1. (V) Pete — Knight Pool, Pt of lots 17 & 18 in Echo Crest, Sec. 2.
The applicant seeks the following development standards variance approval for a new pool:
Docket No. 13030020 V ZO CH: 25.01.01B.3.a.ii Pool front yard setback on a corner lot.
The site is located at 11 107 Echo Crest Drive W. The site is zoned R -1 /Residence. Filed by Marge Mikels
with Pools of Fun, on behalf of the owners.
General Info:
The Petitioner requests variance
approval to build a new pool on a
corner lot, between the home and
111`h Street. This property is located
on the corner of 111th Street and Echo
Crest drive, to the west of Westfield
Blvd. The lot is surrounded by
single - family homes. Please refer to
the petitioner's information packet
for more details.
Analysis:
A pool is an accessory structure and
on a corner lot (which is considered
to have 2 front yards) it is not
permitted to be forward of the front
of the building. The proposed
location of the pool will be in what
currently functions as the side yard.
The pool will be setback about 83 feet from the 111th Street side and about 65 feet from the Echo Crest Dr. Side and it will
be behind the front of the building line on the Echo Crest Dr. side. Additional landscaping is also proposed around the
pool to help provide additional screening from the streets.
Due to the large setbacks and the increased landscaping, the pool should not affect the neighbors in a substantially adverse
manner and this should not have a negative effect on the community. The Department is in support of this variance
request.
Petitioner's Findings of Fact:
1. The approval of this variance will not be injurious to the public health, safety, morals, and general
welfare of the community because: pool will be installed by a registered contractor in accordance with the
City of Carmel and State of Indiana Residential Swimming Pool Codes and Ordinance. An automatic key
operated safety cover will be installed.
2. The use and value of the area adjacent to the property included in the variances will not be affected in a
substantially adverse manner because: installation of an in- ground swimming pool will not add "bulk" to
the property. Proposed landscaping which includes trees and vegetation that surround the site create a buffer
and is not intrusive to adjacent properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: this unique lot is considered to have double front yards,
preventing a pool in the "backyard" of the home.
Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 13030020 V.
