HomeMy WebLinkAboutMinutes PC 05-29-13 Executive Committee Hadley Grove1 1 City of Carmel EXECUTIVE COMMITTEE MEETING CARMEL PLAN COMMISSION MINUTES Wednesday, May 29, 2013, 6:00 PM Dept. of Community Services Conference Room, 3rd Floor of Carmel City Hall, One Civic Square, Carmel, Indiana 46032 Executive Committee Members Present: Alan Potasnik, Brad Grabow, Kevin Rider and Steven Stromquist Staff Members Present: Planning Administrator Rachel Boone, Director Mike Hollibaugh, Legal Council John Molitor, Plan Commission Secretary Lisa Motz Public: Mark — MI Homes Purpose: To discuss options to make the Hadley Grove PUD verbiage compliant with state statue. John Molitor — Council has re- written this ordinance and passed it the night before our April 16th PC meeting. Under state law, when Council makes an amendment to a zoning ordinance it has to go back to PC for further review. PC has 45 days to send back to Council for approval or disapproval or further suggestions. Changes were shown on page 14 of the ordinance. Kevin Rider — Purpose of amendments are to stop major changes in PUD's. John Molitor — BZA has absolute authority under state law to grant variances. Brad Grabow — It doesn't take it away from BZA but adds another layer. John Molitor — Which is unlawful. Brian Stumpf — It either goes to BZA for variance or you amend the PUD. John Molitor — It's not a variance if you identify it as a modification. Changes have been made under (vi) and under A. that state changes that require amendments of the Hadley Grove Ordinance must go through the standard rezone process including changes that alter the concept or intent of the PUD...City Council cannot take away BZA's right to grant variance. Another change (D and E) is to allow the Director the authority to weigh the circumstances surrounding the modification and grant a modification of the Development Requirements. In granting modifications, the Director may impose such conditions as will, in the Director's reasonable judgment, secure the objectives and purposes. B. was also amended to allow the Director to make Any Development Requirements. Brian Stumpf - Minor changes do not require public hearing. The Director can make those changes. John Molitor — recommends sending these changes back to City Council. Brad Grabow — Could this be interpreted as changes that alter the concept or intent? John Molitor — It would be up to the Director to determine. Steven Stromquist — Any other discussion? Do we have a motion? Alan Potasnik — Motioned to approve, Kevin Rider — Seconded motion, Steven Stromquist — Motion Approved. Possibility that this will be heard at the next Council Meeting on June 3rd.
