Moore Proposal No. P10-0208 R1A Dear Les: We are pleased to submit this proposal to perform ongoing engineering consulting services for the referenced project. This proposal is presented in order to establish the additional services to be provided on a per request basis for our portion of the project. If no contract is executed, the terms stated in the previous contract will serve as the terms. Scope of Services It is our understanding that you wish for Walter P Moore to provide engineering consulting services for the above referenced matter that involves the Carmel Regional Performing Arts Center (CRPAC). We will provide engineering consulting support services as requested by the CLIENT that are within the area of the ENGINEER'S professional competence. Client-Supplied Information We understand that you will furnish us in a timely manner with full information regarding special conditions or criteria for this case or special services needed, and also make available to us all pertinent existing data of which you are aware. Fee Due to the nature of the work, we are unable to estimate what our fee may amount to for our services. We propose to provide the indicated Basic Services on a time and expense basis in accordance with the terms in our previous contract, Staff working on this project will be billed in accordance to the previously submitted hourly rates. Our fee for Basic Services does not include sales tax or reimbursable expenses, as applicable. Miscellaneous project-related out-of-pocket expenses will be reimbursed on an actual cost basis plus 10%, as described in the attached schedules. If this letter agreement satisfactorily sets forth your understanding of our agreement, please sign the attached copy and return it to us so that we can continue working with you on this case. Mileage will be charged at the prevailing federal rate of reimbursement. Note:Rates are subject to change on a yearly basis starting in January of the year. With that in mind our work on the Carmel Litigation support matter David Bowers continues. Typically it is very difficult to set up a `not to exceed' number for Vice President any given period of time. However, I do understand your need to have a target budget. With that in mind, 1 suggest that we set an initial budget for Bradley Meyer (Project M041000100) Walter P Moore labor and expenses of$650,000 NTE Secretary for the 2013 on the litigation support portions of the case. This appears to be Tom Crowley a realistic budget for the year for the litigation support efforts. If there are Commissioner any deviations we will seek authorization before moving forward on it.
