Our contractor has come up with an alternate design that allows us to stay 10 ft from the property line,
so we do not need to pursue the variance request.

They would need to hire an engineer to determine the flow path width required to convey the amount of stormwater
displaced by the building addition.
So basically:
• What size flow path is needed to handle the stormwater which currently drains through their property in the area
of the proposed addition (stormwater which falls immediately where the addition is proposed and stormwater
upstream of this addition) combined with the stormwater that already flows through the 3.5 foot setback area?
• Is the 3.5 foot proposed setback sufficient to handle this amount of stormwater? Ideally any stormwater paths
between homes would be centered on the property line.
We would like to prevent one homeowner from burdening another homeowner with the sole responsibility of conveying
any shared stormwater drainage.
It would be my concern that the neighbor could possibly also build this close to the property line, and the 7 foot distance
between homes may not be wide enough for all of the stormwater. Or perhaps the City would have to prohibit the
neighbor from building this close to the property line (if the 7 foot path would not handle the drainage) which reinforces the
situation of burdening one homeowner with the sole responsibility of stormwater drainage.

Alexia,
We have looked at the plans for this proposed addition, and the Engineering Department can not support this. Without
any further engineering analysis submitted from the homeowner, it appears that the addition would be rerouting
stormwater from this property and burdening the property owner to the west with the responsibility to convey this
stormwater. Let me know if you have any questions.

Filing Dates&Deadlines. Petitioner, please note the following:
1. This item does not need to be on a meeting agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than May 18. Published notice is required within the
Indianapolis Star. Note: in addition to certified mailings to neighbors and public notice ad,the placement of a
public hearing sign on the property is also required by the BZA Rules of Procedure,Article VI,Section 6 (see
application). Make sure the public notice meeting time to the newspaper and neighbors reads 5:30 PM and the
location reads City Hall Caucus Rooms. It is suggested to send the notice to the Indianapolis Star newspaper by
Noon,two days prior to the printing deadline (317-444-7163 or email: publicnotices @indystar.com).
3. The Proof of Public Notice(newspaper affidavit, green cards, etc.) will need to be received by this Department no
later than noon,Thursday,May 24, 2012. Failure to submit Proof of Notice by this time will result in the tabling of
the petition.
4. The Filing Fee and Nine(9) Informational Packets must be delivered to BZA Secretary Connie Tingley no later than
NOON, Friday, May 18,2012. Failure to submit Informational Packets by this time will result in the automatic

5. This Item will appear on the TUESDAY, May 29, 2012 agenda of the Board of Zoning Appeals Hearing Officer
