Dear Mr. Hollibaugh:
The following items are included with the submission of our annual report:
An updated aerial photograph to serve as a mining progress report map.
Mueller Property South - 04040024SU, 05090003SU, 08030032SU, 05090003SU
• Mining activity on Mueller South consisted of processing raw material into a back-fill type
product used primarily on the Allisonville Road project. The amount produced on-site was
331,335 tons.
• The Blue Woods Creek relocation is working as designed and is being monitored by State
• and local agencies.
• The North Indianapolis site continues to employ a contractor to provide street sweeping
twice daily, in and around the entrance area of the 96th Street site. The plant purchased a
rotary broom sweeper to maintain in-plant roadways.
• The caution signals installed along 106th street to provide additional safety during times of
transporting material from the Mueller South property are functioning and inspected once a •
month.
• The blasting program at North Indianapolis has been continuously refined through a
cooperative effort with Vibra-Tech, Austin Powder, and Martin Marietta. Changes in Blast
sequencing, increased burden on the'front row holes, and smaller shot sizes are all part of
the effort to minimize blasting noise and neighbor disturbance.

• Water quality and water elevation monitoring have been ongoing on the Mueller properties
since 2003 based on the monitoring plan prepared by AquaFusion. Quarterly reports
summarizing water elevations and annual reports summarizing quality sampling results are
submitted to the Mr. John Duffy. Currently 13 wells, four groundwater sources (three lakes
and Blue Woods Creek) are monitored.
• Updates to the Spill Prevention Control and Countermeasures Plans for, the North
Indianapolis and Carmel Sand operations were submitted to the agencies designated in
the Commitments on February 24.
• A gate and landscaping was installed on the Mueller South property during April 2010. The
gate was installed on the 106th St entrance to prevent motorist from accessing Blue Woods
Creek. Trees and boulders'were installed to improve the aesthetics of the entrance and to
prevent the public from driving around the newly installed gate.
Mueller Property North - 05010021SU V
• The Carmel Sand Plant primarily operated five 10 hour production shifts Monday
• through Saturday during 2012. Seasonal shutdown occurred 12/14/12.
• Customer service hours were lam to 4:30pm Monday through Friday and 8am to 12pm
on Saturday during the loading season. The only exception was to supply the
Allisonville Road at 1465 project. Notification was sent to the D.O.C.S. for all
operations outside of the agreed upon hours
• Mine progression on Mueller Property North was not as significant as in past years.
The focus of the mining occurred on Martin Marietta property where the "old" plant was
located.
• The berm located near the Northern part of the property was relocated and seeded.
• Martin Marietta, Bernard Lally and Mike Thyen both Kingswood Neighborhood
residents, exchanged phone calls and emails to discuss the overall sentiment of the
Kingswood neighbors with respect to the new berm and seeding.
