Angie, I do have two comments...
1. Since the only access will be from 96th Street and this access must cross the legal drain,they must construct an
all weather access(meaning a driveway that is not submerged during the 100-year rain event) unless the Carmel
Fire Department is OK with the drive being under water.
2. They will need to dedicate road right of way consistent with the thoroughfare plan.

Yes, I received the plan, this format will be adequate. However, I do have some comments yet to be
addressed.
The following email represents comments for this project specifically addressing the area of urban forestry. I
have reviewed the drawing and offer the following comments:
URBAN FORESTRY REVIEW COMMENTS
1) Please note any existing shrubs that surround the foundation. Foundation plantings are a
requirement of the overlay (23C.10.02.2). I inspected the site today and it seemed that basically
only the front had any shrubs, the requirement is for plantings to be included along all sides of any
building. Additional foundation plantings will need to be labeled and installed. I am fine if it is on
the same submitted landscape plan.
2) With that, please use and add to the plan the attached Carmel planting detail.
Please illustrate how these comments will be addressed by letter or revised plan. If you have any questions, feel free to

The following letter represents comments for this project specifically addressing the area of
alternative transportation. I have reviewed the project submitted for the June 15, 2011 Technical
Advisory Committee meeting, and offer the following comments:
Alternative Transportation Review and Comments
1) The Bicycle and Pedestrian Plan requires the construction of a 10' asphalt path along
96th St. Please revise the plans to include and label these facilities.
2) The City of Carmel Parking Ordinance requires that all commercial developments
include bicycle parking. Bicycle parking spaces are required at a rate of five(5)
bicycle parking spaces per one hundred (100) automobile.parking spaces with
minimum of four(4)spaces. Please see the City of Cannel's Parking Ordinance in
order to determine the appropriate locations and construction details for the above.
. We request that all responses to our comments be provided in writing. Failure to provide written
responses may result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-
submitted, particularly if any such changes are considered "new" or fall outside of our previous
reviews. Please provide revised plans indicating all revisions. Please notify us of any changes

system. The Indiana State Department of Health Sanitary Engineering Division will need to approve the plans for any

While I have not been by there in the last few weeks, last time I was there they had 5 cars
there and 6 guys in suits came out of the house to looks at the flooding I was there looking
at. Now, that may not necessarily means it is being used as commercial, but a few on them
stated they drove through other flooded road to get there that morning. Seems a little fishy
if it is a residential use.
Now, while I can't tell you not to investigate the use, I know the county is in the process
of purchasing ROW for the road project. The cost of the ROW is cheaper if the parcel is
zoned residential and has no use variance for commercial, that way the county is not paying
commercial rates for the ground. Also, with our drainage project, the cost to replace the
driveway crossing may be more then the entire parcel is worth as residential, and the option
to buy out the entire parcel may not be out of the question. So while it is illegal for them
to be. using the property as commercial, I don't want to trigger something that may end up
costing Hamilton County more money in the long run.

Have the current owners of 3610 W 96th Street talked to you or your department about
redevelopment or a use variance on this parcel? It appears to be zoned S-1 per your GIS
webpage but also appears that it is currently being used as commercial. We are being work on
a drainage project there in coordination with the road project and I was told they were going
to redevelop that site, but I have nothing that confirms that. Let me know if you have heard
anything.
