Dear Carmel Board of Zoning Appeals Member:
I This past week we had a meeting before the Carmel Board of Zoning Appeals for 411 W.Main
Street, which is at the corner of Main Street and 4th Ave SW.
After listening to comments shared by the adjoining property owner and having discussions with
some of the neighbors after the meeting it was determined that it might be better to move the
proposed home back(south) on the lot.This would result in a 25' front yard setback and a better
eastern site line for the neighbor to the west.This plan adjustment resulted in the need for another
variance reducing the rear yard from 20' to 15'.The garage structure is the only portion of the
home that would adjoin the southern property (rear)setback.The garage is planned as a single
story, so there will not be a two story structure near the property line.
Revised Development Standards.Variances Requested:

requested at front with 15' allowed on corner only at roundabout radius
(changed from 15' requested previously)

FINDINGS OF FACT-DEVELOPMENT STANDARDS VARIANCE

Petitioner: The Old Town Design'Group, LLC
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The approval of a reduced rear yard setback will move the garage structure 5' closer to the
southern property line. The applicant has designed the garage a single story structure to reduce
the impact of the structure on site lines for adjacent properties.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The new structure proposed for this location will be of substantially greater architectural and economic value
than the previous structure on the property.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The courtyard design of the home results in a deep home plan and in order to create privacy for
the pool area from 4th Ave SW.Pushing the home further back on the lot allows for the desired
home plan to fit on the lot.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
