3. Docket No. 12090014 ADLS Amend: Woodgate Subdivision, Wall along 146th Street.
The applicant seeks approval for an 8-ft concrete wall to run along the backs of 11 residential lots along
146th Street to replace and existing wooden fence. The site is located near the intersection of Woodgate
Dr. and 146th St. The site is zoned R-1/Residence. Filed by Lyndon Craig Stiff, president of The
Woodgate Homeowners Association.
The applicant seeks approval for an 8-ft concrete wall to run along the backs of 11 residential lots along 146th
Street to replace and existing 8-ft tall wooden fence. The rear of these lots has a 10-ft wide drainage and utility
easement that runs along the rear of the lots, which abut the 146th Street road right of way. As you can see from
the photos, there are hydrants,power poles, and transformers near the area. The color will be grey, and the
pattern will look like stacked, cut stone. This item is before you this evening, because the Subdivision Control
Ordinance states that perimeter walls must be reviewed and approved by the plan commission. Please see the
petitioner's information packet for further detail.
The wall should not encroach into the road right of way, and should only be right on the property line. (The
wooden fence for Copperwood subdivision to the east currently encroaches into the road right of way, and we
do not want this wall to line up with that fence.)
The City Engineering Dept. reviewed this project and has no issues with this project moving forward. The
applicant needs to ensure that, during construction, all stormwater drainage is conveyed in this area to
perpetuate the existing drainage and that any low areas are addressed with a larger conveyance route
through/under the wall. A variance of City Code and a Consent to Encroach Agreement are required for the
wall to be constructed within the platted drainage easement. (The petitioner has already initiated this process.)
The Hamilton County Highway Dept. —the petitioner needs to submit correspondence showing that the
Highway Dept. is okay with the proposed wall location.
The City Utilities Dept. stated that there is a water main line in that vicinity that is close to the existing fence,
located underneath the sidewalk that is within the 146th Street road right of way. The petitioner should be
mindful of that and of the fire hydrants when erecting the wall.
Duke Energy would like verification that the concrete panels are removable that are near the power line poles,
so that they can have access to those poles, if they every need it. (Otherwise, they have no objections to the
proposed wall.)
Vectren Energy states that they have an 8-inch steel gas main on the south side of 146th Street, but it is within
the road right f way, so they probably won't have a problem with the wall, as it would be on private property.
Recommendation:
After all comments and concerns are addressed, the Planning Dept. recommends that the Commission approves
this item, subject to final review and approval by the City Engineering Dept. &Board of Public Works & Safety
(BPW).
