If you could please drop off or email me the plans for the house addition, that would be great. From your phone message, it sounds like you would need variance approval from the Board of Zoning appeals, and maybe even a Consent to Encroach approval from the BPW. Attached is the Variance application for the BZA, to get you started. There is actually a filing deadline coming up:tomorrow by 5 pm! Please get us the filled out application by tomorrow or Monday. The first step is to submit a plan to the Department of Engineering for review. This should be a copy of your plot plan indicating where the easements are located on your property, along with a sketch showing the locations of your proposed improvements. The Engineer will also want to know that you have received written approval from your Homeowner's Association (if your neighborhood covenants require such approvals). The Engineer will review your plan and make sure that the proposed improvements are not going to impede the City's use of the easement. The Engineer will also determine whether or not your proposed improvements will affect surface drainage. Upon the Engineer's approval, this Department will draft a Request for Variance to be placed on the soonest available Board of Public Works and Safety Agenda. The Board meets on the first and third Wednesday of every month and our Departments' deadline to submit items to the agenda is a week before each meeting. A condition of the variance will be that the property owners enter into a Consent to Encroach Agreement, acknowledging that if the City or any other easement holder needs to access their rights to the easement, the improvements could be damaged or may need to be removed at the property owner's expense.
