of land described in Instrument No. 96-41553. An 8 foot board fence located along said right-of-way line appears to agree with the location of said right-of-way line as shown on the within survey. The right-of-way width of said 1st Avenue Southeast is uncertain. The bearing of the South line of land described in Deed Record 337, page 234 was determined from holding the angular relationship of the property located along 3rd Street Southwest described in Instrument No. 84-10733 as shown on said "Miller" survey. There are several internal deed gaps and overlaps as shown on the within survey. The discrepancies may be the result of properties being described from different section comers, lines described with cardinal directions, and distances shown only to the nearest foot. There is also an 8.5 foot gap between an East line of land described in Dead Record 337, page 234 and the West line of land described in Deed Record 337, page 234. This gap may occur because the West line of Deed Record 337, page 234 calls for the East line of Willow Street. No record of the location of Willow Street was found. Because there was no way to determine the location of Willow Street the distance call to the East line of Willow Street was held. There are also several gaps with adjoiners. There is a gap between the North line of the subject real estate and the South line of Lots 18,19 and the South line of land described in Instrument No. 96-41553. The gap varies from 4.1 feet to as much as 10 feet as shown on the within survey. There is also a gap between the South line of said real estate and the North line of land described in Instrument No. 200100069068. The gap varies from 3.4 feet to as much as 3.7 feet as shown on the within survey. The Southeast comer of the asphalt parking area that serves the vacant O'Malla's Bakery lies as murA) as 3.2 feet South of the South property line. All other occupation evidence is as shown on the within survey.
