The applicant seeks approval for the following development standards variances:

The petitioner is requesting two variances. The first
variance is to have a temporary sign that is lit. The seconds.
variance is to have a sign that is off-premise. L PORTRAIT

The Townes at Weston Pointe is a town home development that ';. t r 7 'i 4
sits east of the Weston Pointe retail shops. One must take ' " 1
Weston Pointe Drive off of Michigan Road to access the l''.1 [ i
residential area. The sign is very visible without being lit; the ) '- `-,, it ;; :
colors are mostly yellow and green with some red and black .
text. The sign has been up for over a year already. The Townes ; , �_.-aw
has other signage violations upon the last site visit in January -, r ;,µ+ ; ,
(see photos). In addition to the temporary sign, there is a r`-. ' " " `
double-sided banner and an information center sign further in _. : '61 , x ,.r; '*
the development.
Findings of Fact: Off-premise sign
1. The approval of this variance will be injurious to the public health, safety, morals and
general welfare of the community because:
The sign is adjacent to Michigan Rd, where the road widening is taking place. A more appropriate sign
would be a permanent ground sign stating the whole residential and retail development's name, Weston
Pointe.
2. The use and value of the area adjacent to the property included in the variance will be
affected in a substantially adverse manner because: the sign may be a deterrent to drivers driving in a
construction zone. A more appropriate sign would be a permanent ground sign stating the whole
residential and retail development's name, Weston Pointe.
3. The strict application of the terms of the Zoning Ordinance to the property will not result in
practical difficulties in the use of the property because: the sign will have to be placed further in
the development, along Weston Pointe Drive, however advertising, websites, and flyers also spread
the word about the location of the townhomes.
Findings of Fact: illuminated temporary sign
1. The approval of this variance will be injurious to the public health, safety, morals and
general welfare of the community because: the light is not necessary for a temporary sign; the
information center that caters to possible patrons of the site will not be open when it is too dark
outside. The model home hours are 11 am—7 pm, at the latest. With spring fast approaching, there
is still some light at 7 PM.
2. The use and value of the area adjacent to the property included in the variance will be
affected in a substantially adverse manner because: the light is not necessary for a temporary
sign; the information center that caters to possible patrons of the site will not be open too late
when it is dark outside. The model home hours are 11 am — 7 pm, at the.latest. With spring fast
approaching, there is still some light at 7 PM.
3. The strict application of the terms of the Zoning Ordinance to the property will not result in
practical difficulties in the use of the property because: the sign can exist without being lit and
can be just as visible.
Recommendation:
The department recommends negative consideration of Docket Nos. 06010030 V- 06010031 V.
