Analysis: - The new building and site plan was approved by the Plan Commission; however, it was conditioned upon final approval of construction plans by the Carmel Dept. of Engineering. (see Exhibit A.Letter of Grant) - The need to comply with the Carmel Transportation Plan was mentioned in the Preliminary Planning/Zoning Dept. review comments emailed to the petitioner. (see Exhibit B) However, this comment was not pursued during the review process by the Department. It appears to have been dismissed and not pursued by the petitioner either. In the Petitioner's response letter they state,no thoroughfare improvements required for this site. (see Exhibit C) - The requirement to indicate a 50-foot half right-of-way along Carmel Drive was mentioned in the Engineering Department review letter dated August 30, 2012;before the site plan was approved. (see exhibit D) The current Transportation Plan, plans for a 50 foot half right-of-way for Carmel Drive. This is not a new requirement and has been in place since at least 2010 when the Transportation Plan was last updated. Also, the Department of Engineering has indicated the need for this 50 feet of right-of-way as a there is the potential for another lane on Carmel Dr. coming off of Keystone Parkway that would be a dedicated right-turn lane. This lane would be a part of a more extensive solution to alleviate traffic concerns in this area. The requested 50 foot half of right-of-way would allow for this. The Department does not believe there is a practical difficulty in complying with the Zoning Ordinance and dedicating the additional 10 feet of right-of-way. The site plan would not need to be changed. The extra 10 feet would encroach into the perimeter landscaping proposed but should not affect the parking or other setbacks. A `Consent to Encroach' could be applied for from the Board of Public Works for the proposed landscaping to be within the right-of-way. It appears that there may be some extra room on the site plan for adjustments as well,if need be. 1 The Department is not in support of this variance request. Findings of Fact: 1. The approval of this variance will be injurious to the public health, safety, morals, and general welfare of the community because: it will hinder the City's ability to improve Carmel Drive, traffic flow, and safety in this area in the future. 2. The use and value of the area adjacent to the property included in the variances will be affected in a substantially adverse manner because: traffic flow could become worse in this area and the current right- of-way would make it more difficult to improve the street. 3. The strict application of the terms of the Zoning Ordinance to the property will not result in practical difficulties in the use of the property because: the approved site plan would not need to be changed and the McDonald's could be rebuilt as approved and used as intended. The extra 10 feet of right-of-way would not have an effect on the use of the property. Meters,transformers are generally in the rear of the facility either in the landscaping areas between drive through and rear wall or attached to the building. Where local utility companies allow,meters will be painted to match base building colors. Where transformers are in required free standing in landscaping area,transformers are positioned to hide behind menu boards and will be screened as best possible and as allowed by utilities. 17. Prepare an estimated construction cost to comply with the Thoroughfare Plan& Alternative Transportation Plan; contact the Engineering Dept.for more details, at 571-2441. No thoroughfare improvements required for this site. 18. Please verify with the City Engineering Dept.that no type of traffic analysis is required. None has been requested,although have reviewed ingress/egress points with Engineering and modified southern entrance as a result. 19. The project is scheduled for review at the September 19,2012 Technical Advisory Committee meeting. We offer the following comments: CONSTRUCTION DRAWING REVIEW COMMENTS 1. This project is subject to the City's Storm Water Management and Storm Water Quality Ordinances. 2. Will this development be platted? 3. Please provide a title sheet with the following: a. Project title,site location map,soils map,and index. b. Engineering firm's name,address,phone,fax,and e-mail address. The name of the Project Manager and the Owner/Developer. c. Legal description of site,zone district,setback distances. d. Professional Engineer's stamp. 4. Please omit Sheet C6.0p, Landscape Plan;and Sheet C7.Op,Site Lighting Plan, from construction sets to be submitted for review by this department. The Department of Engineering does not have approval authority over landscape plans or site lighting plans. 5. Please stamp the plans, "APPROVAL PENDING—NOT FOR CONSTRUCITON". 6. Please indicate on the plans and provide the City standard Commercial Driveway and Depressed Curb details. 19. Please label the entrance radii. The City standard commercial driveway requires a 30'radius. 20. The south entrance is located too close to Carmel Drive. Please remove this entrance. 21. Please provide a sidewalk along Keystone Way. Confirm with David Littlejohn, Alternative Transportation Coordinator,what other bicycle and pedestrian facilities are needed to accommodate this site. 22. All sidewalks within the public right-of-way shall meet the City standards. Please provide the City standard sidewalk detail. 23. All proposed ADA ramps within the public right-of-way shall meet the INDOT specifications for ADA ramps. Please provide the IN DOT standard details. 24. City standard curb is required for all curbing. Please indicate on the site plan,include the appropriate City standard curb details,and the City's Curbing Policy in the plans. 25. The maximum spacing of concrete curb control joints shall be 10 feet on tangents and 5 feet on radii. The maximum spacing of concrete curb expansion joints is.50 feet. • 6. Curb along Keystone Way shall be demolished to the nearest joint during the construction of any new drives. 27. Please ensure that all improvements remaining from the previous entrance to the site off of Carmel Drive are removed. 28. Please include a Maintenance of Traffic Plan,meeting all requirements of the Indiana Department of Transportation Work Zone Safety Manual current edition,for the construction of the entrances. 29. Please add the note as required in Storm Water Technical Standards Manual Section 102 "Permit Requirement and Procedures,"Article 102.02 vii pertaining to construction and approval of stone sewer systems to all storm sewer plan and profile sheets. 30. Please provide a drainage summary per Section 102.02(xi)(m)of the City's Stormwater Technical Standards Manual on the plans. 31. Please submit a Stormwater Pollution Prevention Plan,in accordance with the City of Carmel Stormwater Standards Manual Section 102.04 with the plan set. 32. The pond is located less than 50 feet from the Keystone Parkway right-of-way;however,the proposed grading appears to create a barrier from Keystone Parkway traffic. 33. Please provide the local flood routing through the site(all inlets plugged during a 100-year storm event). 34. Please provide the MFPG and MLAG for the building. 35. Please label the critical pond elevations for the detention facility including the 100-year, normal pool and top of bank. 36. Please provide the offsite receiving stormwater system on the plans. 37. Please analyze the receiving stormwater system and ensure it is not restrictive and will not require more detention on site. We will share Crossroad's comments as they are received • Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals(if required)are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. SWPPP is approved. f. All fees are paid. • The Department reserves the right to provide additional comments based upon subsequent reviews. • An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. o Dedication of right-of-way if not platted. The Maintenance Guarantee amount is based upon 15%ofthe Performance amount for Streets and Curbs and 10%of the Performance amount for all other improvements. • Performance Guarantees may he Performance or Subdivision Bonds or Irrevocable Letters of Credit. • Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING • Any work in the dedicated right-of-way will require an approved Right-of-Way Permit and a License R.Permit Bond. • The bond amount is determined by our Right-of-Way Manager.
